1. Scope
1.1 These General Terms and Conditions, or “Terms and Conditions”, apply to all contracts for the sale of goods by Natascha Riha, acting on Etsy as “NatashaRihaPhoto”, (hereinafter “Seller”), regardless of whether they are concluded with a consumer or a business owner (collectively, “Customer”) with respect to the Products displayed on Seller’s Etsy Shop. It should be noted that the inclusion of conflicting or supplementary contractual terms and conditions of the customer is expressly objected to, unless otherwise agreed.
1.2 “Consumer” is any natural person who concludes a legal transaction primarily for purposes that do not serve either their commercial or independent professional activity.
1.3 “Entrepreneur” is any natural person, legal entity or partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

2. Offer & conclusion of contract
2.1 If the seller lists an item on Etsy, this constitutes a binding offer to sell that item.
2.2 The customer can accept the seller's offer via Etsy's online order form. To do this, the customer first places the desired item in their virtual shopping cart on Etsy and then follows the ordering steps described by Etsy. By clicking on the button that completes the ordering process, the customer declares his consent to the offer. By accepting the offer, a legally binding contract is concluded between the seller and the buyer, which triggers the mutual obligation to perform.
2.3 After the conclusion of the contract, the seller keeps the contract text and sends it to the customer in written form, for example by email, fax or post. This submission includes both these Terms and Conditions and Customer Information. The seller does not extend the storage of the contract text beyond this point in time.
2.4 Before the final confirmation of the order, the customer has the opportunity to identify and correct any input errors by carefully checking the information displayed on the screen. The customer can correct his information before completing the order using the usual keyboard and mouse functions.
2.5 The contract languages are exclusively German and English.

3. Right of withdrawal
3.1 The right of withdrawal generally applies to consumers.
3.2 Further details on the right of withdrawal can be found in Section B of this document.
3.3 The right of withdrawal does not apply to consumers who are not members of a Member State of the European Union at the time the contract is concluded and whose sole residence and delivery address are outside the European Union at the time the contract is concluded.

4. Prices and Payments
4.1 Unless otherwise stated in the seller's product description, the prices stated are total prices. Due to the small business regulation in accordance with Section 6 UStG, sales tax is not shown. Any costs incurred for delivery and shipping will be listed separately in the respective product description.
4.2 Deliveries to countries outside the European Union may occasionally incur additional costs that are not the responsibility of the seller and must be borne by the customer. These costs may include fees associated with transferring funds through financial institutions (e.g., wire transfer fees, exchange rate fees) or customs duties and taxes (e.g., import duties). Such expenses may apply regardless of whether the delivery is to a country outside the European Union if the payment originates from a country outside the European Union.
4.3 The available payment options will be communicated to the customer in the seller's offer on Etsy.
4.4 If the customer uses a payment method offered via "Etsy Payments", the payment will be processed via Etsy Ireland UC, with its registered office at 66/67 Great Strand Street, Dublin 1, Ireland (hereinafter referred to as "Etsy UC") or for payments in US dollars or Canadian dollars via Etsy Inc., with its registered office at 117 Adams Street, Brooklyn, NY 11201, United States of America (hereinafter referred to as “Etsy Inc.”). Etsy UC or Etsy Inc. provide the customer with various payment options as part of payment processing via Etsy Payments. Etsy UC or Etsy Inc. may use third-party payment services to process payments. The payment methods available for the respective product are displayed to the customer in the seller's corresponding sales offer or during the ordering process. 5. Delivery and shipping conditions
5.1 The goods will be shipped to the delivery address specified by the customer. The delivery address specified in the ordering process on Etsy is crucial for processing the transaction. However, when paying via PayPal, the delivery address that the customer provided to PayPal during the payment process is decisive.
5.2 Delivery dates and deadlines specified by the seller in the product descriptions are only approximate and are non-binding unless they have been expressly confirmed in writing as binding. No claims against the seller can be derived from non-compliance with non-binding delivery dates and deadlines.
5.3 If delivery of the goods fails due to circumstances attributable to the customer, the customer is obliged to bear the reasonable costs incurred by the seller as a result. This exclusion does not apply to shipping costs if the customer effectively exercises his right of withdrawal. If the customer makes effective use of his right of withdrawal, the return costs will be based on the provisions of the seller's cancellation policy.
5.4 If there is a faulty or improper delivery, the seller has the right to withdraw from the contract. This provision only applies if the non-delivery is not due to the fault of the seller and the seller exercised reasonable care in arranging the transaction with the supplier. The Seller will take all reasonable measures to obtain the goods ordered. However, if the goods are unavailable or only partially available, the customer will be notified immediately and any payment will be promptly refunded.
5.5 It is not possible to collect the goods yourself for logistical reasons.

