A. General Terms and Conditions

1) Scope of Application
1.1 These General Terms and Conditions (hereinafter "GTC") of Anita Barhainski, trading as "The Game Goods" (hereinafter "Seller"), apply to all contracts for the supply of goods concluded by a consumer or business (hereinafter "Customer") with the Seller via the online platform Etsy. Any deviating terms of the Customer are hereby rejected unless otherwise agreed.
1.2 These GTC also apply to contracts for the provision of digital content, unless otherwise regulated. Digital content refers to data that is created and provided in digital form.
1.3 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
1.4 A business is a natural or legal person or a partnership with legal capacity acting in the exercise of their trade or profession when concluding a legal transaction.

2) Conclusion of Contract
2.1 By listing a product on Etsy, the Seller makes a binding offer to sell that item.
2.2 The Customer accepts the offer via the Etsy order form. By clicking the final button in the order process, the Customer accepts the offer, and a purchase contract is concluded.
2.3 The contract text is stored by the Seller and sent to the Customer with the GTC and customer information in text form (e.g., email).
2.4 Before placing the order, the Customer can identify and correct input errors using standard keyboard and mouse functions and browser zoom.
2.5 The contract language is German.
2.6 The following languages are available for contract conclusion: English

3) Right of Withdrawal
3.1 Consumers generally have a right of withdrawal.
3.2 Detailed information is provided in the Seller’s withdrawal policy.

4) Prices and Payment Conditions
4.1 All prices include VAT. Any additional shipping costs are specified separately.
4.2 For deliveries outside the EU, additional costs such as transfer fees, taxes, or customs duties may apply.
4.3 Available payment methods are shown on Etsy.
4.4 Payments are processed via Etsy Payments by Etsy Ireland UC or Etsy Inc. (for USD/CAD).

5) Delivery and Shipping Conditions
5.1 Delivery is made to the address provided by the Customer unless otherwise agreed.
5.2 If delivery fails due to reasons caused by the Customer, the Customer bears the resulting costs.
5.3 If the product is unavailable due to supplier issues, the Seller may withdraw from the contract.
5.4 Digital content is delivered by direct access, download, or email.

6) Granting of Rights for Digital Content
6.1 The Customer is granted a non-exclusive, non-transferable, unlimited license for private use.
6.2 Redistribution or copying for third parties is not permitted.
6.3 The license becomes effective only after full payment.

7) Retention of Title
Goods remain the property of the Seller until full payment is received.

8) Liability for Defects
8.1 For businesses: 1-year warranty on new goods; no warranty for used goods; replacement does not restart warranty.
8.2 Exceptions: damages, fraud, building materials, or mandatory updates.
8.3 Businesses remain subject to statutory recourse claims.
8.4 Merchants must inspect goods and report defects.
8.5 Consumers are asked to report transport damage, but this does not affect rights.

9) Special Conditions for Custom Goods
9.1 If goods are customized, the Customer must provide content and rights.
9.2 The Customer is liable for any legal claims from third parties and agrees to indemnify the Seller.
9.3 The Seller may reject offensive, illegal, or inappropriate content.

10) Applicable Law
German law applies. For consumers, this applies only if protection under their national law is not diminished.

11) Alternative Dispute Resolution
The Seller is not obligated or willing to participate in a consumer dispute resolution procedure.

3.1 Data may be shared with payment and delivery services (e.g., Billbee, Printful).
3.2 Orders are processed using Billbee (billbee.io/privacy).
3.3 Orders are fulfilled via Printful (printful.com/policies/privacy).

4) Web Analytics
4.1 Google Analytics is used on Etsy. Data is anonymized and may be transferred to the USA.
4.2 Google Analytics 4 may be used, with consent only (Art. 6(1)(a) GDPR). Additional features like Google Signals and UserIDs may apply.

5) Data Subject Rights
You have the right to access, rectify, delete, restrict processing, data portability, and lodge complaints (Art. 15–21 GDPR).

6) Storage Duration
Depends on the legal basis and purpose. Data is deleted when no longer needed.

C. Right of Withdrawal

Consequences:
We will refund all payments, including delivery costs (except extra charges for other delivery types), within 14 days. Refunds will be made using the same method of payment unless agreed otherwise. We may withhold the refund until we have received the goods or you have provided proof of return.

Return shipping costs are borne by the Customer.

Exclusions:
No withdrawal for custom-made products or when digital content is accessed before the withdrawal period ends with consent.
