Returns and exchanges
Withdrawal
- As a rule, consumers are accorded a right of withdrawal.
- The Vendor's withdrawal policy yields further details on the right of withdrawal.
- The right of withdrawal shall not be accorded to consumers who do not belong to a member state of the European Union at the time of contractual conclusion and whose sole residence and delivery address are located outside the European Union at the time of contractual conclusion.

Liability for defects
- If the purchased item is defective, regulations pertaining to statutory liability for defects shall be applicable.
- The Customer is requested to lodge any complaints in respect of goods evidently damaged during transportation with the delivery agent, and to notify the Vendor of this. - In the event that the Customer fails to comply with this, that Party's statutory or contractual claims for defects are not affected thereby whatsoever.
Payment
The prices specified by the Vendor are total prices and include statutory VAT. Any delivery and shipping costs additionally incurred are specified separately in the respective product description.
In specific instances, further charges not attributable to the Vendor may be incurred specific to deliveries effected to countries outside the European Union; these are to be borne by the Customer. These include, for instance, money transfer fees levied by financial institutions (e.g. bank transfer charges, exchange rate fees) or charges arising from import regulations or taxes (e.g. customs duties). Such costs relating to money transfer may also be incurred if delivery is not effected to a country outside the European Union, but the Customer effects payment from a country outside the European Union.
Various payment options are available to the Customer; these are specified in the Vendor's offer on Etsy.
If advance payment is agreed, payment is due immediately following contractual conclusion.
If the payment method "PayPal" is selected, the payment is processed via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg, with PayPal's Terms of Use, which can be viewed at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full, being effective. This presupposes that the Customer is opening a PayPal account or already has such an account.

Retention of title
If the Vendor renders services in advance, that Party shall retain ownership of the goods supplied until the purchase price owed has been remitted in full.
Shipping
Unless otherwise agreed, goods are delivered by way of despatch to the delivery address provided by the Customer. When the transaction is processed, the delivery address specified in the order processing on Etsy is definitive. By derogation from this, if the payment method PayPal is selected, the delivery address that is definitive is the one that the Customer has on record with PayPal at the time of payment.
If the transportation company sends the shipped goods back to the Vendor owing to delivery to the Customer not having been feasible, the Customer bears the costs arising from the abortive shipment. This shall not apply if the Customer effectively exercises their right of withdrawal, if the circumstance that led to infeasibility of delivery is not attributable to that Party or if the Customer was temporarily prevented from accepting the service offered, unless the Vendor had given the Customer adequate advance notice.
For logistical reasons, collection in person is not feasible.
Additional policies and FAQs
Scope
- These General Terms and Conditions (hereinafter "GTC") of Ms Christina Lazzari, trading under the business name lovaloom (hereinafter "Vendor"), shall be applicable to all contractual agreements that a consumer or entrepreneur (hereinafter "Customer") concludes with the Vendor in respect of the goods and/or services presented by the Vendor on the Internet trading platform Etsy (hereinafter "Etsy"). The inclusion of proprietary conditions of the Customer is herewith prohibited unless otherwise agreed.
- A consumer, as set forth in these GTC, is any natural person who concludes a legal transaction for purposes that, for the most part, cannot be attributed to their commercial activity or their self-employment. An entrepreneur, as set forth in these GTC, is any natural or legal person or a business partnership with legal capacity which acts by exercising its commercial activity or self-employment upon conclusion of a legal transaction.

Contractual conclusion
- When placing an item on Etsy, the Vendor submits a binding offer respective to the sale of this item.
- The Customer can accept the Vendor's offer via the online order form provided on Etsy. To do this, the Customer must first place the desired item in the virtual shopping basket on Etsy and then proceed with the order process prescribed by Etsy. By clicking the button that concludes the order process, the Customer declares that they accept the offer, whereby a purchase agreement pertaining to the goods previously selected by the Customer is established.
- The text of the contractual agreement is stored by the Vendor and sent to the Customer in writing (e.g. via e-mail, fax or letter) following contractual conclusion, along with these GTC and the customer information. Additionally, the text of the contractual agreement is archived on Etsy and can be retrieved free of charge by the Customer via their password-protected customer account on Etsy.
- The Customer can correct the information entered before submitting their order using the technical resources made available by Etsy. The corrections can be carried out using standard keyboard and mouse functions directly within the offer page by editing the corresponding input fields.
- The language that is exclusively available for contractual conclusion is English.

Applicable law
- All legal relationships subsisting between the Parties shall be governed by the law of the Federal Republic of Germany, to the exclusion of legislation respective to the international purchase of movable goods. Specific to consumers, this choice of law shall apply only insofar as the protection afforded is not withdrawn owing to imperative provisions of the law of the country in which the Consumer ordinarily resides.
- Furthermore, this choice of law respective to the the statutory right of withdrawal shall not be accorded to consumers who do not belong to a member state of the European Union at the time of contractual conclusion and whose sole residence and delivery address are located outside the European Union at the time of contractual conclusion.

Collation, processing, utilisation and disclosure of personal data
- Personal data are collated by us solely if you volunteer them to us yourself for purposes of contractual execution. The personal data provided by you on such an occasion are used by us solely for purposes of contractual execution and to process your enquiries.
- Within the parameters of contractual execution, we pass on your data to the transportation company commissioned with delivery to the extent that this is necessary for delivery of the goods.
- Orders are processed via the service provider "Billbee" (Billbee GmbH, Bremker Str. 92, 32758 Detmold). We pass on your data to Billbee solely for the purpose of processing your online order. Billbee's data protection specifics and its privacy policy can be viewed on Billbee's website, accessible at "billbee.de".
- If payment is remitted by credit card via PayPal or by direct debit via PayPal, we pass on your payment data, as part of payment processing, to PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg.
- After the contractual agreement has been executed in full, your data are stored with due regard to retention terms mandated under fiscal and commercial law, but are blocked for all other purposes and are deleted upon expiry of these terms, provided you have not expressly consented to the further use of your data.

Social plugins
- So-called social plugins ("Plugins") of the social network Facebook, operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook"), are used on the Etsy pages. When you retrieve one of our pages on Etsy containing such a Plugin, your browser establishes a direct connection with the Facebook servers.
By way of this association, Facebook is notified that your browser has retrieved the corresponding Etsy page, even if you do not have a profile on Facebook or are not logged into Facebook at that time. This information (inclusive of your IP address) is transferred directly from your browser to a Facebook server in the USA, where it is stored. If you are logged into Facebook, the latter can directly map your visit to our Etsy pages to your Facebook profile. If you interact with the Plugins, this information is, likewise, transferred directly to a Facebook server, where it is stored. The information is also published on your Facebook profile and displayed to your Facebook friends.
