Breaking News: The CPSIA Mandatory Testing & Certification Proposed 1 Year Suspension

We are so excited to announce that the Commission has voted for a "Stay of Enforcement of Certain Testing and Certification Requirements of CPSIA" — which means that they are proposing a 1 year suspension of the burden of lead testing and certification while they take more time to review the rules and plan enforcement!  All of your hard work is paying off (for the time being at least!).  You wouldn't have to pay to do the certification and testing, though you are still liable if your products are found to have lead. We are so pleased that artisans and vintage sellers got their voices heard. Your hard work is not over; we must continue to play a role in advocating for small business people throughout the coming year.

CPSC Grants One Year Stay of Testing and Certification Requirements for Certain Products

Washington, D.C. – The U.S. Consumer Product Safety Commission voted unanimously (2-0) to issue a one year stay of enforcement for certain testing and certification requirements for manufacturers and importers of regulated products, including products intended for children 12 years old and younger. These requirements are part of the Consumer Product Safety Improvement Act (CPSIA), which added certification and testing requirements for all products subject to CPSC standards or bans.

Significant to makers of children’s products, the vote by the Commission provides limited relief from the testing and certification requirements which go into effect on February 10, 2009 for new total lead content limits (600 ppm), phthalates limits for certain products (1000 ppm), and mandatory toy standards, among other things. Manufacturers and importers – large and small – of children’s products will not need to test or certify to these new requirements, but will need to meet the lead and phthalates limits, mandatory toy standards and other requirements.

The decision by the Commission gives the staff more time to finalize four proposed rules which could relieve certain materials and products from lead testing and to issue more guidance on when testing is required and how it is to be conducted.

The stay will remain in effect until February 10, 2010, at which time a Commission vote will be taken to terminate the stay.

The stay does not apply to:

  • Four requirements for third-party testing and certification of certain children’s products subject to:

    • The ban on lead in paint and other surface coatings effective for products made after December 21, 2008;

    • The standards for full-size and non full-size cribs and pacifiers effective for products made after January 20, 2009;

    • The ban on small parts effective for products made after February 15, 2009; and

    • The limits on lead content of metal components of children’s jewelry effective for products made after March 23, 2009.

  • Certification requirements applicable to ATV’s manufactured after April 13, 2009.

  • Pre-CPSIA testing and certification requirements, including for: automatic residential garage door openers, bike helmets, candles with metal core wicks, lawnmowers, lighters, mattresses, and swimming pool slides; and

  • Pool drain cover requirements of the Virginia Graeme Baker Pool & Spa Safety Act.

The stay of enforcement provides some temporary, limited relief to the crafters, children’s garment manufacturers and toy makers who had been subject to the testing and certification required under the CPSIA. These businesses will not need to issue certificates based on testing of their products until additional decisions are issued by the Commission. However, all businesses, including, but not limited to, handmade toy and apparel makers, crafters and home-based small businesses, must still be sure that their products conform to all safety standards and similar requirements, including the lead and phthalates provisions of the CPSIA.

Handmade garment makers are cautioned to know whether the zippers, buttons and other fasteners they are using contain lead. Likewise, handmade toy manufacturers need to know whether their products, if using plastic or soft flexible vinyl, contain phthalates.

The stay of enforcement on testing and certification does not address thrift and second hand stores and small retailers because they are not required to test and certify products under the CPSIA. The products they sell, including those in inventory on February 10, 2009, must not contain more than 600 ppm lead in any accessible part. The Commission is aware that it is difficult to know whether a product meets the lead standard without testing and has issued guidance for these companies that can be found on our Web site.

The Commission trusts that State Attorneys General will respect the Commission's judgment that it is necessary to stay certain testing and certification requirements and will focus their own enforcement efforts on other provisions of the law, e.g. the sale of recalled products.

these requirements will need to be addressed by Congress.

