This Privacy Policy describes how and when we collect, use, and share information when you purchase an item from us, contact us, or otherwise use my services through Etsy.com or its related sites and services.

This Privacy Policy does not apply to the practices of third parties that I do not own or control, including Etsy or any third party services you access through Etsy. You can reference the Etsy Privacy Policy to learn more about its privacy practices.

We do not sell your information.

Information We Collect:

To fulfil your order and provide our services to you, you must provide us with certain information, such as your name, email address, postal address, payment information, as well as certain information (which you are consenting to provide us with by purchasing from us) such as contact phone numbers for any international orders or orders with expedited shipping because the customs forms and shipping labels for the third-party delivery services request these. Keep in mind, these also may be helpful in case any of the delivery services have problems with delivering your order, they may be able to contact the person to whom the phone number or email belongs. The phone number and or email and address provided will be written on but not limited to: the packing slips, customs forms and expedited shipping labels. This doesn't guarantee the third-party delivery service will contact you if there is a problem with delivery, but we think it is an extra step of safety for the package and the forms do ask for them on international and expedited shipping. Other personal information we collect would be provided by you regarding such things as but not limited to: sizes for jewelry, personal preference or feedback about your experience with us or any communications sent to us from you or Etsy. (More examples are as follows but not limited to: phone numbers, any email addresses, email hosts, email and web carriers, business, personal or any addresses you provided to us with handwritten letter and or in any other form of communication including but not limited to emails and text messages and phone calls from yourself or Etsy.; Also, we may use some addresses that have been "auto-corrected" by the post office or carrier (for example but not limited to: Parkway being abbreviated as PKWY or Lane as LN) and Etsy communications and communication methods from them or yourself of any and all types)

Why We Need Your Information and How We Use It

I rely on a number of legal bases to collect, use, and share your information, including but not limited to:

As needed to provide my services, such as but not limited to: when I use your information to fulfil your order, keep track of your order history and or communications with us, to settle disputes, or to provide customer support,
If necessary to comply with a legal obligation or court order or in connection with a legal claim, such as but not limited to: retaining information about your purchases if required by tax law; and as necessary for the purpose of my legitimate interests, such as but not limited to providing and improving my services (such as but not limited to: your sizing and preferences, reviews or comments you send us, purchase history so we can improve or personalize or tweak your order such as but not limited to providing a different type of free gift or packaging). We use your information 1) To provide the services you requested and in my legitimate interest to improve my services; and 2) Compliance with the Etsy Seller Policy and Terms of Use. I also use your information as necessary to comply with my obligations under the Etsy Seller Policy and Terms of Use. and 3) So as to have a personal reference to whom we have sold products as well as when and the address to which it was shipped.

Information about my customers is important to my business. I share your personal information for very limited reasons and in limited circumstances, as follows:

Etsy. I share information with Etsy as necessary to provide you my services and comply with my obligations under both the Etsy Seller Policy and Etsy Terms of Use.
Service providers. I engage certain trusted third parties to perform functions and provide services to my shop, such as delivery companies. I will share your personal information with these third parties, but only to the extent necessary to perform these services.
Business transfers. If we sell or merge our business, we may disclose your information as part of that transaction, only to the extent permitted by law.
Compliance with laws. We may collect, use, retain, and share your information if we have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce my agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of my customers, or others.

Data Retention

We retain your personal information only for as long as necessary to provide you with our services and as described in our Privacy Policy with the following exceptions:

We may also be required to retain this information to comply with our legal and regulatory obligations, to resolve disputes, and to enforce our agreements.
We generally keep your data for 7 years with the exception of photos or notes of your order possibly containing but not limited to the following information: your first and last name and or recipient's first name and last name the address to which it was shipped, the sates the order was placed, fulfilled, shipped and the email address and or phone number associated and or given. These photos are kept in forms of paper and or the third-party hosts mentioned in this privacy policy although there is the possibility of that information being stored through or by another means. It is kept for the purposes of anything relating to but not limited to: improving our services and products (such as but not limited to: if you request to order exact same size bracelet again as you had before) and offering improved services to and recognizing repeat customers as well as being able to replicate previous items you may wish to buy again) and for our personal reference and access to the creations we have made and where we have shipped them and to whom we have shipped them as well as the dates of all transactions involved with the purchase and fulfilment of the order. We will keep this information on file for our personal lifetimes and or the lifetime of our business including if we merge or sell or close it.

Transfers of Personal Information Outside the EU

We may store and process your information through third-party hosting services in the US and other jurisdictions. As a result, we may transfer or store your personal information within or to a jurisdiction with different data protection and government surveillance laws than your jurisdiction. If we are deemed to transfer information about you outside of the EU, we will rely on Privacy Shield as the legal basis for the transfer, as Google Cloud is Privacy Shield certified.
Storage of some of your data that we use may be done through third party hosts such as but not limited to ETSY, GMAIL, GOOGLE PHOTOS, HOOVER DOMAIN HOSTING, WEBMAIL, HP, SAMSUNG and ONETOUCH by SeaGate. All these accounts are password protected. The passwords are changed often and not shared with any public devices or any persons other than myself, Shawna Brown. Also, paper copies of photos of your order with the information possibly in the photo as mentioned in this privacy policy will be kept indefinitely.

Your Rights

If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. As I understand them and to them best of my knowledge, a general description of these rights is below:

Access. You may have the right to access and receive a copy of the personal information I hold about you by contacting me using the contact information below. I will not be held responsible for receiving these communications. You must make sure I respond through non-automated means to ensure I have received them.
Change, restrict, delete. You may also have rights to change, restrict my use of, or delete your personal information. Absent but not limited to exceptional circumstances (like where I am required to store data for legal reasons such as but not limited to tax documentation) I will generally delete your personal information upon request, but I reserve the right to refuse to delete any part of your information for any reason and you are agreeing to this buy purchasing from this shop.
Object. You can object to (1) my storage and or processing of some of your information based on my legitimate interests and (2) receiving marketing messages from me after providing your express consent to receive them. In such cases, I will usually delete your personal information but do not guarantee it and I will not delete it if I have compelling and or legitimate grounds to continue using that information or if it is needed for but not limited to legal reasons.
Complain. If you reside in the EU and wish to raise a concern about my use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.
