Hello and welcome to novo + leef's Etsy shop ♥

In case you missed our Profile, we offer for sale beautiful and collectible 20th century objects that we carefully source from around the world. We also design and create functional, limited edition, hand made objects. Each of our hand made creations is imprinted to ensure authenticity and originality.

We do not run a Facebook page or Twitter feed. We prefer to communicate on a more personal basis with our customers, email works well to start with.

Our Contract

Our Shop Policies are likely to have the answer to a question that you may have. We encourage you to read our Shop Policies and review our item descriptions carefully before you buy. When you buy an item from us, this Welcome and our Shop Policies, together with the description of the item that you buy, set out the terms of our agreement.

Accepted payment methods

Returns and exchanges
Your Insurance Choice

Your chance of recovering money for a damaged, lost or stolen item, in exchange for a return in accordance with our Refund Policy, depends on which insurance option that you decided on when choosing your delivery method. Refer to our Shipping Policy for further details about risk, ownership and insurance.

Descriptions

We describe the items we are selling in a detailed way, using a combination of words and photographs. Our policy is to be open and fair with our descriptions. We do rely on third parties to provide us with information about our items. Please consider your purchase carefully before you commit to buy. You are welcome to seek further information from us before you buy.

Items are Often Originals

Our items are often originals or uncommon. Replacement of your item in the event of loss, theft or damage in transit or a defect is not an option in these circumstances and we do not offer repairs. You accept that these are risks of your purchase over the internet, requiring delivery of your item to you via a third party delivery company.

Transit Risks

You are only entitled to a refund for delay, damage, loss or theft or other delivery risks to the extent that the insurance policy effected in relation to delivery of your item pays out on a claim. You must also:

1. Keep the original packaging in useable condition.

2. Email us within 14 days of delivery of your item with a description and photographs to help us fully understand the problem. If we do not receive such an email with that period, you agree that you have accepted the condition of your item as satisfactory and fit for use, free from damage or defect.

3. Do not use or mark your item.

4. Return the item to us, in its original packaging and otherwise well protected, at your cost (unless of course it has been lost or stolen). We need to receive your item within a further 7 days after you send the email in 2. above, with tracking details notified to us and transit insurance to the value of the purchase price.

5. If you are claiming a refund due to a risk that you chose insurance for, then we will work with the company that delivered your item to process your request within 14 days after we receive the returned item (unless it has been lost or stolen) and your email in 2. above. We will do what is reasonable to process an insurance claim in relation to your item and you will assist us to do this. If the insurance company refuses a claim, we are not obliged to pursue it.

Defects

If you are claiming a refund due to a defect due to something other than a transit risk, then the procedures in 1. to 4. above apply and we will notify you of our decision whether we consider there is a defect in the item within the same 14 day period as in 5. above.

You accept that the existence of a defect does not of itself qualify you for a refund. If we consider that the product is reasonably fit for the use as described for sale, taking into consideration the age, condition, use, warnings and other information that is express or implied in the product description and our agreement, then no refund will be offered.

If we consider that the product is not reasonably fit for the use as described for sale, taking into consideration the age, condition, use, warnings and other information that is express or implied in the product description and our agreement, a full refund be offered.
Payment
Seller

Novo and Leef Pty Ltd ATF the N&L Trust operates this shop and is the seller. Our trading details are provided in Seller Information.

Time of Agreement

Your offer to buy starts when you electronically send your purchase order to us. Our agreement to supply starts when we have received cleared payment in full for your completed order and we have confirmed your purchase order by email. Our packing and delivery time estimates start from when our agreement to supply starts.

Currency

All prices are in Australian dollars (AUD).

Payment

You agree to pay for your purchase (including all delivery and insurance costs) in full at the time that you electronically submit your offer for an item.

We accept payments through PayPal, which is an intermediary between us and you to transact payment. PayPal has a developed payment security and privacy policy, which you can view at www.paypal.com.au.

We both agree to be bound by terms set by PayPal when using this method of payment. You can learn more about PayPal and their terms by browsing www.paypal.com.au and you agree with us that you will do this before you buy.

PayPal Buyer Protection

We suggest that you select buyer protection before you check out from PayPal's payment page. This offers additional protection for you on the terms of their buyer protection policy. You can browse further information about buyer protection through PayPal at www.paypal.com.au.

Other Methods

If you do not want to use PayPal, please contact us by email at info [!at] novoandleef.com.au. We will do what we can to make other payment arrangements with you, but we can refuse other payment methods in our discretion.

Cancellations

We will use our best endeavours to meet all orders. However, we reserve the right to cancel your purchase by notice to you at any time and without having to give any reason. Any cleared payment by you must be refunded to you in full if a purchase is cancelled by us. Your refund must occur as soon as reasonably possible after the cancellation has been effected. We update our site as soon as possible after a sale has been transacted, but cleared funds do need to be received before we declare the item sold.

Taxes and Other Fees

If Australian GST is payable, it is included in the price. Otherwise, as the buyer, you are responsible to understand and pay for any import duties, customs clearance fees, sales and other taxes and other costs and charges that may apply to your purchase. We are not obliged to complete delivery (and delivery will not be made) unless these expenses are paid when requested by the relevant authority, or by us. We do not offer advice about tax, import duties, customs fees or other expenses incurred in exporting or importing our items.
Shipping
No Profit on Delivery or Insurance

You only pay the actual cost of delivery and insurance, so that we can pay the selected company. We do not profit from arranging estimates for your delivery fees or your insurance.

Freight and Courier Companies

We only obtain our quoted estimates from DHL. The listed quote includes tracking and we require tracking as a feature of any delivery method. These are the standard delivery options.

