GENERAL CONDITIONS OF SALE updated on November 14, 2021
The fact of placing an order implies the adhesion of the buyer to these conditions.
1--WITHDRAWAL
RIGHT OF WITHDRAWAL :
- You have the right to withdraw from this contract without giving any reason within fourteen days.
- The withdrawal period expires fourteen days after the day on which you or a third party other than the carrier and designated by you, takes physical possession of the goods.
- To exercise the right of withdrawal, you must notify : Marie-Christine Martin, 10 rue Sully, 78180 Montigny-le-Bretonneux, of your decision to withdraw from this contract by means of an unambiguous statement (e.g. letter sent by post or e-mail). You can use the model withdrawal form but it is not obligatory.
- For the withdrawal period to be respected, it is sufficient that you send your communication on the exercise of the right of withdrawal before the withdrawal period expires.
EFFECTS OF WITHDRAWAL :
- In the event of your withdrawal from this contract, we shall refund all payments received from you, including delivery costs (with the exception of any additional costs arising from the fact that you have chosen a method of delivery other than the one offered by us) without undue delay and in any event no later than fourteen days from the day on which we are informed of your decision to withdraw from this contract. We will make the refund using the same method of payment that you used for the original transaction, unless you expressly agree to a different method; in any event, no costs will be incurred by you as a result of the refund.
- We may defer the refund until we have received the goods or you have provided proof of dispatch of the goods, whichever is the earlier.
- You must return the goods to us Marie-Christine Martin, 10 rue Sully, 78180 Montigny-le-Bretonneux without undue delay, and in any event, no later than fourteen days after you have informed us of your decision to withdraw from this contract. This period is deemed to have been respected if you return the goods before the expiry of the fourteen-day period.
- You shall bear the direct costs of returning the goods.
- You are only responsible for the depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the goods.
RETRACTION FORM: model at the end of the GTC (chapter 9)
The model form will be sent as an attachment with the order confirmation by e-mail.
Exceptions to the right of withdrawal: The following are not taken back: personalised orders, made-to-measure products, washable make-up removal wipes, masks, FOOD CHARLOTS.
2--LEGAL GUARANTEES OF CONFORMITY AND HIDDEN DEFECTS :
The consumer :
- has a period of two years from the delivery of the goods to act;
- may choose between repairing or replacing the goods, subject to the cost conditions set out in Article L. 211-9 of the Consumer Code;
- is exempted from proving the existence of the lack of conformity of the goods during the six months following the delivery of the goods. This period is extended to twenty-four months from 18 March 2016, except for second-hand goods.
- The legal guarantee of conformity applies independently of any commercial guarantee.
- The consumer may decide to implement the guarantee against hidden defects in the item sold within the meaning of Article 1641 of the Civil Code and in this case may choose between rescission of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.
The legal guarantee of conformity is 2 years from the delivery of the goods, as provided for in Article L.217-7 of the Consumer Code.
The legal guarantee for hidden defects provided for in article 1648 of the civil code also provides for a two-year guarantee: "The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect".
3--Prices: The prices are in euros including VAT.
According to article 293 B of the C.G.I, VAT is not applicable.
4--VALIDATION OF YOUR ORDER: A summary of the information of your order and of the present GTC will be communicated to you in PDF format via the e-mail address of confirmation of order
5--DELIVERY TIME: visible on each product sheet, in the order confirmation email and in the shipping confirmation email.
Your order will be dispatched within 1 to 2 working days after the payment has been registered if the item is in stock. The delivery time is extended in case of holidays. For a custom-made article, add the time of realization which will have been indicated to you during our exchanges of mails.
The shipments are made by registered mail.
6--DELIVERY: The products are delivered to the delivery address indicated during the ordering process.
MISTAIDRA cannot be held responsible for the delivery of a parcel to an incorrect address.
7- SETTLEMENT OF DISPUTES
-In the event of a dispute, the customer has the possibility of having recourse free of charge to a consumer mediator, the costs being borne by the seller.
In accordance with articles L.616-1 and R.616-1 of the Consumer Code, our company has set up a consumer mediation system. The mediation body chosen is: SAS CNPM - MÉDIATION - CONSOMMATION.

8-- MODIFICATION OF THE GCV
MISTAIDRA reserves the right to modify these GTC at any time. The new GTC will only apply to sales made after the modification.
