2. Conclusion of contract and withdrawal:
2.1 Romana Steinhardt
undertakes to accept the order of the contractual partner taking into account the GTC. In the event of spelling and calculation errors, Romana Steinhardt is entitled to withdraw from the contract without any claims accruing to the contractual partner.
3. Delivery:
3.1 Unless otherwise agreed, delivery shall be made to the delivery address specified by the contractual partner. Romana Steinhardt makes every effort to ship the ordered items 1 working day after receipt of payment.
3.2 In the event of delivery delays due to force majeure, natural disasters, strikes or other circumstances for which Romana Steinhardt is not responsible, Romana Steinhardt is entitled to make up for the delivery after the impediment has ceased to exist. However, both parties may withdraw from a concluded contract in whole or in part if one of the aforementioned events leads to a delay in delivery of more than 3 (three) weeks beyond the agreed period. However, further claims of the contracting parties are excluded.
4. Prices and terms of payment:
4.1 All purchase prices quoted are in euros and as final prices, i.e. they include all price components including the statutory value added tax.
4.2 The purchase price includes a packaging and shipping fee. Romana Steinhardt does not deliver outside the EU.
4.3 The purchase price is due upon conclusion of the contract. Payment must be made in advance (bank transfer) or by PayPal. The purchase price is to be paid without deduction no later than 7 (seven) days after receipt of the first request for payment.
5. Retention of title:
The goods offered in the online shop remain the property of Romana Steinhardt until they have been paid for in full.
6. Transfer of risk:
If the buyer is an entrepreneur, the risk of accidental deterioration of the goods shall pass to the buyer upon handover, in the case of sale by shipment, upon handover of the item to the company commissioned with the dispatch of the goods. If the buyer is a consumer, the risk of accidental deterioration of the goods shall only pass to the buyer upon handover of the item to the buyer, even in the case of a sale by mail.
7. Warranty and liability:
7.1 In the event of defects in the ordered goods, Romana Steinhardt is initially entitled, at its discretion, to repair the defective item or to deliver a replacement. In the event of impossibility of rectification or replacement delivery within a reasonable period of time, the contractual partner is entitled to demand a reduction in the purchase price (reduction) or cancellation of the contract. The contractual partner must notify obvious defects immediately, but at the latest within 1 (one) week after receipt of the delivery.
7.2 The warranty does not include the elimination of errors caused by external influences or operating errors. Furthermore, warranty claims do not arise if the contractual partner does not follow the care instructions of the goods of Romana Steinhardt.
7.3 Unless otherwise stated below, further claims of the customer - regardless of the legal grounds - are excluded. Romana Steinhardt is therefore not liable for damage that has not occurred to the delivery item itself.
7.4 The warranty obligation is governed by the statutory provisions. The beginning of the period is the time of the transfer of risk. This period is a limitation period and also applies to claims for compensation for consequential damage caused by defects, unless claims are asserted in tort.
