I've always had the urge to create – I think it’s part of human nature. There’s the thrill of beginning a brand new creation, the excitement as you near the end of a project, and then the on-going satisfaction of seeing, wearing or using what you have made.

Little Conkers began, as many small businesses do, with me making things for my own family, then friends, and then opening an Etsy shop. I soon realised that what I enjoy most is not just creating items myself, but helping others to create, so I started publishing patterns and creating kits.

I get an enormous thrill from seeing the pictures of items my clever customers around the world have made from my patterns and kits, and seeing the items I have made happily installed in their new homes.

As a family we try to live as lightly as possible on the planet, and Little Conkers follows our ethos – if I can’t do it sustainably, I won’t do it! Everything at Little Conkers is as eco-friendly as I can make it, from the 100% renewable electricity that fuels my late-night creativity, to the eclectic selection of recycled boxes I keep for packaging your purchases.

Little Conkers is still evolving, but I'm loving this journey that takes me to new friends and customers all around the world every day.

Welcome to Little Conkers where I strive to give you the maximum possible reward for your money, time and creative effort. This includes being as fair and clear as possible with every customer in respect of shipping, returns and so on.

For your protection, your interactions with Little Conkers are governed by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Sale of Goods Act, the Data Protection Act 1998 and the EU General Data Protection Regulation and the applicable UK and EU Laws.

When you (as a buyer) enter into a contract with Little Conkers, you are assumed to have read and accepted the terms and conditions below, and to have agreed not to require them on paper.

RETURNS & REFUNDS ++++++++++++++++++++++++++++++++++++++++

If you wish to return items I'm happy to refund the purchase price plus postage and packing costs, provided the items are returned in perfect (resellable) condition. Here's how it works:

If you wish to return something, you must get in touch with me within 14 days of receiving it. You can do this using the Returns & Refunds Form on my website here: www.littleconkers.co.uk/Little_Conkers/contact-little-conkers or just contact me with the relevant information.

I will process your refund (of the purchase price plus my standard postage and packaging cost) within 14 days of receiving the returned items, provided they are returned in resellable condition.

If you paid for an upgraded delivery service, this will not be refunded in full - I will only refund the amount of my standard postage and packaging service.

A deduction will be made from the refund if the value of the item(s) has been reduced as the result of excessive handling, carelessness or any other reason.

In returning items, you will need to pay for the return postage yourself. I strongly advise that you obtain a certificate of posting (at a minimum) from your Post Office or courier, as if the item is lost in transit you will need to be able to claim for compensation.

If you are returning items to me from outside the United Kingdom, you must mark the package prominently as "Returned Goods". If you don't do this, I will unfortunately have to deduct any customs fees/tax/brokerage charges from the amount I can refund you.

Digital items and personalized items cannot be returned or refunded.
Payment
Please be assured that when you click to add something to your basket, you will always be shown the full cost including postage and packing costs before you commit to buy, and you can always remove it from your basket if you so wish.

CANCELLING YOUR ORDER – Physical Items ++++++++++++++++++++++++++

You have the right to cancel an order at any time from the moment you place the order until 14 days from the day you receive your goods.

This 14 day period is the time you have to decide you wish to cancel and get in touch with me. Once you have got in touch about cancelling an order, you then have a further 14 days in which to return the goods if they have been dispatched.

The Consumer Contracts Regulations does not give you the right to cancel an order for personalized, customized and tailor-made items, but please contact me anyway if you have any issues at all, and we'll work it out together.

CANCELLING YOUR ORDER – Digital Items ++++++++++++++++++++++++++++

Specific provisions exist in the Consumer Contracts Regulations for digital content.
If you are ordering a digital item, by agreeing to these terms and conditions you are giving your express consent for me to supply you with your digital item within the 14-day cancellation period. (If you did not consent to this, I would have to wait 14 days before providing you with the digital item, to allow you your right to cancel).

