PART A – TERMS AND CONDITIONS
1. SCOPE AND SELLER
These Terms and Conditions apply to all contracts concerning digital products and digital content purchased through the Etsy shop MoonlioDigital.

The applicable terms and technical processes of the Etsy marketplace additionally apply to the use of Etsy.
Any conflicting or differing terms submitted by a customer shall only apply where expressly accepted by the seller.
2. PRODUCTS
MoonlioDigital primarily offers digital products and digital content.
These may include, for example:
• PDF files
• templates
• planners
• checklists
• workbooks
• organizational tools
• AI prompts
• AI toolkits
• digital family and everyday-life resources
• other digital downloads
The exact contents, scope, file format and any technical requirements are stated in the relevant Etsy listing.
Unless expressly stated otherwise in the relevant listing, all products are digital products only.
No physical item will be shipped.
3. FORMATION OF THE CONTRACT
Products are offered through the MoonlioDigital Etsy shop.
The ordering process and formation of the contract take place through Etsy's checkout system.
Before completing an order, customers can review and, where provided by Etsy, correct their order information.
An order confirmation is provided through Etsy following successful completion of the purchase.
4. PRICES AND PAYMENT
The price displayed in the relevant Etsy listing at the time of purchase applies.
Available payment methods are displayed during Etsy checkout.
Payments are processed through Etsy and/or the payment providers integrated into the Etsy platform.
Any applicable taxes are handled in accordance with applicable law and the payment processes provided by Etsy.
5. DELIVERY OF DIGITAL PRODUCTS
Instant digital products are made available through Etsy following successful completion of the purchase or confirmation of payment.
No physical product will be shipped.
The buyer is responsible for having a compatible device and, where necessary, suitable software to open and use the file format described in the relevant product listing.
Where an external service or software is required to use a product, this will be indicated in the relevant product description where appropriate.
6. THIRD-PARTY SERVICES AND AI PLATFORMS
Some MoonlioDigital products may be designed for use with third-party services, including AI platforms.
Unless expressly stated otherwise in the relevant listing, access to, subscriptions for, or paid services provided by third parties are not included in the purchase from MoonlioDigital.
The terms of use and privacy policies of the relevant third-party providers also apply when such services are used.
MoonlioDigital has no control over future changes to the pricing, features, AI models, availability or terms of third-party services.
7. AI PROMPTS AND AI TOOLKITS
Where a product contains AI prompts, AI templates or instructions for using artificial intelligence, these materials are provided as practical tools and sources of inspiration.
Results generated by external AI systems may depend on factors including:
• the AI provider used
• the AI model
• the current model version
• user settings
• information entered by the user
• future changes made by the provider
For this reason, no specific result generated by an external AI service can be guaranteed.
AI-generated responses should be independently reviewed for accuracy, suitability and appropriateness before being used.
MoonlioDigital products do not replace individual medical, psychological, legal, tax, financial or other professional advice.
Qualified professional advice should be obtained where appropriate, particularly for health, safety, legal or similarly important decisions.
8. LICENCE AND PERMITTED USE
Unless a different licence is expressly stated in the relevant product listing, full payment grants the buyer a non-exclusive, non-transferable licence for private, non-commercial use.
The purchased files may be used by the buyer personally and within their own private household.
Without prior express permission from MoonlioDigital, buyers may not:
• resell the purchased files
• distribute the files to third parties, whether for payment or free of charge
• make the files publicly available for download
• present or sell the contents as their own products
• resell templates or prompt collections in whole or in substantial part
• include or distribute the contents in commercial template, file or prompt collections
• upload the files to file-sharing or comparable platforms
• remove trademark, authorship, source or rights notices for the purpose of redistribution
Private backup copies for personal use are permitted.
To the extent that intellectual property rights exist in individual texts, illustrations, designs, compilations, trademarks or other materials, such rights remain with MoonlioDigital or the respective rights holder.
9. RIGHT OF WITHDRAWAL FOR DIGITAL CONTENT
Consumers generally have a statutory right of withdrawal in distance contracts.
For paid digital content that is not supplied on a tangible medium, however, the right of withdrawal may expire before the regular withdrawal period has ended where all applicable statutory requirements have been satisfied.
Detailed information is provided in Part B of this document.
Statutory rights relating to defective, faulty or non-conforming digital products remain unaffected.
10. RETURNS, EXCHANGES AND CANCELLATIONS
MoonlioDigital sells instant digital downloads.
Because digital content cannot be returned in the same manner as physical goods once it has been provided, MoonlioDigital does not offer voluntary:
• returns,
• exchanges, or
• cancellations
after the digital content has been provided.
This does not restrict or exclude mandatory statutory consumer rights.
Any statutory right of withdrawal that has not yet expired and all statutory rights relating to defective or non-conforming digital products remain unaffected.
11. DEFECTIVE OR NON-CONFORMING DIGITAL PRODUCTS
Applicable statutory provisions governing digital products remain in force.
If, for example:
• a file is damaged,
• an incorrect file has been provided,
• the file cannot be used as described in the product listing, or
• the product materially fails to conform to the agreed characteristics,