The stay of enforcement does not provide relief for the charities, thrift shops, resellers and small retailers who are
impacted especially hard by the retroactive effect of the lead ban to existing inventory. While these groups do not
have a legal requirement to test their inventory, they must meet all standards enacted by Congress. Thrift shops,
charities and other sellers will have to decide whether they will continue to sell children’s clothing and other
products that have not been tested, even though no one has suggested that they are unsafe. The retroactive nature
of the lead ban has caused much of the concern that has been voiced over this law but Congress will need to
address that issue; the CPSC cannot."

As you can see we are not off the hook, the stay is only saying they are not going to enforce it right now and allow more time for them to address the concerns, rule on exemptions and put into place testing protocols. Plus the Stay gives the CPSC time to work on other issues that they are having to deal with each day, such as the recent crib reall. In essence the Stay is giving them a break to not have to deal with enforcing it right now. It's not relieving us of the original intention of the law.

In fact it references back to the same clarification they released Jan 8, which said thrift shops and resellers don't have to test, but you're also not suppose to sell inventory that is not compliant. It does not relieve businesses s from complying with the requirements (such as making sure your inventory is compliant and the finished product you sell is compliant) enacted by Congress that start Feb. 10th. Changes to those requirements have to be fixed by Congress not her department. Commissioner Nord has just bought some time for herself and her department in dealing with the issues. She's basically asking for more help, funds etc. Once she is awarded that I'm sure the law will be enforced just as it had originally be set forth.

Please don't think this has gotten everyone off the hook. The law still has to be "reformed" and efforts still need to be made in that direction.

Glad I'm getting my products XRF tested so that I can be sure of compliance, but man, I'm breathing a sigh of relief that they won't be enforcing the certificate and third party testing requirement for a year. This "stay" is nothing but political tap-dancing and yet another example of the government talking out of both sides of their mouth. We gained nothing with this stay. Under the CPSIA, the state attorneys general can still pursue manufacturers and retailers for products which are not compliant with the Feb. 10 lead and phthalates standards. If you don't test, then how do you assure compliance?

Also, if you sell to retailers, they are still going to ask for proof of compliance in the form of testing reports and/or certificates of compliance so they limit the legal liability of their inventory. So the fact that the CPSC has granted a stay for testing and certificates is moot.

Back to the drawing board, folks....

The bullet has been 'dodged' for 'now'. But what do the home crafters/small business/ and artists do a year from now?

The problem here is not 'when' the law takes affect. The problem is that the law needs to be AMENDED NOW so that small businesses/crafters etc... won't go bankrupt when this FARCE of a LAW goes into effect!

I agree with cindyjoy that we need to move now to be in 'compliance' with the law. BUt as long as we must still send our things to third party's in order to test (costing $500 to $4000 PER ITEM), there will be more and more people wrongly being forced into bankruptcy!

In short, NOTHING has changed! And in order for US to be in COMPLIANCE things need to.

I still say it's WRONG to have to test a MUSLIN doll, including muslin clothes (dyed with onion skins) for LEAD and PHYLANTES, and the same goes for the PLAIN white TEE SHIRTS.

Hi! As a huge supporter, buyer and seller of children's hand-crafted goods, I am happy to hear about the 1 year stay of execution.

HOWEVER....

We are still required to COMPLY by February 10th as indicated by a poster on January 30th (see above).

I have spent weeks trying to make heads or tails of the CPSIA regulation - reviewing official CPSA sites, whitepapers, legal documents, contacting 3rd party lab experts, speaking with fellow designers and attorneys.

As frustrating as it is, I believe I'm almost there! The last big hurdle has been to craft and provide the required General Certificate of Conformity "GCC". There is little guidance AND NO samples out there!!!

I found only one site that provides a very good illustration of one that I am happy to share:

I've been able to download this sample and adjust it with success to my own goods.

I have been hesitant to craft toys, dolls etc.
As I only knit and crochet, there is no way any of these items would contain lead, etc. I understand the lead in paint thing, but, it is hard to find out, but does this apply to this type of craft? (knitting or crochet).

I know of one other person who no longer makes knitted or crocheted toys due to this.

