My shop, GABYGA, offers transparency and trust and reliable customer service, always there for every request or concern.

*The Information I collect*

When you make a purchase, you provide me the information needed to fulfill an order. You provide me information that you have previously authorized Etsy to provide to me, such as your name, e-mail address, shipping address and payment information (your billing address or your PayPal account). You also send me the details of the product that you purchase and in my handmade business, I always ask for your body measurements, such as bust, waist, hips and height in order to offer you a perfect fit. These are not mandatory, but they help us in creating your items and offering the best fit that we can get at a long distance. Your phone number is also needed for the shipping company so that the courier can find you at the address given. I do not use your phone number in any other way and I do not make any promotions over phone calls.

*How I use your information and why do I need it*

I rely on some legal bases to collect, use and share your information with any third party and that includes the following:

* to provide my services: to fulfill your order, offer you customer support and settle disputes
* if necessary to comply with legal obligations, when I create my finances and offer information about your purchases that is required by the tax laws in my country
* if you provide your consent in using your info for receiving news or promos about my brand in e-mail marketing campaigns. I will always ask you clearly if you wish to be part of the newsletter and will not use your e-mail address without your clear affirmative consent

*Sharing Information & Disclosure*

Your privacy and safety are crucial for my business. Build on transparency and trust, GABYGA always puts the customer's needs first, so I will never share your information any other way, but in limited situations such as:

1. Etsy. I share information with Etsy as it is necessary to provide and fulfill my services and comply with all my obligations for Etsy, including the Etsy Terms of Use and Etsy Seller Policy.

2. Service Providers. I use and engage very trustworthy third parties to fulfill services for my shop, such as the shipping companies. I will share your information with these companies but only to fulfill the service and I carefully select these providers who share the same privacy policy as my shop and brand.

3. Compliance with laws. I may share your information only if there is a matter of legal or government request or of I suspect any act of fraud or any illegal activity, technical or security issues. I will always protect the rights, property and safety of my customers

*How long do I keep your data*

Your data is kept only during the time I need to fulfill your order or request. I may save your personal information such as your body measurements, if you are a regular customer and I may also be required to retain some information to comply with legal and financial obligations, but I will not keep this data longer than 2 years.

*Your personal Information Outside EU*

I may store and process your information through third-party hosting services in the US and other jurisdictions. I also sell worldwide and shipping companies use transport both in EU and outside EU to reach and fulfill an order. This may result in your personal information being transferred to a jurisdiction with different data protection and government surveillance laws than your jurisdiction. I rely on Privacy Shield as as the legal basis for the transfer if your information is transferred outside EU, as Google Cloud is Privacy Shield certified.

*Your Rights*

If you are resident in the EU but also in other territories, you have certain rights regarding your personal information.

1. Access: you have the right to access and receive a copy with your personal information and you can contact me to receive it
2. Change, make any restriction and delete. You also have the right to make any change, to restrict your information and to delete it. Except for the case when I will need the information for any legal matter, I will delete it if asked.
3. Object. You can object to me and the process of your information, for example in receiving marketing material or any promos, even after you have expressed you affirmative consent. You can change that anytime you wish.
4. Complain. If you live in the EU and have any complaint to make at my use of your data, you have the right to do so with your local data protection authority.

- EXCHANGES: If you're unhappy with the fit, we offer one free size exchange per garment! Kindly note that we're unable to provide a return shipping label, but we'd be happy to send your replacement item at no additional charge upon receiving your item for exchange.

- RETURNS: Upon receiving any garment(s) from you for return, we will reimburse you within 5 business days.


Please, NOTE!

If you order a wrong size, you can exchange the right size free of charge(only the same design), but you need to bear the shipping costs.

*For refund case, please keep the clothing new and clean. I will refund you as soon as I get the item in original condition(without wearing,trace of perfume, washed, spoiled).

Each piece from Gabyga is custom made to order and is not refundable.

THE SHIPPING COSTS ARE NON REFUNDABLE !

If you are not satisfied with my handmade work. You can return or exchange your item(s) , But you need to pay the return’s shipping fee on your own.

*Please have in mind that I cannot be held responsible for returned items lost in transit.
*I recommend that you send the item back to me by Registered Post, retain proof of posting and send me a Tracking Number.

*Return INSTRUCTIONS :

1. Send the package with REGULAR POST ! ( NOT COURIERS ) it's Cheaper for You
2. Don't Insure the parcel ( will cost you more money )
3. Declare the LOWEST VALUE (10$) in the papers you fill in ( like i do when i send it to you ), otherwise will go to the Custom, and i need to pay Import Fee for it ( in this Case i'am sending the package back to You on Your Expenses ! )
