UK AND EU/EEA RIGHT OF WITHDRAWAL

This policy applies where UK, EU or EEA consumer law provides the buyer with a statutory right to withdraw from an online purchase.

RIGHT TO WITHDRAW

For eligible standard goods that are not made to the customer’s individual specifications, clearly personalised or otherwise exempt under applicable law, the buyer may withdraw from the purchase without giving a reason.

The buyer must notify CemeteryCrypt of their decision to withdraw within 14 days after the day on which they, or a person nominated by them other than the delivery carrier, receives the goods.

Where one order contains multiple goods delivered separately, the withdrawal period begins after the final item is received.

HOW TO SUBMIT A WITHDRAWAL REQUEST

The buyer must provide a clear statement confirming that they wish to withdraw from the purchase.

• The model withdrawal form provided below

The buyer may use the model form, but its use is not compulsory.

RETURNING THE GOODS

After notifying CemeteryCrypt of the withdrawal, the buyer must return the goods within a further 14 days.

Return instructions and the appropriate return address will be provided after the request has been received.

The buyer is responsible for the direct cost of return postage unless the goods are faulty, damaged, incorrect or materially different from the Etsy listing.

We strongly recommend using a tracked postal service and retaining proof of postage. The buyer is responsible for packaging the goods securely and returning them safely.

Returned goods must be unworn, unused and handled only to the extent reasonably necessary to establish their nature, characteristics and fit, in the same way they could reasonably be inspected in a physical shop.

REFUNDS

Where the withdrawal request is valid, CemeteryCrypt will refund the price paid for the eligible goods.

Where the buyer paid an outbound delivery charge, the refund will also include the cost of the least expensive standard delivery service offered for the order. Any additional amount paid for express, upgraded or premium delivery is not refundable beyond the cost of the standard delivery option.

Refunds will be issued to the original payment method without undue delay and within the timeframe required by applicable consumer law.

CemeteryCrypt may withhold the refund until either:

• The returned goods have been received; or
• The buyer provides satisfactory evidence that the goods have been returned,

whichever occurs first.

A reasonable deduction may be made from the refund where the value of the goods has been reduced by handling beyond what was reasonably necessary to inspect their nature, characteristics and fit.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The statutory right of withdrawal does not apply where an applicable legal exception applies, including goods that are:

• Made to the customer’s individual specifications
• Clearly personalised
• Custom-designed specifically for the customer
• Specially altered to the customer’s requested measurements or requirements
• Otherwise genuinely bespoke or non-prefabricated and produced according to the customer’s individual choices

The fact that an item is handmade or produced after an order is placed will not, by itself, remove a statutory withdrawal right where the product is otherwise a standard, non-personalised item.

FAULTY, DAMAGED OR INCORRECT GOODS

Nothing in this policy limits or excludes the buyer’s statutory rights where goods are faulty, damaged, incorrect, not as described or materially different from the Etsy listing.

Buyers experiencing an issue with an order should contact CemeteryCrypt through Etsy Messages or email cemeterycrypt@gmail.com and provide their order number, details of the issue and photographs where relevant.