6. Retention of title
The goods remain the property of the seller until the purchase price owed has been paid in full.

7. Liability for defects (warranty)
7.1 Unless otherwise specified in the following regulations, the statutory provisions on liability for defects apply. However, the following conditions apply to contracts for the sale of goods:
7.2 If the customer acts as an entrepreneur:
-The manner of subsequent fulfillment is determined at the seller's sole discretion.
-For new goods, the limitation period for defects is one year from delivery.
-Rights and claims due to defects are excluded for used goods.
-The limitation period does not begin again if a replacement delivery is made within the scope of liability for defects.
7.3 The above limitations of liability and shortening of deadlines do not apply in the following cases:
-Customer claims for damages and reimbursement of expenses.
-In cases where the seller intentionally concealed the defect.
-For items that were used in accordance with their normal use in the construction of a building and caused defects in the building.
-In cases where the Seller is obliged to provide updates for digital products under contracts for the supply of goods containing digital components.
7.4 The statutory limitation periods for any recourse claims against entrepreneurs remain unaffected.
7.5 If the customer acts as a consumer, he is asked to report any obvious transport damage to the delivery service provider and to notify the seller as soon as possible. The buyer's statutory or contractual rights to defects remain unaffected.

8. Redeeming promotional vouchers
8.1 Promotional vouchers that are provided by the seller as part of promotions and have a specific period of validity cannot be purchased and can only be redeemed in the seller's Etsy shop during the specified period.
8.2 Promotional vouchers can only be redeemed by consumers.
8.3 Certain products may be excluded from voucher promotions if the content of the promotional voucher provides for such restrictions.
8.4 Promotional vouchers can only be redeemed before the order is completed. Retroactive application is not possible.
8.5 Only one promotional voucher can be redeemed per order.
8.6 The value of the goods must be at least equal to the amount of the promotional voucher. Any remaining balance will not be refunded by the seller.
8.7 If the value of the promotional voucher does not cover the total order value, one of the other payment methods offered by the seller can be chosen to settle the difference.
8.8 The balance of promotional vouchers will neither be paid out in cash nor interest.
8.9 If the customer purchases items that were purchased with a promotional voucher in whole or in part within the scope of his statutory right of withdrawal, the promotional voucher will not be refunded.
8.10 Promotional vouchers are intended exclusively for use by the person named on them. Passing on promotional vouchers to third parties is prohibited. The seller has the right, but not the obligation, to check the voucher holder's eligibility.

9. Applicable Law
The law of the Republic of Austria applies to all legal relationships between the parties, with the exception of the laws on the international purchase of movable property. For consumers, this choice of law only applies to the extent that it does not affect the protection provided by mandatory legal provisions of the country in which the consumer has his or her habitual residence.

B. RIGHT OF WITHDRAWAL

Introduction

Consumers have a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who concludes a legal transaction for purposes that cannot be predominantly attributed to either their commercial or independent professional activity:
Right of withdrawal

You have the right to cancel this contract within fourteen days without giving any reasons.

The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the last goods.

In order to exercise your right of withdrawal, you must inform us (Natascha Riha, Natasha Riha Photography, Gerasdorfer Straße 141, 1210 Vienna, Austria, Tel.: 06649185645, Email: office@natasharihaphotography.com) by means of a clear statement (e.g. a letter sent by post or email) about your decision to withdraw from this contract. You can use the attached sample cancellation form, although this is not mandatory.

In order to meet the cancellation period, it is sufficient that you send the notification of your exercise of the right of cancellation before the cancellation period expires.
Consequences of revocation

If you cancel this contract, we will refund to you all payments received from you, including delivery costs (except for additional costs resulting from you choosing a method of delivery other than the cheapest standard delivery offered by us have) to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment we use the same payment method that you used for the original transaction, unless something different was expressly agreed with you; under no circumstances will you be charged any fees as a result of this repayment. We may refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is the earlier.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of your cancellation of this contract. The deadline is met if you send the goods before the fourteen day period has expired.

You bear the direct costs of returning the goods.

You are only liable for any loss in value of the goods if this loss in value is due to the handling other than what is necessary to establish the nature, characteristics and functionality of the goods.
