§ 1 - Provider, inclusion of the General Terms and Conditions
(1) Provider and contractual partner for the goods presented in the Etsy shop "Bloutenband" is Michel Behr, Blücherstr. 11, 22767 Hamburg, phone +49 40 33423549, email info@bluetenband.de (hereinafter referred to as “provider”).
(2) These general terms and conditions are part of every contractual agreement between the provider and the respective customer. Conflicting terms and conditions of the customer are contradicted.
§ 2 – Offer of goods and conclusion of contract
(1) The seller offers the items shown in his Etsy shop "Blossom" to other Etsy users for sale. The color of the items on the website may vary slightly depending on the internet browser used and the customer's monitor settings; these deviations are technically never completely avoidable.
(2) The selection of goods, the conclusion of the contract and the execution of the contract take place in German.
(3) The provider only delivers to customers with a delivery address within Germany.
(4) The customer selects the desired goods by placing them in the "shopping cart". In the "Check and order" step, the customer receives a summary to check for input errors. The order request can then be sent to the provider via the "Order with obligation to pay" button. Until the order is sent, the customer has the option of correcting his entries at any time by going back one or more order steps in the browser, or canceling the order entirely.
(5) The Provider submits a binding purchase offer for the goods presented in the Provider's shop. By sending the order request via the "Order with obligation to pay" button, the customer accepts the purchase offer. The provider confirms the conclusion of the contract by e-mail (contract confirmation).
(6) The content of a concluded contract (contract text) is automatically saved by Etsy in the Etsy user accounts of the provider and the customer and can be viewed by the customer in his user account on the Etsy portal via the menu "My Etsy" under the item " My purchases". After the conclusion of the contract, the customer also receives an e-mail from Etsy with the text of the contract. In addition, the provider does not save the text of the contract itself and does not make it accessible outside of the Etsy portal.
(7) In the event of delivery obstacles or other circumstances that would prevent the fulfillment of the contract, the provider will inform the customer by e-mail.
§ 3 - Prices and payment
(1) All product prices are total prices plus shipping costs. The fees include the statutory sales tax.
(2) The shipping costs are listed in the respective product description in the "Payment & Shipping" section.
(3) The provider delivers at the option of the customer against prepayment by redeeming an Etsy voucher, against prepayment by bank transfer, against prepayment by PayPal payment or against cash payment on collection. With the confirmation of the contract, the customer receives an Internet link by e-mail that leads him to the Etsy area "My purchases", which contains further information on the purchase process.
(a) To pay using an Etsy voucher, the customer can enter one or more voucher codes in the “My Purchases” area. The voucher value is credited to the provider and the invoice amount is paid in this way. If a voucher value is higher than the invoice amount, the voucher remains valid for the excess amount.
(b) If the customer has selected "bank transfer" as the payment method, the customer will be informed of the provider's bank details in the "My purchases" area. The provider only accepts transfers from abroad as free payments in euros.
(c) If the customer has selected “PayPal” as the payment method, he can go to the PayPal online service via the “My Purchases” area and initiate the payment there.
(d) If the customer has chosen "cash payment" as the payment method, he can pick up the goods at the provider's registered office.
(4) If other payment methods are listed in the product description in the "Payment and Shipping" section (e.g. credit card, Sofortüberweisung, iDEAL, EPS), such payments are processed via the payment service provider Mangopay (Mangopay S.A., 59 Boulevard Royal, 2449 Luxembourg, www .mangopay.com).

(5) A payment period of one week from receipt of the contract confirmation applies to prepayment orders. The provider puts the desired goods back for the customer for the duration of the payment period. It is the customer's responsibility to make his payment in good time so that the provider receives it within the deadline. § 4 – Dispatch, delivery times
(1) The provider delivers the goods within 4-6 working days after payment.
(2) For products that are marked as "customizable" in the product description, the delivery time increases by one week if the customer requests such customization.
(3) Several products ordered at the same time are delivered in one shipment; the delivery time of the product with the longest delivery time applies to the joint shipment. If the customer wishes the delivery of a certain product with a shorter delivery time in advance, he must order this product separately.
(4) If the delivery to the customer fails because the customer has given the delivery address incorrectly or incompletely, a new delivery attempt will only be made if the customer assumes the direct costs of the new shipment. These costs correspond to the shipping costs agreed upon conclusion of the contract.
(5) If the customer has chosen cash payment as the payment method, the goods will not be shipped. Instead, the customer can pick up the goods at the supplier's place of business 2 working days after the conclusion of the contract; for individualized products (see paragraph 2), the time until delivery is extended by one week.
§ 5 – Consumer Right of Withdrawal
(1) An orderer who buys as a consumer has a right of withdrawal in accordance with the statutory conditions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.
(2) If the right of withdrawal is exercised, the provider shall bear the costs of the return.
(3) The provider grants a consumer with a permanent residence outside of Germany a consumer right of withdrawal in accordance with the German requirements and legal consequences even if the national law of the consumer does not provide for a right of withdrawal or if the withdrawal is linked to a shorter period or to a stricter form than Under German law.
§ 6 – Warranty (right to liability for defects)
There are warranty claims on the part of the customer (also referred to as liability for defects) in accordance with the statutory provisions.
§ 7 - Final Provisions
(1) The law of the Federal Republic of Germany applies to the exclusion of the UN Sales Convention. However, German law does not apply to consumers with a permanent residence abroad, insofar as the national law of the consumer contains regulations from which the consumer cannot deviate by contract.
(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the parties agree that the place of jurisdiction is the registered office of the provider.
(3) Should individual provisions of these general terms and conditions prove to be ineffective or unenforceable, this shall not affect the validity of the remaining provisions.
