I handle your personal data with care
To fulfill your order, you must provide me with certain information (which you have authorized Etsy to provide to me), such as your name, email address, mailing address, payment information, and the details of the product you are ordering.
This privacy policy describes how and when I collect, use, and share information when you purchase an item from me, contact me, or otherwise use my services through Etsy.com or related sites and services.

This privacy policy does not apply to the practices of third parties over which I have no control, including Etsy and / or other third party services that you can access through Etsy. I refer you to the Etsy privacy policy for this.

I rely on a number of legal bases to collect, use and share your information, including:
- To provide my services, such as when I use the information to fulfill your order, or to settle disputes if necessary or, of course, to provide good customer service.
- When necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchases if required by the tax authorities.
- For complying with the Etsy Seller Policy and Terms of Use. That means I will use your information as necessary to fulfill my obligations under the Etsy Seller Policy and Terms of Use. In addition, for the purpose of my legitimate interests, if those legitimate interests do not outweigh your rights or interests, such as, for example, providing and improving my services.
- Finally, and only if you give separate permission for this, which you can withdraw at any time, for example to sign up for my newsletter.

Personal data that we process
We only use information that you expressly and voluntarily provide when you visit the Etsy website. We use this information to help you as best as possible. You provide personal data when:
• You purchase a painting or digital product.
• Mark your products in our store as "favorite".
• You sign up for the newsletter via our own website.

Sharing your data
Information about my customers is important to heARTsongpaintings. I only share your personal information in the following situations:
- Etsy. I share information with Etsy as necessary to provide you with my services and to comply with my obligations under both the Etsy Seller Policy and Terms of Use.
- Service providers. I engage certain trusted third parties to perform functions and provide services to my store, such as delivery companies. I will share your personal information with these third parties, but only to the extent necessary to perform these services.
- Business transfers. If I sell or merge my business, I may disclose your information as part of that transaction, only to the extent permitted by law.
- Compliance with Laws. I may collect, use, store and share your information if I have a good faith belief that it is reasonably necessary to: 1) demonstrate my business practices to the Dutch tax authorities if necessary; 2) respond to legal process or government requests; ; 3) prevent, investigate and address fraud and other illegal activities, security or technical problems; or 4) protect the rights, property and safety of my customers or others.

Keep your data
I will only keep your personal information for as long as is necessary to provide you with my services and as described in this privacy policy. However, I may also need to retain this information to comply with legal and regulatory obligations, resolve disputes, and enforce my agreements. There is no specific retention period for personal data under the General Data Protection Regulation (GDPR). In general, I keep your data for 5 years.

View, modify or delete data
You have the right to view, correct or delete your personal data. You can do this yourself via the personal settings of your Etsy account. You also have the right to withdraw your consent to the data processing or to object to the processing of your personal data by heARTsongpaintings and you have the right to data portability. This means that you can submit a request to us to send the personal data that we have about you in a computer file to you or another organization mentioned by you.

If you want to use your right to object and / or right to data portability or if you have other questions / comments about data processing, please send an email.
To ensure that the request for access has been made by you, we ask you to send a copy of your ID with the request. Make your passport photo, MRZ (machine readable zone, the strip with numbers at the bottom of the passport), passport number and Citizen Service Number (BSN) black in this copy. This is to protect your privacy. HeARTsongpaintings will respond to your request as soon as possible, but in any case within four weeks.

If you live in Europe, I would also like to point out that you have the opportunity to file a complaint about my use of your information with the local supervisory authority, the Dutch Data Protection Authority.
