THANK YOU for purchasing my art!!

By purchasing my instant downloads, digital art, clip art, illustrations and graphics, you agree to my Terms of Use. You understand that there is no transfer of copyright or exclusive rights to any of my work. You are purchasing my art for your personal use or small commercial use, hence you purchase a SMALL COMMERCIAL USE LICENSE with the item.

TERMS OF USE - For all of my Graphics, all Digital Designs, Clip Art, Digital Papers, Digital Patterns, all Digital Files sent electronically to you:

YOU MAY
1. Use my artwork to create items for personal or small commercial use. Create designs for (but not limited to) greeting cards, invitations, bottle caps, pendants, iron-on transfers, stickers, magnets, wall decals, wall clings, printable wall art, stationery, note cards, postcards, paper crafts, shrink plastic designs, labels, candy bar wraps, coloring pages, embroidered clothing, brochures, party printables, the list is endless, use your creativity!

FOR SMALL COMMERCIAL USE: My graphics must be incorporated into something new that you’ve created yourself. The artwork, my clip art, graphics and illustrations, must be incorporated with your additional designs and flattened. They cannot be re-sold, in any way, as the original graphics that you have received in formats that are transparent PNG extension files.

2. You may incorporate my designs within commercial items for re-sale (500 units or less) provided that the other TOU policies are met. You may sell tangible (printed) products, or as digital files (such as printables) that have been flattened (JPEG, TIFF, PNG or PDF) so as they are not able to be extracted or shared in any way. (As in 'layers').

3. For POD (print on demand) my graphics must be incorporated into something that you've created, merged and flattened onto something else. Not to be used as single image graphics (png file) as the completed design.

EXAMPLE: You may not use my images ALONE on a t-shirt, mug, magnet or any product and sell ‘as is’ - my art must be included in a design image that you have created. The design you create is to be a flattened file, so it is not in layers.

4. FOR DIGITAL PAPERS ONLY: To use my digital papers, or 'surface patterns' designs on items without adding your additional artwork, you must purchase an EXTENDED COMMERCIAL USE LICENSE for EACH ‘pack’ or ‘set’ of DIGITAL PAPERS. No credit to the artist is required when this is purchased.

Examples: For the purpose of designing background images for such products as seen on POD sites like Zazzle, Cafe Press and Red Bubble, referring to and not limited to, such products as pillows, notebook covers, candy tins, clocks, electronic device skins, iOS Apps, iPhone, iPod, iPad and other electronic device covers. You must purchase one license per ‘set’ ‘pack’ or ‘kit’ of digital papers. Aka ‘scrapbook pages’ ‘digi scrap pages’.

5. You may give proper credit to the artist stated in this way “Created using graphics by Cherie's Art” or a link address should be provided to my Etsy shop, www.etsy.com/shop/cheriesartsncrafts. One or the other must be used at least once on your design listings or blog posts.

You don't have to credit me all the time! I am pretty lenient about this. As long as you are adding your artwork to my artwork, and creating something new with it, not claiming that my artwork is yours, I am pretty flexible with this. I know it's hard to always credit the artist, but if anyone does ask, please do credit me and direct them to my Etsy shop!

YOU MAY NOT
1. Use my art as it is, as logos. You may add my art to yours to include it in your design for a logo.

2. USE in any type of mass production, (501 or more pieces) not for wholesale, not on thousands of t-shirts or other items. Please contact me if you wish to do so.

3. CLAIM my art as your own.

4. SHARE digital art files among computers, your family or friends.

5. SELL my graphics, clip art or digital papers in kits, sets or packs of any kind.

6. USE MY DIGITAL PAPER DESIGNS for the use of designing FABRICS or MATERIAL (cloth) of any kind. Whether for personal use or for the purpose of selling at online fabric sites such as Spoonflower, this is not allowed.

Even if you have added your own artwork to my designs, my digital papers are not to be used for designing fabrics, material, cloth products that sell as swatches, fat quarters or by the yard.

