Clarification Please - You may not list the same unique item in more than one shop on Etsy

In the Etsy DOs and DONTs under "multiple accounts held by one person" it states: You may not list the same unique item in more than one shop on Etsy

I've been reporting a shop for months that sells the exact same items out of 2 different shops and I'm constantly competing with this shop for space on the 1st page of search results. (They get two spaces- 1 for each shop and I get 1 space.)

I've been reporting and reporting and reporting. And nothing, nada, zip. I emailed Etsy support this morning but realize I'm probably holding my breath for a response, so I sat there staring at this line: You may not list the same UNIQUE item in more than one shop on Etsy. Unique.

So, does unique mean I can make 2 pair of the earrings that are in my avatar and then sell them from two different shops? Even if they're the same, they're still unique, right? Or not? I'm trying really hard to understand and hoping a few opinions might help.

Unique in this case refers to "one and only." If you have several identical items you can sell them in ten different shops if you choose to.
if they have more than one of the items they can sell it in two shops.
what is against the rules is to list the same one item in both.

if they have two bracelets of the same design they can list them in two different shops.

Ha! See, this is what I feel like is summing up etsy.

I have even seen made to order listings with identical pictures and wording in the listings posted in two shops. Same person owns both shops. I guess made to order is different.
I would think they refer to unique as the one of a kind items. You couldn't list an item as one of a kind and also list it in another shop as one of a kind.

I assumed this was for purely practical reasons, and would not be a wise thing to do.

Vintage seller has a 1920's teapot. Lists it in two shops - what if both listings sold? Obviously he can't honour both listings, so should never have had two of them in the first place.

Crochet hat seller makes a blue hat with a flower on it. Lists it in two shops - what if both listings sold? Seller makes another hat from the same yarn, to the same pattern, and sends both out - no issues at all here.

If an item is made to order then presumably the seller can make it twice if needed - if they only have supplies to make one then they should only have one listing max. You should never be offereing something you can't deliver.

That is how I understood it.
