This Privacy Policy describes how and when I collect, use, and share information when you purchase an item from me, contact me, or otherwise use my services through Etsy.com or its related sites and services. Please note www.fringeandbow.com is powered via Pattern by Etsy.

I will adhere to the provisions of the Australian Privacy Principles (APPs) which are contained within the Privacy Act, in relation to how I collect, use, disclose and protect your Personal Information.

Where applicable, I will also adhere to the EU General Data Protection Regulation (GDPR).

This Privacy Policy applies where I am a ‘data controller’ in relation to your personal information. That is, where I am in control of the purposes and methods of processing your personal information.

Definitions

In this policy:
• Cookie means a small piece of data stored on your device used to access websites.
• EU means European Union.
• Personal Information has the meaning given under the Privacy Act.
• Privacy Act means the Privacy Act 1988 (Cth).
• US means United States of America.


Information I Collect

To fulfil your order, you must provide me with certain information (which you authorised Etsy to provide to me), such as your name, email address, postal address, payment information, and the details of the product that you are ordering. You may also choose to provide me with additional personal information, if you contact me directly.

I may also collect Personal Information from you when you log onto or connect to www.fringeandbow.com and my server automatically records the information your browser sends (e.g. your IP address, how and when you travel through the website, the pages and documents accessed, information about your usage, e.g. by way of cookies and other information provided by downloading information from my website). However, unless your name is part of your email address or you specifically provide it, my server does not automatically collect this information. You can also adjust the settings on your computer to decline any cookies if you wish.

If I do not collect your personal information or if any of the personal information you provide is incomplete or inaccurate, I may not be able to complete your purchase and/or deliver your order.


Why I Need Your Information and How I Use It

I rely on a number of legal bases to collect, use, and share your information, including:
• as needed to provide my services, such as when I use your information to fulfil your order, to settle disputes, or to provide customer support;
• when you have provided your affirmative consent, which you may revoke at any time, such as by signing up for my mailing list;
• if necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchases if required by tax law; and
• as necessary for the purpose of my legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as 1) providing and improving my services. I use your information to provide the services you requested and in my legitimate interest to improve my services; and 2) Compliance with the Etsy Seller Policy and Terms of Use. I use your information as necessary to comply with my obligations under the Etsy Seller Policy and Terms of Use.


Information Sharing and Disclosure

Information about my customers is important to my business. I share your personal information for very limited reasons and in limited circumstances, as follows:
• Etsy. I share information with Etsy as necessary to provide you my services and comply with my obligations under both the Etsy Seller Policy and Etsy Terms of Use.
• Service providers. I engage certain trusted third parties to perform functions and provide services to my shop, such as delivery companies. I will share your personal information with these third parties, but only to the extent necessary to perform these services.
• Business transfers. If I sell or merge my business, I may disclose your information as part of that transaction, only to the extent permitted by law.
• Compliance with laws. I may collect, use, retain, and share your information if I have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce my agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of my customers, or others.


Data Retention

I retain your personal information only for as long as necessary to provide you with my services and as described in my Privacy Policy. However, I may also be required to retain this information to comply with my legal and regulatory obligations, to resolve disputes, for the purposes of backing-up my computer systems and data, and to enforce my agreements. I generally keep your data for a period of time sufficient for me to comply with my legal and accounting obligations.

You may choose to require me to delete your Personal Information in certain circumstances, including, but not limited to where the Personal Information is no longer necessary for the purpose for which it was collected, or where you withdraw your consent for me to retain your Personal Information and there is no other legal ground for processing your Personal Information.


Transfers of Personal Information Outside the EU

I may store and process your information through third-party hosting services in the US and other jurisdictions. As a result, I may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your jurisdiction.

To the extent that I am deemed to transfer Personal Information outside of the EU, I rely on the transfer being necessary for the performance of the contract between you and I. As I deliver goods and services to customers located in various countries worldwide, and use technical infrastructure in various countries worldwide including Australia and the US (among others) to deliver my services and goods to you, I need to transfer your Personal Information to other jurisdictions as necessary for me to provide those goods and services. In other words, I may not be able to provide services or goods to you without transferring your Personal Information outside of the EU.


Your Rights

If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. I describe these rights below:
• Access. You may have the right to access and receive a copy of the personal information I hold about you by contacting me using the contact information below. For security purposes, before I provide you with personal information, I will ask that you provide evidence of your identity.
• Correct, Change, restrict, delete. You may also have rights to correct, change, restrict my use of, or delete your personal information. Absent exceptional circumstances (like where I am required to store data for legal reasons) I will generally delete your personal information upon request.
• Object. You can object to (i) my processing of some of your information based on my legitimate interests and (ii) receiving marketing messages from me after providing your express consent to receive them. In such cases, I will delete your personal information unless I have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.
• Complain. If you reside in the EU and wish to raise a concern about my use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.


Considerations When You Send Your Information to Me

While I do all that I reasonably can to protect your Personal Information from misuse, loss, unauthorised access, modification or disclosure, including investing in security software, no data transfer over the Internet is 100% secure.

The open nature of the Internet is such that information exchanged via the Internet may be accessed and used by people other than those for whom the data is intended. If you send me any information, including (without limitation) Personal Information, it is sent at your own risk.

If you provide Personal Information to me electronically, there are steps you can take to help maintain the information’s privacy. These include:
• always closing your browser when you have finished your session;
• NEVER providing Personal Information by using a public computer; and
• NEVER disclosing your user name and password to another person.
You are responsible for all actions taken using your username, email or password. If at any time you believe your username or password has been compromised, you should immediately contact me and also change your password.

You should also contact me immediately if you believe:
• someone has gained access to your Personal Information;
• I have breached my privacy obligations or your privacy rights in any way; or
• you would like to discuss any issues about my Privacy Policy.
