PRIVACY POLICY

I, Retha Engels, am the owner of InvitlyStudio, based in South Africa. This Privacy Policy explains how I collect, use, share and retain personal information when you purchase from InvitlyStudio or contact me through Etsy.

This policy applies only to information I receive through Etsy. Etsy has its own Privacy Policy covering the information it collects and processes.

1. PERSONAL INFORMATION I RECEIVE

To complete your order, Etsy may provide me with limited personal information, including your name, email address, billing country or address, order details, transaction information, Etsy messages and any personalization information you voluntarily provide.

I do not receive or store your complete credit card, banking or Etsy password information. Payments are processed by Etsy and its payment providers.

Please do not send sensitive personal information through Etsy Messages unless it is genuinely required to complete your order.

2. HOW I USE YOUR INFORMATION

I use your information only when necessary to:

• Process and fulfil your digital order.
• Provide access to purchased files or Canva templates.
• Respond to questions and provide customer support.
• Resolve problems relating to an order or download.
• Maintain appropriate business, accounting and tax records.
• Prevent fraud, misuse or infringement.
• Comply with Etsy’s Seller Policy and Terms of Use.
• Comply with applicable legal obligations.

I do not add Etsy buyers to mailing lists or send unsolicited marketing messages without their clear consent.

3. LEGAL BASIS FOR PROCESSING

I rely on the following legal grounds when processing personal information:

Contract: I require certain information to provide the digital product or service you purchased.

Legal obligation: I may need to retain transaction information for tax, accounting or legal purposes.

Legitimate interests: I may use limited information to operate and improve my shop, provide customer service, protect my work and prevent fraud, provided these interests do not override your rights.

Consent: Where legally required, I will request your permission before using your information for another purpose.

4. SHARING OF PERSONAL INFORMATION

I share personal information only where reasonably necessary:

Etsy: Information is shared with Etsy as necessary to provide my services and comply with Etsy’s Seller Policy and Terms of Use.

Service providers: I may use trusted providers for essential services such as secure file storage, accounting or professional advice. These providers receive only the information necessary to perform their services.

Legal compliance: I may disclose information if required by law, court order or a lawful government request, or when necessary to protect my rights, prevent fraud or respond to a legal claim.

Business transfer: If InvitlyStudio is sold or reorganised, customer information may form part of that transaction, subject to applicable privacy laws.

I do not sell or rent buyers’ personal information.

Opening or using a Canva template may involve Canva processing information under Canva’s own terms and Privacy Policy. I do not control Canva’s independent collection or processing of information.

5. DATA RETENTION

I retain personal information only for as long as reasonably necessary to fulfil orders, provide customer support, resolve disputes and meet legal, accounting or tax obligations.

Transaction records may normally be retained for up to five years, or longer if required by applicable law. Information that is no longer required will be deleted, securely destroyed or de-identified where reasonably possible.

6. INTERNATIONAL DATA TRANSFERS

I am based in South Africa and sell through Etsy to customers in different countries. Personal information may therefore be processed outside a buyer’s country of residence through Etsy and other necessary service providers.

Where applicable, I take reasonable steps to process personal information in accordance with relevant privacy laws, including South Africa’s Protection of Personal Information Act (POPIA) and applicable international data-protection requirements.

7. YOUR RIGHTS

Depending on where you live, you may have the right to:

• Ask what personal information I hold about you.
• Request access to or a copy of your information.
• Ask for incorrect or incomplete information to be corrected.
• Request deletion of information, subject to legal record-keeping obligations.
• Object to or restrict certain uses of your information.
• Withdraw consent where processing is based on consent.
• Lodge a complaint with an appropriate data-protection authority.

For information held directly by Etsy, including Etsy account and payment information, you may need to contact Etsy directly.
