Owner of the Etsy shop "Aunt Donatella"

§ 1 – Provider, inclusion of the GTC
(1) The supplier and contractual partner for the goods presented in the Etsy shop "Tante Donatella" is: Franz Falliano, Hauptstr. 37, 10827 Berlin (hereinafter referred to as "Provider").

(2) These General Terms and Conditions are an integral part of any contractual agreement between the Provider and the respective Customer. Conflicting terms and conditions of the customer are contradicted.

§ 2 – Offer of goods and conclusion of contract
(1) The provider offers the articles presented in his Etsy shop Aunt Donatella to other Etsy users for sale. The colour representation of the articles on the website may vary slightly depending on the Internet browser used and the monitor settings of the customer; these deviations are never technically completely avoidable.

(2) The selection of goods, the conclusion of the contract and the execution of the contract shall be carried out in German. The provider delivers by shipping within Germany.

(3) The customer selects the desired goods by placing them in the "shopping cart" or by clicking on the button "Order with obligation to pay". The order request can finally be transmitted to the provider via the button "Order with obligation to pay". The customer has the possibility at any time until the dispatch of his order request to change the data provided in the context of the order or to cancel the order completely.

(4) For the goods presented in the shop of the provider, the provider makes a binding purchase offer. By sending the order request via the button "Order with obligation to pay", the customer accepts the purchase offer. The provider confirms the conclusion of the contract by e-mail (contract confirmation).

(5) In the event of impediments to delivery or other circumstances that would prevent the fulfilment of the contract, the provider shall inform the customer by e-mail. A partial delivery shall only take place with the consent of the customer.

§ 3 – Prices and payment
(1) All product prices are understood as final prices plus shipping and packaging costs. VAT is not charged.

(2) The shipping costs are listed in the product description under "Payment & Shipping".

(3) The provider delivers against advance payment (PayPal).


If the customer has chosen "PayPal" as the payment method, he will be taken to the online service of PayPal via the button "Click here to pay with PayPal" and can initiate the payment there.

§ 4 – Shipping, delivery periods
(1) The provider hands over the goods to be delivered to the shipping company within two working days from full receipt of payment.

(2) The shipping company needs about 2-3 working days from handover by the provider for delivery. Delivery will be made to the delivery address specified by the customer.

(3) If the delivery to the customer fails because the customer has entered the delivery address incorrectly or incompletely, a new delivery attempt will only be made if the customer assumes the costs for the new shipping. The renewed shipping costs correspond to the shipping costs agreed at the time of conclusion of the contract. The provider will inform the customer of the necessary costs of a new delivery by e-mail. A new shipment will only take place after receipt of payment of these costs.

§ 5 – Return of goods as a consumer
(1) If the customer is a consumer within the meaning of § 13 BGB, the parties to the purchase contract agree in the event of the exercise of the statutory right of revocation (§§ 312d, 355 BGB) that the customer bears the costs of the return if the delivered goods correspond to the ordered goods and if the price of the item to be returned does not exceed an amount of 40 euros or if the customer does not yet pay the consideration or a has made a contractually agreed partial payment.

(2) Insofar as the customer has to bear the return costs in accordance with the preceding paragraph, the amount of money to be reimbursed by the provider and the return costs to be reimbursed by the customer may be offset against each other.

§ 6 – Warranty
The warranty rights of the customer are governed by the statutory provisions.

§ 7 – Data protection information

(1) After conclusion of the contract, DaWanda shall transmit to the Provider the DaWanda user name, the name and the billing address as stored in the Customer's user account. Insofar as the customer has provided further data in the context of his order (e.B. a different delivery address or a telephone number), these will also be transmitted.

(2) The provider processes the data referred to in paragraph 1 electronically for the proper performance of the contract, in particular for dispatch, invoicing and the booking of payments. For the purpose of shipping, the provider may also transmit the name and address of the customer to the commissioned shipping company.

(3) The provider shall keep the data stored until all mutual claims arising from the order have been completely settled and the commercial and tax retention obligations for the provider have expired.

(4) The customer may request information from the provider at any time about the data he has stored about the customer. Furthermore, the customer may request the correction of incorrect data at any time.

(5) The responsible body for data protection is the provider named in § 1 paragraph 1.

§ 8 – Final provisions
(1) The provider collects the data entered by the customer as part of his purchase for the purpose of processing and fulfilling the contract. Insofar as the customer uses the service of PayPal for the payment of his purchase, the PayPal data protection regulations apply to the payment process. PayPal acts as a vicarious agent of the customer, not of the provider.

(2) The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

(3) Should individual provisions of these General Terms and Conditions prove to be invalid or unenforceable, this shall not affect the validity of the other provisions.