You are further acknowledging that once I have e-mailed you a digital item, or you have started to download a file, you loose your right to cancel the order.

If you do not consent to this, please do not place an order.
Delivery
DELIVERY - Digital Files +++++++++++++++++++++++++++++++++++
There is no shipping or handling fee for digital files, the price on the listing page is all you will pay.

Most of my digital items are available for immediate download from Etsy. In some cases (dictated by the size or number of files) this is not possible, and I will e-mail the file(s) to the e-mail address on your Etsy account (not your PayPal account) as soon as possible. Please allow for time differences when waiting for your files!

DELIVERY - Physical Items +++++++++++++++++++++++++++++++++
The time to dispatch is shown on every listing before you place an order. If for any reason I am not able to meet this schedule after you have ordered I will inform you, and you will have the right to cancel your order as set out below.

I often use recycled paper, envelopes, etc, to post my items. This is not only of benefit to the environment, but it helps me keep my post & packing costs as low as possible for my customers.

Little Conkers is compliant with the German Packaging Register requirements.

Items will be posted to the address specified by you at checkout. Please make sure it is correct.

If you're ordering something for a gift and would like it posted to a different address than your own, that's fine too, this option is available in the checkout.

Items shipping to UK addresses will by default be sent by standard Second Class post, which the Royal Mail aims to deliver in 2-3 working days including Saturdays, but this is not guaranteed. If you would like to upgrade to the First Class "Signed For" service, which the Royal Mail aims to deliver the next working day, then just let me know when you order. Note that this service is also not guaranteed. The Royal Mail does not consider items as delayed until 3 working days after the due delivery date.

Items shipping outside the UK will be sent by the Royal Mail’s International Tracked service. For countries in Europe (including the EU) the delivery aim with this service is of 3 to 5 days after posting, for all other countries the delivery aim is 6 to 7 working days. This is an aim and not a guaranteed service. Under normal circumstances, an item is not considered 'lost' until 20 days after the due delivery date for item to Europe and 25 days after the due delivery date for the rest of the world.
In addition to the standard delivery information above, at certain times deliveries may be affected by other exceptional circumstances in the UK or your own country (Christmas post volumes, flooding, strikes, quarantines, etc). Within the UK, please refer to the Royal Mail’s latest information for your location here: https://personal.help.royalmail.com/app/answers/detail/a_id/12556. If you are outside the UK please see here: https://personal.help.royalmail.com/app/answers/detail/a_id/5317 and refer to your national carrier’s service updates.

Once in the postal system, delivery is not in my control, but your item should remain safe and secure even if delayed beyond normal expectations.

If something does not reach you within the time frame given above for a particular postal service, and taking into account any exceptional circumstances, please do get in touch with me, and we will work out together how best to proceed (replacement, refund, etc). I always obtain a certificate of posting, as if unfortunately something did get lost in the post this would allow me to claim compensation from the Royal Mail.

In the UK, the Royal Mail will sometimes leave parcels with your neighbours unless you have specifically opted out of this, or in a safe place that you have agreed with them. Similar arrangements may take place with postal services in countries outside the UK. This is something you need to arrange with your postal service and is not within my control.

When you buy from me, you are responsible for any customs fees/taxes you are charged, so please be aware of your country’s import regulations. I'm afraid I cannot be held responsible for items damaged by customs officials (although this hasn't happened yet!).

PATTERN USE AND SELLING ITEMS MADE FROM MY PATTERNS ++++++
By buying from Little Conkers you are deemed to have read and agreed to these terms and conditions, including the fact you may only use my patterns for your individual, personal use unless we have agreed otherwise in advance.

You may not copy, reproduce, sell or distribute all or any part of any of my patterns by any means, on or offline.

You may not sell items made from my patterns without prior written agreement from me granting you a Commercial Use Licence. If you are considering this, please get in touch preferably before you purchase and ask for a copy of the Licence so you can review its suitability to your intended use and we can discuss your needs and arrangements. You may find my Commercial Use Licence does not suit your needs, so please do not purchase any of my patterns with the intention of reselling without checking. Until I issue you with a Commercial Use Licence you remain bound by these terms and conditions, including the fact that my patterns are for your individual, personal use only.