I am so pleased, I want to share a paragraph of a letter I sent to a friend (an Old neighbor), who is now a senator;
You know many schools and churches use craft shows to raise money. With the CPSIA safety act looming these shows will decrease by at least half, cutting back on income for our schools and churches, if you expand even broader, the Grand Rapids festivals will be hurting too, causing less revenue to evolve, this will only add to the spiraling downfall of the economy. I love handcrafting not just to help survive, but to also fulfill a dream of providing handmade items to people who understand the love that goes into every item made, crafting is a way of life for many, it is to us, what government is to you.

From a mom's standpoint I don't think that it's good news at all that products I buy for my child may or may not have lead, "who knows?" because no one's being held accountable for it. I'm unpopular I'm sure but I don't think a little profit takes precedence over the safety of our kids (and I wouldn't be too crazy about getting lead poisoning either). Our goverment failing us again.
NOT doing ANYthing doesn't fix things.

wiiildfire, I agree with you that protecting children is of utmost importance. But I also think that there is a difference between a huge factory in China paying for certification and testing vs a one-woman (or man) shop who is crocheting or making handmade toys, etc. Etsy is trying to get the voices of those micro-businesses heard. We are hoping that there will be an end result that protects children and also takes a realistic stance with regards to small businesses.

So many scenarios in a business like this. Think about it: Panamacitymamma1313 likes to make jewelry from "found" pieces. Recycling is chic right? Only her found pieces include junkyard pickups from the last hurricane, perhaps some lead infused piping from old buildings. She doesn't know. Neither does granny who loved the charm bracelett. Neither did grandson who chewed the charm bracelett and got lead poisoning. This stuff happens all the time, that's why moms like me pushed for these laws. I'm sorry but this isn't the middle ages where we just hope our kids will survive to adulthood and if they don't it must be the black magic.

I'm not trying to be mean. I'm not the enemy. I heart work-from-home crafters too. But when so much of it comes from things like recycling items that may or may not have been recalled (I have 125 recall emails from the CPSC in the last year and half, including a lot of children's clothing and such for lead in the decals), the question is who is going to be responsible?

I just wanted to make sure you were all aware that Ron Paul was the only representative in the House to vote against the original bill calling for these ridiculous testing burdens on small businesses for this very reason. This is great news for all American manufacturers of children's goods. It seems that US small businesses should not be penalized for something that stemmed from overseas imports...why not try to put stricter guidelines on the import process? And if they are going to require testing of children's goods, I am surprised legislators are not trying to go a step further...my son likes to chew on picture frames, and anything else he can get his little 13 month hands on- these wouldn't be tested under the law. Nursing babies spend half their time on their mother's chest, why not test mother's clothing too? See my point...there has to be a limit to this type of legislation, they can't just make it so broad and general. It isn't fair to punish US small businesses who are just trying to make a way in the world!

great news! Now I can get my line of clothes for toddlers
up in my shop. Our hard work has payed off, but we need to stay on it and make sure that our products are safe for children, especially those things that are most likely to go in childrens mouths. Thank you all for the hard work!

Wildfire, no one is saying that children should not be PROTECTED.

We are saying that having to test madagascar raffia, pine needles, muslin, wood, 100% cotten, and of course naturally dyed fabrics (that have been dyed with onion skins of all things) is nothing more than OVER regulation.

And for you to say it's only a 'small' loss (or a small inconvenience) to have to test each item individually, is the understatement of the YEAR.

The fact is that it will cost between $500 and $4000 per item to be in compliance with the law. Oh and that does NOT include the shipping and handling of the items to have them sent to the 'approved' testing facility.

For many of US, that's no slight monetary loss. That is BANKRUPTCY!

And just because it doesn't affect SOME PEOPLE, doesn't make it RIGHT!

I agree with " littledebrarae", it is gross Over regulation. Also who will be overseeing the testing of all the foreign junk from China which is the bulk of the consumer concern in the first place. I used to own a paint store and I can tell you that lead based paint has not been manufactured in the USA for Many Many years.

This would definately not be a good thing for an already struggling USA economy.
Everyone needs to continue to write and email their legislators and let them know what an incredible business killer this bill would be if allowed to pass. Not to mention the cost it would pass on to the consumer.
