General Terms and Conditions of the Etsy shop “Leocardia”


Vendor, inclusion by reference of the General Terms and Conditions

(1) The vendor and contracting party for the merchandise presented in the Etsy shop “Leocardia” is Ulrike Gremmer, Lindenschmitstr. 45 D-81373 Munich, Germany (referred to hereinbelow as the “Vendor“ for short).
(2) The present General Terms and Conditions are a component part of any contractual agreement made between the Vendor and the respective customer. The Vendor hereby objects to any terms and conditions that the customer may have established and that contradict the present General Terms and Conditions.



________Merchandise offered and conclusion of contract

(1) The Vendor is offering the articles presented in the Etsy shop “Leocardia” for sale to other Etsy users.
The colors of the articles shown on the website may vary slightly depending on the internet browser and monitor settings used by customers; these variations are technically unavoidable.
(2) The selection of merchandise, conclusion of contract and implementation of the agreement shall take place, to the selection of the customer, in German or English.
(3) The Vendor shall deliver the merchandise to destinations in the United States of America (USA).
(4) Customers shall select the merchandise desired by placing it in their “shopping cart” („Warenkorb“) by clicking on the button “Add to cart“ („In den Warenkorb“). The order will be conclusively placed with the Vendor by clicking on the button “Submit Order” („Bestellung abschicken“). Until the order is transmitted to the Vendor, customers have the opportunity to review, at any time, the data they have input when placing the order, to modify them or to completely discontinue the order.
(5) The Vendor is making a binding sales offer for the merchandise presented in its shop. By transmitting the order using the button “Submit Order” („Bestellung abschicken“), the customer accepts the sales offer. The Vendor shall confirm the conclusion of the contract by e-mail (contract confirmation).
(6) The content of the contracts concluded is stored in the customer’s Etsy user account and may be viewed by the customer at any time in the Etsy portal by clicking on the item „Purchases“ („Einkäufe“) in the “Your Account” („Dein Konto“) menu.
(7) The Vendor shall inform the customer by e-mail of any impediments preventing the delivery from being made, or of any other circumstances that might prevent contractual performance. Partial deliveries shall be made only with the customer’s prior consent.

________Prices and payment
(1) All product prices are end prices plus shipping costs. Depending on the type of product bought, the prices include turnover tax in the amount 19%.
(2) The shipping costs are listed in the respective product description under the menu item “Shipping” („Versand“).
(3) Where deliveries are made to the United States of America customs or acquisition tax for imported goods may have to be paid by the customer to the customs authorities upon receipt of the shipment. These duties will accrue in addition to the purchase price and the shipping costs; the Vendor has no means of influencing them.
(4) The Vendor shall deliver the merchandise against pre-payment in US-$ using PayPal.

Allgemeine Geschäftsbedingungen des Etsy-Shops “Leocardia”

________Anbieter, Einbeziehung der AGB

(1) Anbieter und Vertragspartner für die Waren im Etsy-Shop “Leocardia” ist Frau Ulrike Gremmer, Lindenschmitstr. 45 81373 München Deutschland (im folgenden kurz „Anbieter“).
(2) Diese allgemeinen Geschäftsbedingungen sind Bestandteil jeder vertraglichen Vereinbarung zwischen dem Anbieter und dem jeweiligen Besteller. Entgegenstehenden AGB des Bestellers wird widersprochen.


