***** In August 2008, Congress passed legislation requiring all toys and clothes for children, even handmade, to be certified by third-party testing facilities to be free of lead and phthalates. While product safety is important (I'm a Mom TOO), the problem with this is that it can cost $100 or much more per item for testing. This is just not financially feasible for anyone making handmade items. Would you want to pay $103 for my mini cupcakes?
The CPSC has issued a one year stay of enforcement on the testing portion of this law. This is good news for small businesses. However, this struggle is far from over.
It is very likely that anyone selling handmade toys or clothing for children on Etsy or anywhere will have to cease operations as of February 10, 2010. If you feel as strongly as I do that this not happen, please find out all you can about the Consumer Product Safety Improvement Act (CPSIA) and write to your representatives and the CPSC to see if there can be some sort of amendment to keep small businesses up and running!
