I) General Terms and Conditions

1) Scope of application

1.1 These terms and conditions of Anna Böhl, (hereinafter referred to as "Seller"), apply to all contracts that a consumer or entrepreneur (hereinafter referred to as "Customer") concludes with the Seller with regard to the goods and/or services presented by the Seller on the Etsy Internet trading platform (hereinafter referred to as "Etsy"). The inclusion of the customer's own terms and conditions is hereby objected to, unless otherwise agreed.

1.2 Customers within the meaning of Section 1.1 are both consumers and entrepreneurs, whereby a consumer is any natural person who concludes a legal transaction for a purpose that can be attributed neither to their commercial nor their independent professional activity. On the other hand, an entrepreneur is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his independent professional or commercial activity.

2) Conclusion of contract

2.1 The conclusion of the contract via the Etsy website is governed by § 4 of the General Terms and Conditions for the Use of Etsy.com. There, the conclusion of the contract is regulated as follows:

"If a member as a seller places an item or a service description, he makes a binding offer that any other member can purchase the item or service at the specified price. The contract is concluded when another member (buyer) clicks on the button provided for this purpose (currently: "order with obligation to pay") and confirms the process."

2.2 The order processing and contact take place by e-mail and automated order processing. The customer must ensure that the e-mail address provided by him for order processing is correct, so that the e-mails sent by the seller can be received at this address. In particular, when using SPAM filters, the customer must ensure that all e-mails sent by the seller or third parties commissioned by the seller with the order processing can be delivered.

3) Return costs when exercising the right of withdrawal

If the customer has a right of withdrawal, the regular costs of the return will be imposed on him when exercising the right of withdrawal if the price of the item to be returned does not exceed an amount of 40 euros or if, in the case of a higher price of the item, the customer has not yet provided the consideration or a partial payment at the time of revocation, unless that the delivered goods do not correspond to those ordered. In all other cases, the seller shall bear the costs of the return.

4) Prices and terms of payment

4.1 The seller's prices quoted are final prices including VAT. This will be shown in the invoice. Any additional delivery and shipping costs will be stated separately in the respective product description.

4.2 Various payment options are available to the customer, which are indicated on the respective offer page of the seller on Etsy.

4.3 If prepayment has been agreed, payment is due immediately after conclusion of the contract.

5) Delivery and shipping conditions

5.1 The delivery of goods takes place regularly on the dispatch route and to the delivery address specified by the customer. When processing the transaction, the delivery address specified in the seller's order processing is decisive. Deviating from this, when selecting the payment method PayPal, the delivery address deposited by the customer at the time of payment at PayPal is decisive.

5.2 Self-collection is not possible for logistical reasons.

6) Liability for defects

The statutory liability for defects shall apply.

7) Applicable law, place of jurisdiction, contract language

7.1 The law of the Federal Republic of Germany shall apply to all legal relationships between the parties to the exclusion of the laws on the international purchase of movable goods. In the case of consumers, this choice of law shall only apply to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has his habitual residence.

7.2 The contract language is German.

The contract is concluded in accordance with Section 2 of the Seller's General Terms and Conditions (see above).

Payment shall be made in accordance with Section 4, delivery in accordance with Section 5 of the Seller's General Terms and Conditions (see above).

5) Information about the technical steps leading to the conclusion of the contract

In the first step, the customer clicks on the product page either on the button "Add to cart" or on the button "Go directly to checkout". If the customer has clicked on the button "Add to cart", he must click in an intermediate step on the now appearing button "Go to checkout". If the customer has clicked on the button "Go directly to checkout", this intermediate step is omitted.

A new page will now open, which shows the stock of the shopping cart and on which the customer clicks on the button "Next" in the second step.

A new page will now open where the customer must either register as a member or log in.

If the customer is not yet registered as a member of Etsy, he enters the data required for registration in the mask in the third step, ticks "Yes, I agree to the terms and conditions and the privacy policy by clicking on the mouse. I have taken note of the cancellation policy." and then click on the button "Register". A new page then opens, on which the customer enters the validation key in an intermediate step, which has been sent to him by e-mail in the meantime, and then clicks on the "save" button. A new page will now open, on which the customer enters his address in a further intermediate step and then clicks on the "Next" button.

If the customer is already a member of Etsy, he enters his login data in the third step and then clicks on the "Login" button.

A new page opens, on which the customer selects a payment option in the fifth step and then clicks on the button that concludes the order process.

6) Information on the storage of the contract text

The text of the contract will be stored by the seller and sent to the customer after conclusion of the contract together with the present GTC and customer information in text form (e.B. e-mail, fax or letter). In addition, the text of the contract is archived at Etsy and can be retrieved free of charge by the customer via his password-protected customer account on Etsy.

7) Information on the technical means to detect and correct input errors

Customer may correct its entries prior to placing its order using the technical means provided by Etsy. The corrections can be made using the usual keyboard and mouse functions directly on the offer page in the corresponding input fields.

8) Information about the languages available for the conclusion of the contract

Only the German language is available for the conclusion of the contract.


9) Privacy Policy

9.1 Below we inform you about the type, scope and purpose of the processing of your personal data when using our Etsy shop. Personal data is any information relating to an identified or identifiable natural person.

