This Privacy Policy is intended to describe how your information is collected, processed, handled and protected. This privacy policy solely covers the responsibilities of Art of Elm, and does not cover third party services such as Etsy or any other service accessed via Etsy.

1. Your Personal Information & Data

Art of Elm does not share your information with third parties. Any information entered through the Etsy platform is done so in order to complete and verify orders. Records are kept via the Etsy platform, and through my own personal records for tax keeping and invoicing purposes. This information may include your Name, Email Address, Postal address and the details of your purchase and any additional information that you have chosen to provide.

2. How Your Personal Information Is Used and Why

In order to complete my service, information from the customer is kept to fulfill postal duties and settle any present or future disputes with the client. Due to this, we believe we keep your on the basis of legitimate interests. This may include using your provided information to confirm the whereabouts of lost packages, customer support or recovering information about a previous sale and most importantly, fulfilling your order.

Your information may be used further when you have provided affirmativ consent. Such as an invitation to a mailing list, or confirmation of reviews for promotional material. Your information is held via the Etsy platform.

Your information is collected and retained only when in good faith, and when believed reasonably necessary to (a) fulfil legal duties and government requests; (b) enforce terms and policies, (c) confirm address and resolve any issues between Art of Elm and customer.

Your information is used as necessary in order to comply with my obligations under the Etsy Seller Policy and Terms of Use.

3. Third Parties

In order to use the Etsy platform, your information is shared with Etsy to fulfill my business obligation to you. This includes fulfilling shipping with third party delivery and postal services.

Your information may be disclosed in the following circumstances:

(a) With Etsy. The information shared with Etsy is essential to fulfilling my services and obligations via the platform, under the Etsy Seller Policy and Etsy Terms of Use.

(b) Service Providers. Your information is used with trusted third party services to complete elements of your transaction as necessary. This includes Royal Mail, and business managment cloud based services such as Google Cloud.

(c) In compliance with the law. I may collect, use, retain, and share your information if I have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce my agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of my customers, or others.


4. Data Retention

Your information may be kept in my personal records for as long as necessary, and no shorter than the length of time required by the government to fulfill legal obligations. This may include pulling records for tax purposes and proof of business transactions.

5. Transferring Data outside of the EU

Your personal information may be transferred to third party services outside of the EU. This may be in the form of cloud services, such as Google Cloud or Airtable, where records may temporarily be stored as a back up to fulfil orders.

5. Your rights
Art of Elm recognises your right to be informed about the nature of your how data is used, and any changes to our privacy policies. You reserve the right to request a copy of the information in full detail, and how it has been used.

You reserve the right to restrict and change the use of your personal information. Excluding situations where I would be legally required to.

You reserve the right to request your data be excluded from my personal records and third party services where it is not essential.

You reserve the right to object and reserve the right to not be subject to automated decision-making, including profiling.

If you wish to raise any concerns on how your information is used, you have the right to do so with your local data protection authority and Information Commissioner's Office if you feel that there is a problem with how your data is being handled.