WHAT TYPE OF INFORMATION LITTLE CONKERS HAS ++++++++++++++++++++++++++++++++
I currently collect and process personal information including personal identifiers (such as names); contact information (such as physical addresses, phone numbers and e-mail addresses) and online identifiers (such as IP addresses and usernames).
I never receive payment or banking details; nor do I receive special category or sensitive data such as religious, medical or criminal offence information.
I do not knowingly hold personal information about children. My products and services are not intended for individuals under the age of 16. If I become aware that an individual under 16 has provided me with personal information, I will take steps to delete it. Please contact me if you believe that I have unintentionally collected information from an individual under 16.

WHY I COLLECT AND PROCESS YOUR INFORMATION ++++++++++++++++++++++++++++++++
The legal bases on which I receive and use your personal information are:
a) I need the information in order to fulfil my contractual obligations to you, including fulfilling and shipping orders, providing a quotation prior to an order if requested, providing support on a purchased product if requested and, if necessary, processing returns and refunds;
b) I need the information to comply with a legal obligation, including UK tax law in relation to providing evidence of my business income, and my obligations under Etsy’s selling regulations;
and
c) I need the information for the legitimate commercial interests of my business. This includes communicating with potential customers; marketing and offering relevant goods and services to potential customers and helping me to understand how users browse and interact with my Etsy shop. These legitimate interests will only ever be what I believe to be reasonable and proportionate having carried out a Legitimate Interests Assessment, a record of which is available on request.

Most of the information is directly created by your interactions with me or the Etsy online selling platform. For example, data are created when you correspond with me via e-mail or social media; when you place an order or when you write a review.
Other data and metadata are indirectly created by processes on the social media or online selling platforms as you visit them, including by cookies and analytics.

HOW I SHARE AND STORE YOUR INFORMATION +++++++++++++++++++++++++++++++++++
I share your personal information with Etsy and other third parties including social media (Facebook, Twitter, etc) and payment services providers (PayPal, etc). By ‘sharing’ I mean that my interactions with these sites may include data created by you or about you. In most cases the data is initially created on Etsy and shared with me. Each of these platforms or services has a privacy policy detailing how they collect, process, store and share your data, to which you will have consented as a user of their platform or services.
I share data with these third parties only to the extent required for the purposes and on the legal bases given above.
Your data may also be stored on the servers of my e-mail provider (1and1 IONOS Ltd, based within the EEA), my ‘cloud’ storage provider (Microsoft 365, based within the UK) and on my business computer, which is password protected and kept updated with the latest operating system and app updates.
In order to fulfil orders, I share your information with postal services or shipping providers (the Royal Mail for example) to the extent necessary to successfully deliver your purchase(s).
Fulfilling customer orders may also require your personal information to be held in hard copy, in particular postal addresses on shipping manifests and proofs of posting from my shipping providers. These are kept in a lockable filing cabinet.
I might be required to share your personal information with the police or regulatory authorities in relation to legal processes.
I retain all these data for the minimum length of time required to satisfy the purpose(s) for which they were collected or in fulfilment of my legal obligations. This includes my obligations to the UK tax authorities (who require records be kept for 5 years after the 31 January submission deadline of the relevant tax year).
Once the need to retain a piece of information has ended, I delete digital data and shred and recycle hard copy documents.

CHANGES TO HOW I COLLECT AND PROCESS YOUR INFORMATION +++++++++++++++++++++
I will update this policy as often as necessary, whenever any of the above information changes. You are advised to check periodically to ensure you remain happy with how I am using your personal information.
I will not start using your personal information for substantively different purposes without making you aware of the change. For example, I would not start using your contact details to send you newsletters without seeking your prior consent.
