––––––––––––––––––––––––––––––––––

1) Scope of Application
1.1 These General Terms and Conditions (hereinafter "GTC") ...of Vanessa Bevilacqua (hereinafter "Seller") apply to all contracts for the supply of goods concluded between a consumer or entrepreneur (hereinafter "Customer") and the Seller regarding the goods presented by the Seller on the online marketplace Etsy (hereinafter "Etsy"). The inclusion of the Customer's own terms and conditions is hereby objected to, unless otherwise agreed.
1.2 For the purposes of these General Terms and Conditions, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
1.3 For the purposes of these General Terms and Conditions, an entrepreneur is a natural or legal person or a partnership with legal capacity that acts in the exercise of its trade, business, or profession when concluding a legal transaction.

2) Conclusion of Contract
2.1 By listing an item on Etsy, the Seller makes a binding offer to sell that item.
2.2 The Customer may accept the Seller's offer via the online order form provided on Etsy. To do so, the Customer must first place the desired item into the virtual shopping cart on Etsy and then proceed through the ordering steps prescribed by Etsy. By clicking the button that concludes the ordering process, the Customer declares acceptance of the offer, thereby concluding a purchase contract for the goods previously selected by the Customer.
2.3 The text of the contract is stored by the Seller and sent to the Customer in text form (e.g., e-mail, fax, or letter) after the contract has been concluded, together with these General Terms and Conditions and customer information. The Seller does not make the contract text available beyond this.
2.4 Before submitting a binding order, the Customer can identify potential input errors by carefully reading the information displayed on the screen. An effective technical means for better detecting input errors can be the browser's zoom function, which allows the on-screen display to be enlarged. Customers can correct their entries using standard keyboard and mouse functions during the electronic ordering process before finally submitting the order.
2.5 The German language is available for the conclusion of the contract.
2.6 The following languages are also available for the conclusion of the contract:
- English
- French

3) Right of withdrawal
3.1 Consumers generally have a right of withdrawal.
3.2 Further information regarding the right of withdrawal can be found in the seller's instructions on the right of withdrawal.

4) Prices and terms of payment
4.1 Unless otherwise stated in the seller's product description, the prices quoted are total prices. No VAT is charged, as the seller is exempt from VAT under the small business regulation. Any additional delivery and shipping costs are specified separately in the respective product description.

4.2 Right to Object
If we process your personal data based on our overriding legitimate interest as part of a balancing of interests, you have the right to object to this processing at any time, on grounds relating to your particular situation, with effect for the future.

If you exercise your right to object, we will cease processing the data in question. Further processing will only be permitted if we can demonstrate compelling legitimate grounds for the processing which override your interests, fundamental rights and freedoms, or if the processing serves the establishment, exercise or defense of legal claims.

If we process your personal data for direct marketing purposes, you have the right to object at any time to the processing of your personal data for such marketing. You can exercise your right to object as described above.

If we process your personal data for direct marketing purposes, you have the right to object at any time to the processing of your personal data for such marketing. If you exercise your right to object, we will cease processing the data in question for direct marketing purposes.

5) Duration of storage of personal data
The duration of storage of personal data is determined by the respective legal basis, the purpose of processing, and – where applicable – the respective statutory retention period (e.g., commercial and tax law retention periods).

When processing personal data based on explicit consent pursuant to Art. 6 para. 1 lit. a GDPR, the data in question will be stored until you withdraw your consent.

If statutory retention periods exist for data processed in connection with contractual or quasi-contractual obligations based on Article 6(1)(b) GDPR, this data will be routinely deleted after the retention periods have expired, unless it is still required for the performance of a contract or for taking steps prior to entering into a contract and/or we have a legitimate interest in its continued storage.

When processing personal data based on Article 6(1)(f) GDPR, this data will be stored until you exercise your right to object pursuant to Article 21(1) GDPR, unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the purpose of establishing, exercising or defending legal claims.

When processing personal data for direct marketing purposes based on Article 6(1)(f) GDPR, this data will be stored until you exercise your right to object pursuant to Article 21(2) GDPR. Unless otherwise specified in this privacy policy regarding specific processing situations, stored personal data will be deleted when it is no longer necessary for the purposes for which it was collected or otherwise processed.

Introduction
Consumers have a right of cancellation under the following conditions, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity:

Right of Cancellation
You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you, or a third party named by you who is not the carrier, took possession of the last goods.

To exercise your right of withdrawal, you must inform us (Vanessa Bevilacqua, Neuhofstrasse 47, 60318 Frankfurt am Main, Germany, Tel.: +49 1575 9613131, Email: lacontessafrankfurt@gmail.com) of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post or email). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (excluding any additional costs incurred if you chose a delivery method other than our cheapest standard delivery option), without undue delay and no later than fourteen days from the day on which we received your notification of withdrawal. For this reimbursement, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees as a result of this reimbursement.

In the case of contracts for the supply of goods, we may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You must return or hand over the goods to us without undue delay and in any event no later than twenty-one days from the day on which you communicate your withdrawal from this contract to us.

Returns can only be sent to the following address:
Vanessa Bevilacqua, Wallflower Online Shop, Neuhofstr. 47, 60318 Frankfurt am Main, Germany.

The deadline is met if you send the goods before the end of the 21-day period.

You bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods if this diminished value is due to handling of the goods beyond what is necessary to ascertain their nature, characteristics, and functioning.

Exclusion or premature expiry of the right of withdrawal

The right of withdrawal does not apply to contracts for the supply of goods whose price depends on fluctuations in the financial market which are beyond the control of the trader and which may occur within the withdrawal period.