9.2 Controller within the meaning of the EU General Data Protection Regulation (GDPR) is the natural or legal person who alone or jointly with others decides on the purposes and means of processing personal data. 9.4 We process the data referred to in paragraph 3 electronically for the proper fulfilment of the contract, in particular for delivery, invoicing, the booking of payments and the processing of returns and complaints. This data processing takes place on the basis of Article 6 (1) (b) GDPR. We will keep this data stored until all mutual claims arising from the respective contractual relationship with you have been completely settled and the commercial and tax retention periods to which we are subject have expired.

9.5 In order to conclude a contract between you and us, it is necessary that we receive your name and a delivery address. The necessity of providing this data results, among other things, from etsy's terms and conditions as well as from legal regulations (such as § 312i para. 1 no. 3 BGB, § 14 para. 4 UStG). Without providing this data, you can therefore not conclude a contract with us.

9.6 Insofar as we send you physical goods on the basis of the purchase contract, we may transmit your name and shipping address to Deutsche Post (Deutsche Post AG, 53113 Bonn), DHL (DHL Paket GmbH, 53113 Bonn) or Hermes (Hermes Germany GmbH, 22419 Hamburg) as a shipping service provider, for the purpose of delivering the shipment to you and, if applicable, returning your shipment to us on the basis of Article 6 (1) (b) GDPR.

9.7 For the payment of a purchase, the payment service provider you have chosen collects and processes your name, card or account number and/or other data required for the respective payment method on your behalf. In this respect, the data protection regulations of the selected payment service provider apply and, if the recipient of the payment is Etsy, etsy's privacy policy.

9.8 To support our merchandise management (order management, invoicing, accounting, delivery), we use the services of BillBee (BillBee GmbH, 32756 Detmold), to which we transmit the data mentioned in paragraph 3 for order processing in accordance with Article 28 GDPR.

9.9 If you send us a message about "Ask a question", "Ask a custom-made product" or via a similar function on the Etsy Platform, Etsy will send us your Etsy username or, if you do not have an Etsy username, any other sender identification together with your message (legal basis: Article 6 (1) (a) GDPR). If you send us a message by e-mail, we store your message with the sender data (name, e-mail address) in order to answer it and also to be able to respond to any subsequent questions from you (legal basis: Article 6 (1) (f) GDPR). For the receipt, storage and sending of e-mails, we use an e-mail provider who acts for us as a processor in accordance with Article 28 GDPR. We will delete the data collected with your message no later than six months after the last communication with you about your request, subject to the regulation in the following paragraph.

9.10 If you provide us with a legally relevant declaration of the contractual relationship (e.B. a revocation or a complaint), the legal basis for the processing, regardless of the means of transmission, is also Article 6 (1) (b) GDPR. In such a case, we will delete the data associated with your declaration as soon as all mutual claims arising from the contractual relationship have been finally settled and the retention periods under commercial and tax law have expired.

9.11 Social media buttons may appear on Etsy's pages; they can be recognized by the logos of the social media platforms (hereinafter referred to as "platforms") (Facebook: blue "f", Pinterest: red "p", Twitter: blue bird silhouette). These are links to the respective platforms based in the USA. A click on such a link calls up the website of the respective platform, whereby the IP address of the calling device and the address of the page from which the link is made ("referrer") are transmitted to the accessed platform in the USA. However, no data is collected or processed by us in connection with the social media buttons.

9.12 We do not use automated decision-making and profiling.

9.13 With regard to the personal data we process about you, you have the following rights:
a) You have the right to request confirmation from us as to whether we are processing personal data concerning you. If this is the case, we will inform you of the personal data stored about you and the other information in accordance with Article 15 (1) and (2) GDPR.
b) You have the right to have inaccurate personal data concerning you rectified without undue delay. Taking into account the purposes of the processing, you also have the right to request the completion of incomplete personal data – also by means of a supplementary declaration.
c) You can request us to delete your personal data without undue delay under the conditions of Article 17 (1) GDPR, insofar as their processing is not required in accordance with Article 17 (3) GDPR.
d) You can request us to restrict the processing of your data if one of the requirements of Article 18 (1) GDPR exists. In particular, you can request the restriction instead of deletion.
e) We will communicate any correction or deletion of your personal data and a restriction of processing to all recipients to whom we have disclosed personal data concerning you, unless this proves impossible or involves a disproportionate effort. 9.14 RIGHT TO OBJECT: FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION, YOU MAY OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA; this right to object exists in relation to data processing carried out on the basis of Article 6 (1) (f) GDPR to safeguard the legitimate interests of us or a third party, unless your interests or fundamental rights and freedoms that require the protection of personal data prevail.
If you exercise your right to object, we will no longer process the data in question unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or that the processing serves to assert, exercise or defend legal claims.

9.15 IN THE EVENT THAT WE PROCESS PERSONAL DATA FOR DIRECT MARKETING (E.B. NEWSLETTER), YOU CAN OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH ADVERTISING, WITH THE RESULT THAT WE WILL NO LONGER PROCESS YOUR DATA FOR THESE PURPOSES.

9.16 If you believe that the processing of your personal data infringes the GDPR, you may lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement. This does not preclude other administrative or judicial remedies.