________Warenangebot und Vertragsschluss

(1) Der Anbieter bietet die in seinem Etsy-Shop “Leocardia” dargestellten Artikel anderen Etsy-Nutzern zum Kauf an. Die farbliche Darstellung der Artikel auf der Internetseite kann je nach verwendetem Internetbrowser und Monitoreinstellungen des Bestellers geringfügig variieren; diese Abweichungen sind
technisch nie ganz vermeidbar.
(2) Warenauswahl, Vertragsschluss und Vertragsabwicklung erfolgen nach Wahl des Bestellers in deutscher oder englischer Sprache.
(3) Der Anbieter liefert ausschließlich in die Vereinigten Staaten von Amerika (USA).
(4) Der Besteller wählt die gewünschte Ware aus, indem er sie in den „Warenkorb“ legt („Add to cart“). Der Bestellwunsch kann nach Eingabe der PayPal-Daten des Bestellers abschließend über den Button „Bestellung abschicken“ („Submit Order“) an den Anbieter übermittelt werden. Der Besteller hat bis zur Absendung seines Bestellwunsches jederzeit die Möglichkeit, die im Rahmen der Bestellung angegebenen Daten einzusehen und zu ändern oder die Bestellung ganz abzubrechen.
(5) Für die im Shop des Anbieters dargestellten Waren gibt der Anbieter ein verbindliches Kaufangebot ab. Mit der Absendung des Bestellwunsches über den Button „Bestellung abschicken“ („Submit Order“) nimmt der Besteller das Kaufangebot an. Der Anbieter bestätigt den Vertragsschluss per E-Mail (Vertragsbestätigung).
(6) Der Inhalt abgeschlossener Verträge wird im Etsy-Nutzerkonto des Bestellers gespeichert und ist für den Besteller im Etsy-Portal jederzeit einsehbar über das Menü „Dein Konto“ („Your Account“) unter dem Punkt „Einkäufe“ („Purchases“).
(7) Bei Lieferhindernissen oder anderen Umständen, die der Vertragserfüllung entgegenstehen würden, informiert der Anbieter den Besteller per E-Mail. Eine Teillieferung erfolgt nur nach Zustimmung durch den Besteller.

________Preise und Bezahlung

(1) Alle Produktpreise verstehen sich als Endpreise in US-Dollar/ bzw. Euros zzgl. Versandkosten. Die Entgelte enthalten 19% Umsatzsteuer.
(2) Die Versandkosten sind bei der jeweiligen Produktbeschreibung unter dem Menüpunkt „Versand“ („Shipping“) aufgeführt.
(3) Bei Lieferungen in die USA können Zoll und Einfuhrumsatzsteuer anfallen, die vom Besteller beim Empfang der Sendung an die Zollbehörde zu entrichten sind. Diese Abgaben fallen zusätzlich zum Kaufpreis und den Versandkosten an und sind vom Anbieter nicht zu beeinflussen.
(4) Der Anbieter liefert ausschließlich gegen Vorkasse mittels PayPal-Zahlung in US-Dollar.

________Shipping
Shipment, delivery periods
(1) The Vendor shall submit the merchandise to the shipping company within the time given in the item description.
(2) Unless otherwise provided for in the item description,
* The shipping time from the moment of payment is about:
-Europe: 7-14 business days
-USA: 10-20 business days
-Canada: 10-20 business days
-Australia and everywhere else 10-20 business days
Delays are possible during busy periods around HOLIDAYS!
(3) Where a delivery cannot be made because the customer has provided a wrong delivery address or the address is incomplete, an attempt to once again deliver the merchandise shall be made only if the customer accepts to bear the costs of re-shipping the merchandise. The re-shipping costs correspond to the shipping costs agreed at conclusion of contract. The Vendor shall inform the customer of the costs of re-shipping the merchandise by e-mail. The re-shipment shall be made only upon receipt of payment for these costs.


________Versand, Lieferfristen

(1) Der Anbieter übergibt die zu liefernde Ware innerhalb der in der jeweiligen Produktbeschreibung genannten Zeitspanne ab vollständigem Zahlungseingang an das Versandunternehmen.
(2) Soweit in der Artikelbeschreibung nicht abweichend angegeben, dauert der Versand
-innerhalb Europas 7-14 Werktage
-in die USA 10-20 Werktage
-nach Kanada 10-20 Werktage
-nach Australien 10-20 Werktage
Verzögerungen sind zu Zeiten erhöhten Versandaufkommens wie z. B. Ferien möglich.
(3) Wenn die Lieferung an den Besteller fehlschlägt, weil der Besteller die Lieferadresse falsch oder unvollständig angegeben hat, erfolgt ein erneuter Zustellversuch nur, wenn der Besteller die Kosten für den erneuten Versand übernimmt. Die erneuten Versandkosten entsprechen den bei Vertragsschluss vereinbarten Versandkosten. Der Anbieter wird dazu dem Besteller die erforderlichen Kosten einer erneuten Zustellung per E-Mail mitteilen. Ein erneuter Versand erfolgt erst nach Zahlungseingang dieser Kosten.
