c. Customer – every person buying items in the Color Design Circus Shop in Etsy or every person contacting Shop.

2. Privacy Policy
This Privacy Policy describes how and when Data Cotroller collect, use, and share information when Customer purchase an item from Shop, contact Shop, or otherwise use Shop’s services through Etsy.com or its related sites and services.
This Privacy Policy does not apply to the practices of third parties that Data Cotroller does not own or control, including Etsy or any third party services that Customer access through Etsy. Customer can reference the Etsy Privacy Policy to learn more about its privacy practices.

3. Data that is collected and used
To fulfil an order, Customer must provide the Data Cotroller with certain information (which Customer authorized Etsy to provide to the Data Controller), such as Customer’s:
a. name,
b. email address,
c. postal address,
d. payment information,
e. the details of the product that you’re ordering.
f. Customer may also choose to provide the Data Cotroller with additional personal information (for a custom order of invitation, for example), if Customer contact Shop directly.

4. What is data collected and used for
Data Controller rely on a number of legal bases to collect, use, and share Customer’s information, including:
• as needed to provide services, such as when Custromer’s information is used to fulfil an order, to settle disputes, or to provide customer support;
• when Customer has provided their affirmative consent, which they may revoke at any time, such as by signing up for Shop’s mailing list;
• if necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about Custromer’s purchases if required by tax law; and
• as necessary for the purpose of Data Controller legitimate interests, if those legitimate interests are not overridden by Custromer’s rights or interests, such as 1) providing and improving Shop’s services. Data Cotroller use Custromer’s information to provide the services Custromer requested and in Data Cotroller’s legitimate interest to improve their services; and 2) Compliance with the Etsy Seller Policy and Terms of Use. Customer’s information is used as necessary to comply with Data Cotroller’s obligations under the Etsy Seller Policy and Terms of Use.
5. Third parties whit whom personal data may be shared
Customers’ personal information may be shared for very limited reasons and in limited circumstances, as follows:
• Etsy. Information may be shared with Etsy as necessary to provide services and comply with obligations under both the Etsy Seller Policy and Etsy Terms of Use.
• Service providers. Data may be shared with third parties engaged to perform functions and provide services the Shop, such as delivery companies. The Customer’s personal information will be shared with these third parties, but only to the extent necessary to perform these services.
• Business transfers. In case of selling or merging business, Customer’s information may be disclosed as part of that transaction, only to the extent permitted by law.
• Compliance with laws. Data Cotroller may collect, use, retain, and share Customer’s information if he have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce his agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of his customers, or others.

6. Data Retention
Customer’s personal information is retained only for as long as necessary to provide Customer with services and as described in Privacy Policy. It also may be required to retain this information to comply with Data Controller legal and regulatory obligations, to resolve disputes, and to enforce Data Cotroller’s agreements.

7. Customer Rights
If Customer reside in certain territories, including the EU, they have a number of rights in relation to their personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. These rights are described below:
a. Access. Customer may have the right to access and receive a copy of the personal information Data Controller hold about the Customer by contacting Data Cotroller using the contact information below.
b. Change, restrict, delete. Customer may also have rights to change, restrict use of, or delete their personal information. Absent exceptional circumstances (like where it is required to store data for legal reasons) generally your personal information will be deleted upon request.
c. Object. Customer can object to (i) processing of some of information based on Data Controller legitimate interests and (ii) receiving marketing messages after providing Customer express consent to receive them. In such cases, Customers personal information will be deleted unless Data Controller have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.
d. Complain. If Customer reside in the EU and wish to raise a concern about use of personal information (and without prejudice to any other rights Customer may have), Customer has the right to do so with their local data protection authority.

Polityka Prywatności opisuje jak Administrator zbiera, przetwarza oraz udostępnia dane Klienta pozyskane w wyniku złożenia przez Klienta zamówienia, kontaktu lub innego sposobu korzystania ze Sklepu.

3. Przechowywane i przetwarzane dane osobowe
W związku z obsługą zamówienia dokonanego w sklepie Administrator przechowuje i przetwarza następujące dane podane przez Klienta:
a. Imię i Nazwisko
b. Adres do wysyłki
c. Dane do faktury – imię i nazwisko lub nazwa firmy, adres, NIP (w przypadku firmy)
d. Dane kontaktowe – adres e-mail, numer telefonu
e. Dane płatności
f. Informacje o zamówionych produktach
g. Inne informacje przekazane dobrowolnie w wiadomości do sklepu

4. Cele i podstawy prawne przetwarzania danych osobowych:
Powyżej wymienione dane przechowywane, przetwarzane i udostępnione są w celu obsługi zamówienia w zakresie koniecznym do jego realizacji (art. 6 ust. 1 lit c RODO), kontaktu z Klientem (art. 6 ust. 1 lit b RODO) oraz w celu przesyłania informacji marketingowych. Podstawą prawną tych działań są:
a. Złożone zamówienie i obowiązek jego realizacji
b. Zgoda Klienta wyrażona np. w ramach zgody na przesyłanie informacji marketingowych (art. 6 ust. 1 lit a RODO)
c. RODO

5. Odbiorcy danych
Dane udostępniane są
a. Etsy w zakresie, w którym zobowiązują Administratora dokumenty Etsy Seller Policy oraz Etsy Terms of Use.
b. Dostawcy usług koniecznych do funkcjonowania Sklepu np. hosting, księgowość, mailing; w zakresie koniecznym do prawidłowego dostarczania tych usług (art. 6 ust. 1 lit f RODO)
c. Właściwym organom bądź osobom trzecim, które w ramach odpowiedniej podstawy prawnej zażądają udzielenia informacji – w zakresie koniecznym oraz zgodnie z obowiązującym prawem.
d. Przewoźnikowi w celu realizacji zamówienia

6. Okres przetwarzania danych osobowych
Dane przechowywane są przez Administratora przez okres realizacji zamówienia oraz po jego realizacji aż do wycofania wyrażonej zgody przez Klienta lub zgłoszenia skutecznego sprzeciwu wobec przetwarzania przez Administratora danych w ramach uzasadnionego interesu Administratora. Ponadto dane mogą być przechowywane dłużej, jeśli będzie tego wymagać ewentualne dochodzenie roszczeń lub obrony przez roszczeniami (art. 6 ust. 1 lit f RODO). Dodatkowo dane będą przechowywane przez okres określony przepisami prawa.

7. Uprawnienia Klienta
Klient ma prawo do:
a. Dostępu do danych przechowywanych przez Administratora
b. Usunięcia danych poza okresem, w którym Administrator jest zobowiązany prawem do przechowywania danych.
c. Ograniczenia przetwarzania poza okresem, w którym Administrator jest zobowiązany prawem do przetwarzania danych.
d. Przenoszenia danych
e. Wniesienia sprzeciwu względem przetwarzania danych
f. Wniesienia skargi do lokalnego organu nadzorczego ochrony danych osobowych

W zakresie, w jakim dane Klienta przetwarzane są na podstawie zgody, można zażądać ich usunięcia, wycofując zgodę w dowolnym momencie, kontaktując się z Administratorami.
