General terms and conditions of the Etsy shop "frau zwerg"
§ 1 - Provider, inclusion of the General Terms and Conditions
(1) Vendor and contractual partner for the goods presented in the Etsy shop "frau zwerg" is: Kathrin Klipfel, Zeppelinstr. 44, 76185 Karlsruhe (hereinafter referred to as “provider”).
(2) These general terms and conditions are part of every contractual agreement between the provider and the respective customer. Conflicting terms and conditions of the customer are contradicted.
§ 2 – Offer of goods and conclusion of contract
(1) The seller offers the items shown in his Etsy shop "frau zwerg" to other Etsy users for sale. The color of the items on the website may vary slightly depending on the internet browser used and the customer's monitor settings; these deviations are technically never completely avoidable.
(2) The selection of goods, the conclusion of the contract and the execution of the contract take place in German.
(3) The customer selects the desired goods by placing them in the “shopping cart” or by clicking on the “Proceed to checkout” button. The order request can then be sent to the provider via the "Order with obligation to pay" button. Until the order has been sent, the customer has the option at any time to view and change the data specified in the order or to cancel the order completely.
(4) The Provider submits a binding purchase offer for the goods presented in the Provider's shop. By sending the order request via the "Order with obligation to pay" button, the customer accepts the purchase offer. The provider confirms the conclusion of the contract by e-mail (contract confirmation).
(5) The content of concluded contracts is stored in the customer's Etsy user account and can be viewed by the customer in the Etsy portal at any time.
(6) In the event of delivery obstacles or other circumstances that would prevent the fulfillment of the contract, the provider will inform the customer by e-mail. A partial delivery will only be made after approval by the customer.
§ 3 - Prices and payment
(1) All product prices are final prices plus shipping costs. The fees include 19% sales tax.
(2) The shipping costs are listed in the respective product description under the menu item "Payment & Shipping".
(3) The provider delivers at the option of the customer against advance payment by bank transfer.
a) If the customer has selected "bank transfer" as the payment method, the customer will be informed of the provider's bank details in the "My purchases" area. The provider only accepts transfers from abroad as free payments in euros.
(4) A payment period of one week from receipt of the contract confirmation applies to prepayment orders. The provider puts the desired goods back for the customer for the duration of the payment period. It is the customer's responsibility to make his payment in good time so that the provider receives it within the deadline. The provider reserves the right to withdraw from the purchase contract and sell the goods elsewhere if payment has not been received by the deadline. Any payment received from the customer after withdrawal will be refunded to the customer.
§ 4 – Dispatch, delivery times
(1) The provider hands over the goods to be delivered to the shipping company within two working days after receipt of full payment.
(2) If the delivery to the customer fails because the customer has given the delivery address incorrectly or incompletely, a new delivery attempt will only be made if the customer assumes the costs for the new shipment. The renewed shipping costs correspond to the shipping costs agreed upon conclusion of the contract. The provider will inform the customer of the necessary costs for a new delivery by e-mail. A new dispatch takes place only after receipt of payment of these costs.
§ 5 – Returning goods as a consumer
(1) Orderers who shop as consumers (§ 13 BGB) have a right of withdrawal in accordance with the legal requirements (§§ 312d, 355 BGB). Details to this can be seen in the cancellation policy.
(2) If the customer is a consumer, the contracting parties agree, in the event that the right of withdrawal is exercised, that the customer shall bear the regular costs of returning the goods if the delivered goods correspond to those ordered and if the price of the goods to be returned does not exceed an amount of 40 euros or if, in the case of a higher price for the item, the customer has not yet provided the consideration or a contractually agreed partial payment at the time of the revocation.
(3) If the customer has to bear the return costs, the amount of money to be reimbursed by the provider and the return costs to be reimbursed by the customer can be offset against each other.
§ 6 – Warranty
The customer's warranty rights are based on the statutory provisions.
§ 7 - Final Provisions
(1) The provider collects and processes the data entered by the customer as part of his purchase for the purpose of processing and fulfilling the contract.
(2) Should individual provisions of these general terms and conditions prove to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.

A. Terms and Conditions with Customer Information

1) Scope
1.1 These general terms and conditions (hereinafter "GTC") of Kathrin Klipfel (hereinafter "seller") apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter "customer") concludes with the seller with regard to the seller on the Internet trading platform Etsy (hereinafter "Etsy"). The inclusion of the customer's own conditions is hereby contradicted, unless something else has been agreed.
1.2 A consumer within the meaning of these General Terms and Conditions is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. Entrepreneur within the meaning of these terms and conditions is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