7. CLAIM to sell exclusive rights or copyrights to your customers for printed materials such as invitations, greeting cards, brochures, fliers, etc..

8. SELL any of the designs you create with my artwork in LAYERS. FILES MUST BE FLATTENED so as that my graphics / designs cannot be extracted.

9. SELL MY PRINTABLES such as wall decor, paper crafts, Photoshop templates and greeting cards that I have designed, that you have purchased from me. These are NOT FOR RESALE.

10. You may not have my artwork digitized for use in selling as embroidery files.

Frequently asked questions

Can I get a refund on 'instant download' digital files?

Due to the nature of the 'instant download' digital files, once you have downloaded the files, there are no refunds. If you have not downloaded the digital files, ( I will be able to see this via your receipt ), I can then refund your money.

If I lose my digital file, can I download it again?

There are generally no limits for when or how many times you can download a file. In most cases you can access a file any time on your Purchases page, provided the transaction hasn't been canceled or removed.

May I Cancel My Order?

Yes, if you have not downloaded your digital files within 24 hours. I am able to check to see if you have downloaded the files via the receipt.

May I use your artwork on POD sites, like Zazzle or Society6?

Yes, provided you add other artwork to it! You may not just plop down one of my PNG or JPG images on a t-shirt, or any other product, and sell it. My art is meant to be part of your design.

You must flatten the files so as they can not be extracted in any way.

YOU MAY NOT use any of my digital papers for POD sites 'AS IS' or alone. You must add artwork to it and flatten the file.

What is a 'zipped' file?

Because the digital files have to be under 20MB each, Etsy only allows us a total of 100MB at this time, the files have to be compressed, or 'zipped' which means that you have to have a program that unzips those compressed files. There are two free programs that you can download, just Google them, WinZip and 7-Zip. Your computer may already have a program that unzips files.

May I use your digital papers for use in creating fabrics to sell?

No. My digital scrapbooking papers, or surface patterns, are not for your use for creating fabrics to sell at Spoonflower or Zazzle, or any other fabric manufacturer.

You may not use my digital papers to create 'all over' printing on clothing of any kind, on any website.

You may not use my digital papers for shower curtains, book covers, iPhone or iPad cases, or on any product where you will be 'tiling' my patterns or having them being the sole design on any products.

May I use your images, convert them to create and sell as embroidery files?

You may not use my images for the purpose of converting them to embroidery files and selling them 'as is' or alone.

You may include my artwork in your embroidery designs that you sell provided that my artwork is in a flattened state, so as they are not to be extracted and used in a seperate file.

May I use your images as logos?

You may use my artwork for your logo designs provided that they are part of your design, not selling them 'as is' or alone.

You may not claim to sell exclusive rights or copyrights to your customers for logos or printed materials such as invitations, greeting cards, brochures, fliers, etc..

Do I have exclusive rights once I purchase your artwork?

By purchasing my digital art / graphics, you agree to my Terms of Use. You understand that there is no transfer of copyright, you do not purchase exclusive rights to any of my work. You are purchasing the art for personal or small commercial use, hence you purchase a SMALL COMMERCIAL USE LICENSE with the item.

FOR SMALL COMMERCIAL USE: Graphics must be incorporated into something new that you’ve created yourself. The artwork, my graphics and illustrations, must be incorporated with your additional designs and flattened. They cannot be re-sold, in any way, AS the original graphics you receive.

You may NOT claim the artwork as your own. You may NOT sell my art in kits of any kind.

Do I have to credit you as the artist on the designs I sell?

YOU've created something using my art, and that makes me happy! As long as you follow my requests in not using my art alone, claiming it as 'your own' and not using my digital papers as fabrics or alone (as is), then I'm pretty easy going. You don't have to give me credit on every single item you create but it would be GREATLY APPRECIATED, and if you would credit me as the artist if someone asks!
