Kelly Jane Creative

One snowy Saturday morning a few years back, I sat down at my computer and thought I'd open up an Etsy shop. Why not? I wanted to see what would happen. So I researched and designed and skipped meals... and that night I had my shop up, 13 listings, and one sale under my belt. I can't even describe the moment when I realized that someone had bought something I made only 3 minutes after I had listed it. I screamed! About a month later, I was laid off. Instead of going job hunting, I poured all my energy into my Etsy shop and haven't looked back. To say that Etsy has changed our lives is an understatement.

The shop has gone through some changes over the years. The initial focus of my shop was on branding, logo design, and Etsy graphics. I still do those designs but that has moved to another shop and here, I focus on clip art.

My inspiration comes from my surroundings. In the pictures above, you'll see our farm. It's old, abandoned, neglected... and the most peaceful place on the planet. We'll be moving there this summer and what a challenge that will be! I suppose I should back up a bit and tell you who we are.

I'm Kelly, but you're a smart cookie so you probably guessed that. I live in the middle of Minnesota with my guy Marty and our girl Ayden and of course, the dog, Astro. Marty has a construction business, Ayden is 16 and busy being a teenager, and Astro is spoiled rotten. As for me, I love what I do so much that I can't call it work. Life is good when you look forward to Monday mornings.

Right now we live in a house that Marty built about 10 years ago, so moving into a smelly old spidery house with cheap paneling and avocado green carpet will be quite the change, but very worth it. Underneath all that nasty paneling are the original white oak logs from 1892... along with a few bats, I'm sure. But hey, this is Minnesota and bats eat mosquitoes so it's all good! All of the buildings need repair but the 10 acres is surrounded by trees, there's a pond, and lots of wild flowers. It's a cozy bit of wilderness that hasn't been tamed. I think I love it so much because it reminds me of the places Calvin and Hobbes would play, minus the cliffs.

All Items available from Kelly J Sorenson are protected by United States and international copyright laws and treaties. I retain ownership of the Items, but grant you a non-exclusive, non-transferable right to use as expressly permitted by the license herein and subject to the terms set forth herein:

Standard License

1.You may use a purchased Item in a new End Product as long as the End Product meets the following requirements.
End Products must be significantly different than the original Item and require time, effort, and skill to produce. End Products must not be used or sold in a way that is directly competitive with the original Item you purchased. End Products must not redistribute the original Item to any third parties in a manner that allows for the extraction of the original Item.

2. A purchased Item may be used in one Project. As an exception, Installable Items may be used in an unlimited number of Projects on a one seat per license basis. A Project is defined as a complete and cohesive undertaking that may result in one or more End Products. Any End Products included in the one Project must be directly related under a single concept. However, all purchased Items may be used in an unlimited number of Personal Use Projects.

3. Under the Standard License, you may use purchased Items to create End Products for Sale where lifetime sales of the End Product for Sale do not exceed 500 units. If a Standard Licensed Item is purchased and used to create an End Product for Sale of which the sales exceed 500 units, either another Standard License or an Extended License must be purchased. For End Products that are not offered for sale, you may distribute as many copies of the End Product as you like.
An End Product For Sale can be either a digital design or physical item that you and/or your client intend to sell to more than a single person (wholesale, drop-shipping, etc.). For purposes of this license, “intend to sell” means you plan to sell, license, sub-license, or distribute the End Product for any type of fee or charge.

4.You may not modify or manipulate the Item, or incorporate it into other content and make a derivative work from.

5. You may not sublicense, resell, share, transfer, or otherwise redistribute the Item (e.g. as stock, in a tool or template, with source files, and/or not incorporated into an End Product) under any circumstances, not even for free.

6. You may not make the Item available on a digital asset management system, shared drive, or the like for the purposes of sharing or transferring the Item, and you must not permit an end user of the end product to extract the Item and use it separately from the End Product.

7. You may not falsely represent, expressly or by way of reasonable implication, that any Item was created by you or a person other than the copyright holder(s) of that Item.

8. You may not use any Item if that use could result in a third party’s claim that it acquired rights in the Item that are contrary to this license.

9. You may not register as a trademark the Item or the end product incorporating the Item – not even logos.

Extended License

If you purchase an Extended License, the following terms apply:

The Extended License allows you to use Items in any manner permitted under the Standard License, and pursuant to the obligations and restrictions therein; and
You may also use Items purchased under the Extended License to create End Products for Sale, in which the End Product for Sale may be sold an unlimited number of times.

Clip Art: Do I need the Standard License or Extended License?

The Extended License allows you to create an End Product for sale and sell it an unlimited number of times. With the Standard License, you can sell an End Product up to 500 times.

Clip Art: How many times can I use the graphics I purchase?

A set of graphics may be used in one Project. A Project is defined as a complete and cohesive undertaking that may result in one or more End Products. Any End Products included in the one Project must be directly related under a single concept. However, all purchased Items may be used in an unlimited number of Personal Use Projects.

Example: You are not allowed to purchase a graphic to include in an End Product flyer design that you create for a real estate company, and then use that same graphic when designing the End Product of a website for a bakery, because these are unrelated End Products and therefore do not fall under the same Project.

Clip Art: Can I use your graphics to create logo designs for sale?

You can, but you, and the person you create the logo for, must be aware that the design can not be trademarked.

Clip Art: Can I use your graphics to create my own logo and branding?

Yes, but please understand that you won't be able to trademark you logo.

Clip Art: Do I have to give you credit as the designer?

No you don't, but you also can't claim my graphics as your own.

Clip Art: I only need one piece of clip art from a set. Can I just buy that one?

Sorry, I don't split up the sets. The time to locate the file on my computer, create a new listing, and upload it would make that one piece more expensive than buying the set.