2) Conclusion of contract
2.1 By listing an item on Etsy, the seller makes a binding offer to sell this item.
2.2 The customer can accept the seller's offer via the online order form provided by Etsy. To do this, the customer must first place the desired item in the virtual shopping cart on Etsy and then go through the ordering steps specified by Etsy. By clicking on the button that concludes the ordering process, the customer declares acceptance of the offer, which results in a purchase contract for the goods previously selected by the customer.
2.3 The text of the contract is saved by the seller and sent to the customer in text form (e.g. e-mail, fax or letter) after the contract has been concluded together with these General Terms and Conditions and customer information. The seller himself does not make the contract text accessible beyond this.
2.4 Before submitting a binding order, the customer can identify possible input errors by carefully reading the information displayed on the screen. An effective technical means for better recognition of input errors can be the enlargement function of the browser, with the help of which the display on the screen is enlarged. The customer can correct his entries before the binding submission of the order as part of the electronic ordering process using the usual keyboard and mouse functions.
2.5 Only the German language is available for the conclusion of the contract.

3) Right of Withdrawal
3.1 Consumers are generally entitled to a right of withdrawal.
3.2 Further information on the right of cancellation can be found in the seller's cancellation policy.
3.3 The right of withdrawal does not apply to consumers who do not belong to a member state of the European Union at the time the contract is concluded and whose sole place of residence and delivery address are outside the European Union at the time the contract is concluded.

4) Prices and terms of payment
4.1 The prices given by the seller are total prices and include the statutory sales tax. Any additional delivery and shipping costs are specified separately in the respective product description.
4.2 For deliveries to countries outside the European Union, additional costs may arise in individual cases for which the seller is not responsible and which are to be borne by the customer. These include, for example, costs for money transfers by banks (e.g. transfer fees, exchange rate fees) or import duties or taxes (e.g. customs duties). Such costs can also be incurred in relation to the transfer of money if the delivery is not made to a country outside the European Union, but the customer makes the payment from a country outside the European Union.
4.3 The payment option(s) will be communicated to the customer in the seller's offer on Etsy.

5) Delivery and shipping conditions
5.1 Goods are delivered to the delivery address specified by the customer, unless otherwise agreed. When processing the transaction, the delivery address specified in the order processing on Etsy is decisive.
5.2 If the transport company sends the shipped goods back to the seller because delivery to the customer was not possible, the customer bears the costs for the unsuccessful shipment. This does not apply if the customer is not responsible for the circumstance that led to the impossibility of delivery or if he was temporarily prevented from accepting the service offered, unless the seller announced the service to him a reasonable time in advance had. Furthermore, this does not apply with regard to the costs for the delivery if the customer effectively exercises his right of withdrawal. If the customer effectively exercises the right of cancellation, the regulation made in the seller's cancellation policy applies to the return costs.

6) Retention of title
If the seller pays in advance, he retains ownership of the delivered goods until the purchase price owed has been paid in full.

7) Liability for defects
7.1 If the purchased item is defective, the statutory liability for defects applies.
7.2 The customer is asked to complain about delivered goods with obvious transport damage to the delivery agent and to inform the seller of this. If the customer does not comply, this has no effect whatsoever on his statutory or contractual claims for defects.

8) Governing Law
8.1 The law of the Federal Republic of Germany applies to all legal relationships between the parties, excluding the laws on the international purchase of movable goods. For consumers, this choice of law only applies insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has his habitual residence.
8.2 Furthermore, this choice of law with regard to the statutory right of withdrawal does not apply to consumers who do not belong to any member state of the European Union at the time the contract is concluded and whose sole place of residence and delivery address are outside the European Union at the time the contract is concluded.

9) Alternative Dispute Resolution
9.1 The EU Commission provides a platform for online dispute resolution on the Internet under the following link: ec.europa.eu/consumers/odr
This platform serves as a contact point for the out-of-court settlement of disputes arising from online purchase or service contracts in which a consumer is involved.
9.2 The seller is neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.

C. Cancellation policy

You have the right to withdraw from this contract within fourteen days without giving any reason.
The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the last goods.
In order to exercise your right of withdrawal, you must send us (Kathrin Klipfel, Zeppelinstr. 44, 76185 Karlsruhe, Germany, Tel.: 0721-844345, e-mail: frau.zwerg [!at] web.de) a clear statement (e.g. a letter sent by post or e-mail) about your decision to withdraw from this contract. You can use the attached sample revocation form for this, but this is not mandatory.
To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation
If you revoke this contract, we have paid you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us have), immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment.
In the case of contracts for the supply of goods, we may refuse repayment until we have received the goods back or until you have provided proof that you have sent back the goods, whichever is the earlier.
You must return or hand over the goods to us immediately and in any case no later than twenty-one days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send back the goods before the period of twenty-one days has expired.
You bear the direct costs of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion or premature expiry of the right of withdrawal
The right of withdrawal does not apply to consumers who do not belong to a member state of the European Union at the time the contract is concluded and whose sole place of residence and delivery address are outside the European Union at the time the contract is concluded.
