This Privacy Policy describes how and when HjM Store (“I”, “me”, “my” or “HjM Photo”) collects, uses and shares personal information when you place an order through my Etsy shop, contact me or otherwise use my services.

HjM Store is the data controller responsible for the personal information used to fulfil orders placed with HjM Photo. Etsy separately processes personal information under its own Privacy Policy.

Personal information I collect

To fulfil your order, you must provide Etsy and me with certain information. This may include:

Your name
Email address
Postal address
Payment-related information processed through Etsy
Details of the product you have ordered
Messages and communications you send through Etsy or by email
Photographs, wording, names or other personalisation information you provide for a personalised product
Information needed to resolve a query, process a replacement or handle a complaint

I receive this information from Etsy or directly from you. I do not receive or store your complete payment-card details, as Etsy processes payments.

Please only provide photographs or personal information that you have permission to use. If a photograph contains another person, you are responsible for ensuring that you have the necessary permission to provide it for the creation of your order.

Why I use your information

I rely on the following lawful reasons to collect and use your information:

Contract: I use your information when it is necessary to process, create, personalise, deliver and provide support for your order.

Legal obligation: I may keep or use certain information where required for tax, accounting, fraud-prevention or other legal purposes.

Legitimate interests: I may use your information where necessary to operate and improve my shop, protect my business, prevent fraud, maintain records and respond to customer enquiries, provided that these interests do not override your rights.

Consent: Where I rely on your consent, you may withdraw it at any time by contacting me.

Marketing

I do not use customer information for marketing purposes.

I do not sell customer information or share it with third parties for their own advertising or marketing.

Purchasing from HjM Photo does not automatically add you to a marketing mailing list.

Your information is shared only where reasonably necessary to provide my services, fulfil your order or comply with the law. This may include:

Etsy: I share information with Etsy as necessary to provide my services and comply with my obligations under Etsy’s Seller Policy and Terms of Use.

Delivery companies: I provide delivery companies and postal services with the information necessary to deliver your order. This usually includes your name, delivery address and, where required by the delivery service, your email address or telephone number.

Service providers: I may use trusted businesses that help me operate my shop, such as printing, order-processing, IT, file-storage or accounting providers. They may process information only to perform services on my behalf and must handle it appropriately.

Legal and regulatory requirements: I may collect, retain, use or disclose information where I reasonably believe it is necessary to comply with the law, respond to a lawful request, enforce my agreements, prevent fraud or protect the rights and safety of my customers or business.

Business transfers: If HjM Store is sold, merged or reorganised, customer information may be disclosed as part of that transaction where permitted by law.

Data retention

I retain personal information only for as long as necessary to fulfil your order, provide customer service and meet my legal, tax and accounting obligations.

Order and transaction records may normally be retained for up to six years where required for business, tax or legal record-keeping.

Photographs and personalisation files are retained only for as long as reasonably necessary to create the product, complete the approval and fulfilment process, address possible order issues and maintain appropriate business records. They will then be securely deleted or anonymised when they are no longer needed, unless continued retention is required by law.

Messages may be retained for as long as necessary to provide support, maintain records and resolve disputes.

Etsy may retain information according to its own policies and legal obligations.

International data transfers

HjM Store is based in the United Kingdom. Some service providers, including Etsy, may process or store information outside the United Kingdom.

Where personal information is transferred internationally, the relevant organisation is responsible for using an appropriate legal safeguard, such as an adequacy regulation or approved contractual protections.

HjM Photo does not currently sell or deliver products to customers located in the European Union. This restriction does not affect any privacy rights that apply under relevant law.

Data security

I take reasonable administrative and technical precautions to protect personal information from loss, misuse, unauthorised access, disclosure or alteration.

However, no internet transmission or electronic storage system can be guaranteed to be completely secure.

Some rights are subject to legal exceptions. For example, I may need to retain transaction information to meet tax, accounting or legal requirements.