Remote Areas and Express Options

Areas not within the metropolitan area of a specified city will attract a delivery surcharge, which you must pay on making your offer to buy. Other charges will also apply for faster deliveries. Please contact us before you purchase to obtain a quote for non-standard delivery options.

Risk and Ownership

Delivery companies that we use are not our agents, representatives or our employees and we are not responsible for how they do business. We offer delivery to you on the terms that the delivery company offer us as their customer.

Risk in and ownership of your item passes to you when we deliver your item to the company responsible for delivery, which will occur in Melbourne, Australia.

Your risk is only covered to the extent that a claim is paid under the insurance that you decide to pay for and under our Returns Policy.

Insurance

We include in our estimates an option to select insurance for the purchase price of your item, for risks specified by DHL on their website.

Packaging for Despatch

When we have reached a sale, we will pack your purchase and provide it to your selected company for delivery. We ask that you dispose of your packaging thoughtfully.

Our Environment

We use packaging supplied to us by DHL. DHL has a carbon reduction plan and developed environmental policies. Usually our packing process takes less than 24 hours. Where DHL does not supply an economical standard packaging size, we source recycled packaging for your item.

Confirmation of Departure

We will contact you to let you know when your purchase has been despatched and provide you with a tracking number. Standard delivery tracking numbers can take at least 24 hours to issue and to provide to you.

Delivery and Signing

A person must be at your delivery address and sign for your delivery before it is handed over. If there is nobody at the address to accept the delivery, a notification card will be left letting you know what to do.

Delivery Address

We know that you are careful about these things, but please check that your contact and delivery details are correct. You cannot redirect your delivery to a new address after we have handed it to your courier.

Inspection

Please inspect your item on delivery. If you discover that your item has been damaged in transit, take detailed photographs of the damage, retain all of the original packaging and refer to our Refund Policy.

Custom Orders

We consider commission requests, although a set price for custom orders will have to be agreed through our Etsy shop when we understand your requirements. Our www.novoandleef.com.au website has some images of commissions and concepts that we have completed. We retain copyright and other intellectual property ownership of all rights in what we make (see Intellectual Property in the Additional Information Policies below). This is without limitation to the moral rights of any author in what we make, which we assert on their behalf.

Additional policies and FAQs
Safety and Installation

Specific information relating to your item will be brought to your attention on the page that advertises the relevant item for sale and sometimes also on packaging that is included with your purchase. You agree as a condition of our agreement that you will respond to and comply with any such information (including any warnings or limitations) and take all necessary precautions to keep you, other people and property safe .

Warranties

Unless we have expressly provided for otherwise in these Shop Policies, all conditions and warranties expressed or implied by any law are excluded and our liability is limited as set out in our agreement.

Our agreement is not intended to breach any statute. If any part of our agreement breaches a statute, then that discrete part is treated as severed and the remaining agreement is to read down accordingly to give effect to our intent expressed in it.

Your item and similar terms means the relevant item as it was described for sale, taking into consideration the age, condition, use, warnings and other information that is express or implied in the product description.

Release

To the full extent permitted by law you release us from and indemnify us against all responsibility and liability whatsoever of any kind, arising in any way, from your purchase - including without limitation: damage, theft or other loss in relation to your item; costs, loss, damage, expense, suit or claim arising from ownership or use of your purchase, use of our Etsy shop, use of our website, the content, operation or privacy practices of any web sites associated with our Etsy shop and/or the choice of and service provided by any courier and insurer.

Without limiting the foregoing, you agree that to the full extent permitted by law the maximum amount of our responsibility or liability of any kind including in relation to any Refund is limited to the purchase price of your item.

Internet Use

You take all risk in relation to and must take your own precautions to ensure that your use of our Etsy shop and our website complies with all laws and also that the process by which you access our Etsy shop or website does not expose you to risk of viruses, malicious computer code or software or other forms of computer systems that may cause you damage, costs, loss or expense.

Interpretation

References to the singular include the plural, to a gender include all genders and to laws or statutes mean laws or statutes operating in Victoria, Australia. We and you submit to Victorian law and the Courts of Victoria exclusively to govern our agreement. We also agree that Melbourne, Victoria is the place in which any dispute between us is to be heard and determined.

Intellectual Property

All Intellectual Property in the Objects is the property of the seller. By Objects, we mean all information, artwork, designs, furniture, objects, creations and concepts created by the seller and all their source codes, drawings and images in any form (visible or not). By Intellectual Property, we mean all rights in patent, copyright, trade marks, trade names, logos and images (including photographic, film, video, digital, design, drawings) and moral rights attributed to the author.

Electrical Items

It is essential that you have an electrician check your item for correct operation and safety before using it and you agree with us that you will do this, even if an item appears to have been rewired.

It is also essential to use a qualified, registered and insured electrician to carry out any electrical inspection or work required and you agree with us that you will do this.

Original Condition

Collectors often prefer that important vintage items are left as original as possible, to be used as display pieces only.

For example, the wiring in some of our vintage items will not comply to Australian Standards or be safe to use. If a vintage European collectable lamp is found by us with its original bakelite plug and period wiring, we would not re-wire prior to sale.

No Re-Selling

Our brand and reputation are in part based on the release of uncommon items for sale. Our original items are released in a limited number. Our items are not for resale, and you agree that you will not do this without first obtaining our written consent to do so. Please also refer to Intellectual Property above. We may refuse our consent without giving any reason, or grant our consent subject to any conditions.

Privacy

We respect that you care about the privacy of your personal information. We do not sell or rent your information. Payments through PayPal do not reveal your banking details to us.

We do of course have to share your contact and delivery details with the courier company and the sale details to the insurance provider and you consent to us doing these things. We also are obliged to disclose your details when required by law to do so and you also consent to us doing this.
