A. General Terms and Conditions

1) Scope
1.1 These General Terms and Conditions (hereinafter “GTC”) of Frank Georg, operating under “ADAM WILD” (hereinafter “Seller”), apply to all contracts for the delivery of goods concluded between a consumer or entrepreneur (hereinafter “Customer”) and the Seller via the online marketplace Etsy.
The inclusion of the Customer’s own terms and conditions is hereby rejected unless otherwise agreed.

1.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that predominantly are not attributable to their commercial or self-employed professional activity.

1.3 An entrepreneur within the meaning of these GTC is a natural or legal person or a legally capable partnership who acts in the exercise of their commercial or self-employed professional activity when concluding a legal transaction.

2) Conclusion of Contract
2.1 By listing an item on Etsy, the Seller submits a binding offer to sell that item.

2.2 The Customer may accept the Seller’s offer via the online order form provided by Etsy by placing the selected item in the virtual shopping cart and completing the ordering process. By clicking the button completing the order, the Customer declares acceptance of the offer, thereby concluding a purchase contract.

2.3 The contract text is stored by the Seller and sent to the Customer in text form (e.g. email) together with these GTC after conclusion of the contract. No further access to the contract text is provided by the Seller.

2.4 Before submitting the binding order, the Customer may identify and correct any input errors using standard keyboard and mouse functions.

2.5 The contract language is German.

3) Right of Withdrawal
3.1 Consumers are generally entitled to a right of withdrawal.
3.2 Further details can be found in the Seller’s withdrawal policy.

4) Prices and Payment Conditions
4.1 All prices stated by the Seller are total prices and include statutory VAT. Any additional delivery or shipping costs are stated separately in the respective product description.

4.2 The available payment methods are communicated to the Customer in the Seller’s Etsy listing.

4.3 Payments via Etsy Payments are processed by Etsy Ireland UC, Dublin, Ireland, or—if paid in USD or CAD—by Etsy Inc., Brooklyn, NY, USA. Etsy may use third-party payment service providers.

5) Delivery and Shipping Conditions
5.1 Goods are delivered to the delivery address provided by the Customer during the Etsy checkout process.

5.2 If delivery fails for reasons attributable to the Customer, the Customer shall bear the reasonable costs incurred. This does not apply if the Customer effectively exercises their right of withdrawal.

5.3 The Seller reserves the right to withdraw from the contract in case of incorrect or improper self-supply, provided this is not attributable to the Seller.

6) Retention of Title
The Seller retains ownership of the goods until full payment of the purchase price has been made.

7) Liability for Defects
Statutory warranty rights apply unless otherwise stated.
For entrepreneurs:
– The Seller may choose the type of subsequent performance.
– The limitation period for defects in new goods is one year from delivery.
– Warranty rights for used goods are excluded.

8) Processing According to Customer Specifications
8.1 The Customer is responsible for providing lawful content and usage rights for texts, images, or graphics supplied for customization.

8.2 The Customer indemnifies the Seller against third-party claims arising from rights infringements.

8.3 The Seller reserves the right to refuse processing orders that violate legal regulations or public morals.

9) Applicable Law
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

10) Alternative Dispute Resolution
The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

C. Right of Withdrawal
──────────────────────

Consumers have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party designated by you has taken possession of the last goods.

To exercise your right of withdrawal, you must inform us (Frank Georg, ADAM WILD, Dietkircher Str. 3, 65551 Limburg, Germany, Email: kontakt@adamwild.de) by means of a clear statement.

You must return the goods within twenty-one days. You bear the direct costs of returning the goods.

The right of withdrawal does not apply to goods that are custom-made or clearly tailored to personal needs.