Mandatory statutory rights relating to defective or non-conforming digital products remain unaffected.
12. UPDATES AND FUTURE VERSIONS
Unless expressly stated otherwise in the relevant listing, the purchase does not include a voluntarily promised entitlement to future expansions, additional content, redesigns or new versions of the product.
Any mandatory statutory obligations relating to digital products remain unaffected.
13. LIABILITY
MoonlioDigital's liability is governed by applicable statutory provisions.
For AI prompt products, MoonlioDigital is responsible for providing the digital product described in the relevant listing.
No particular personal, financial, educational, organizational or other outcome resulting from the use of the product is guaranteed.
This does not limit statutory liability, consumer or defect-related rights.
14. PRIVACY
Information about the processing of personal information is provided in the separate MoonlioDigital Privacy Policy.
Etsy's own privacy terms additionally apply to the use of the Etsy platform.
Where external AI platforms, software or other third-party services are used, their respective privacy policies also apply.
15. GOVERNING LAW
The laws of the Federal Republic of Germany apply, excluding the United Nations Convention on Contracts for the International Sale of Goods.
Where the customer is a consumer, this choice of law shall not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence.
Mandatory consumer protection laws remain unaffected.
16. FINAL PROVISIONS
If an individual provision of these Terms and Conditions is invalid or becomes invalid, the applicable statutory provisions shall take its place.
The validity of the remaining provisions shall not be affected.
PART B – INFORMATION ON THE RIGHT OF WITHDRAWAL
RIGHT OF WITHDRAWAL
Consumers generally have the right to withdraw from this contract within fourteen days without giving any reason.
For contracts concerning digital content, the withdrawal period is fourteen days from the date on which the contract is concluded.
EXERCISING THE RIGHT OF WITHDRAWAL
To exercise your right of withdrawal, you must inform:

of your decision to withdraw from the contract by means of a clear statement.
You may contact us, for example, by email or through the Etsy messaging system.
Where Etsy provides an electronic withdrawal function for the relevant order, you may also use that function to submit your withdrawal.
You may use the model withdrawal form contained in Part C of this document, but you are not required to do so.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
EFFECTS OF WITHDRAWAL
If you validly withdraw from this contract, we will reimburse all payments received from you in connection with the withdrawn contract without undue delay and no later than fourteen days from the day on which we are informed of your decision to withdraw.
We will generally use the same means of payment that you used for the original transaction unless otherwise expressly agreed.
You will not incur additional fees as a result of the reimbursement.
Refund processing may be carried out through Etsy.
EARLY EXPIRY OF THE RIGHT OF WITHDRAWAL FOR INSTANT DIGITAL DOWNLOADS
Unless expressly stated otherwise in the relevant listing, the products offered by MoonlioDigital are digital content that is not supplied on a tangible medium.
For contracts concerning paid digital content, the statutory right of withdrawal may expire before the end of the regular withdrawal period where all applicable statutory requirements have been fulfilled.
In particular, this requires that:
• you have expressly consented to performance of the contract beginning before the end of the withdrawal period,
• you have acknowledged that by giving such consent you will lose your right of withdrawal once performance begins,
• performance of the contract and supply of the digital content have begun,
and
• the legally required contractual confirmation has been provided to you.
For instant digital downloads purchased through Etsy, the digital content is made available through the Etsy platform following successful purchase.
Where all applicable statutory requirements have been satisfied, the statutory right of withdrawal expires once performance and the supply of the digital content begin.
NO VOLUNTARY RETURNS, EXCHANGES OR CANCELLATIONS
Due to the digital nature of our instant downloads, MoonlioDigital does not offer voluntary returns, exchanges or cancellations once the digital content has been provided.
This policy does not restrict or exclude mandatory statutory consumer rights.
STATUTORY RIGHTS FOR DEFECTIVE PRODUCTS REMAIN UNAFFECTED
The expiry of the right of withdrawal does not exclude your statutory rights if a digital product is defective or does not conform to the contract.
Your statutory rights therefore remain in force where, for example, a digital file is defective, damaged, incorrect or materially does not conform to the product description.
