Conditions
§ 1 - Provider, inclusion of the GTC
(1) Provider and contract partner for the goods shown in the Etsy shop "LittlePeacesShop" is Jennifer Weihert, Berliner Str. 12, 63538 Großkrotzenburg, Phone: 0173 8208988, eMail: littlepeacesshop@gmail.com (hereinafter referred to as "provider").
(2) These terms and conditions are part of every contractual agreement between the supplier and the respective customer. Contrary terms and conditions of the purchaser are contradicted.
§ 2 - product range and conclusion of contract
(1) The provider offers the items shown in his Etsy shop "LittlePeacesShop" to other Etsy users for purchase. The color representation of the articles on the website may vary slightly depending on the Internet browser used and monitor settings of the customer; These deviations are technically never completely avoidable.
(2) Selection of goods, conclusion of contract and contract execution are in German language.
(3) The supplier delivers within Germany as well as in the countries of the EU.
(4) The customer selects the desired goods by placing them in the "shopping cart" or clicking on the button "buy now". The order request can finally be sent to the provider via the button "order to pay". The purchaser has until the sending of his order request at any time the opportunity to view the data specified in the order and change or cancel the order altogether.
(5) For the goods shown in the shop of the provider, the provider makes a binding offer. With the sending of the order request, the buyer accepts the purchase offer. The provider confirms the contract by e-mail (contract confirmation).
(6) The content of concluded contracts is stored in the Etsy user account of the purchaser and can be viewed by the purchaser in the Etsy portal at any time. In addition, the provider does not save the contract text itself and makes it outside of Etsy also not accessible.
(7) In the event of delivery obstacles or other circumstances that would prevent the fulfillment of the contract, the vendor informs the purchaser by e-mail.
§ 3 - Prices and Payment
(1) All product prices are final prices plus shipping costs. VAT is not charged.
(2) The shipping costs are listed in the respective product description in the section "Shipping & Returns".
(3) The provider delivers at the option of the customer against advance payment with credit card payment or advance payment by PayPal payment.
a) If the customer has chosen "PayPal" as the payment method, he will reach the payment via the button "Click here to pay with PayPal" to the online service of PayPal.
b) If the customer has chosen "credit card" as payment method, he is requested to enter the credit card data.
(4) For advance payment orders, a payment period of one week from receipt of the contract confirmation. The provider places the desired goods back during the period of payment for the customer. It is the purchaser's responsibility to effect payment in good time so that it can be received by the provider within the deadline. The provider reserves the right to withdraw from the contract of sale and sell the goods elsewhere if the payment has not been received by the deadline. Any payment received by the purchaser after the resignation will be reimbursed to the purchaser.
§ 4 - Shipping, delivery times
(1) The supplier delivers the goods within 1-2 business days from payment.
(2) For products which are marked as "can be personalized: yes" in the product description, the delivery time increases by 3 working days, if the customer orders such an individualization.
(3) For shipments to destinations outside Germany, the delivery time will increase by another 2-9 working days, depending on the destination country.
(4) several products ordered at the same time are delivered in a common shipment; For the joint shipment, the delivery time of the product with the longest delivery time applies. If the customer wishes to deliver a certain product in advance with a shorter delivery time, he must order this product separately.
(5) If the delivery to the customer fails because the customer has given the delivery address incorrectly or incompletely, a new delivery attempt will only be made if the customer accepts the direct costs of the new shipment. These costs correspond to the shipping costs agreed upon conclusion of the contract.
§ 5 - Consumer right of withdrawal
(1) A purchaser who buys as a consumer is entitled to a right of revocation according to the legal conditions. A consumer is any natural person who enters into a legal transaction for purposes which are predominantly neither commercial nor self-employed.
(2) The consumer shall grant a consumer right of withdrawal in accordance with the German requirements and legal consequences to a consumer with permanent residence outside Germany even if the consumer's national law does not provide for a right of revocation or if the revocation is linked to a shorter period or a stricter form than Under German law.
(3) In case of exercising the right of withdrawal, you bear the direct costs of returning the goods.
§ 6 - Warranty (right to defect)
There are warranty claims of the customer (also called warranty rights) in accordance with the statutory provisions.
§ 7 - Final provisions
(1) The law of the Federal Republic of Germany applies excluding the UN sales law. However, German consumers do not apply to consumers who permanently reside abroad, provided that the national law of the consumer contains provisions from which the consumer can not derogate from the contract.
(2) Should individual provisions of these terms and conditions prove to be ineffective or unenforceable, this shall not affect the validity of the remaining provisions.
Cancellation
Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods.
To exercise your right of withdrawal, you must me (Jennifer Weihert, Berliner Str. 12, 63538 Großkrotzenburg, phone: 0173 8208988, eMail: littlepeacesshop@gmail.com) by means of a clear statement (eg a letter sent by mail or e-mail) inform about your decision to withdraw from this contract. You can use the attached model withdrawal form, which is not required.
In order to maintain the cancellation period, it is sufficient that you send the notice of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of the cancellation
If you revoke this Agreement, I shall reimburse you for any payments I have received from you, including delivery charges, promptly and not later than fourteen days from the date on which I received notice of your withdrawal of this Agreement. For this repayment, we use the same means of payment that you used in the original transaction, unless otherwise agreed with you; In no case will you be charged for this repayment fees.
I may refuse to repay you until I have the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return the goods to me, Jennifer Weihert, Berliner Str. 12, 623538 Großkrotzenburg, without delay and in any event not later than fourteen days from the date on which you inform us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days.
You bear the immediate costs of returning the goods.
Exceptions to the right of withdrawal
The right of withdrawal does not apply to delivery of goods that have been made to your customer's specifications.
