TERMS OF USE (Revised May 2016)

YarkoDesign reserves the right to modify the Terms of Use for this shop at any time without prior notice. By purchasing our products after any such modification you agree to follow the Terms of Use as modified.

1. NON-PROFIT/PERSONAL USE

You can use our graphics on any personal or non-profit project without credit as long as NO MONEY is made.

2. COMMERCIAL USE - CREDIT REQUIRED

You can use our graphics for small commercial use. Small Commercial Use is defined as 1000 combined sales of any product our artwork is used in.
However to use our artwork commercially a credit should be given to YarkoDesign including a url that links back to (https://www.etsy.com/shop/YarkoDesign). The link should be placed on the same page as the product that is being sold or displayed.

*This is NOT a mass production license. It allows up to 1000 items sold. For bigger quantities you need a MASS PRODUCTION license, please contact us.

3. COMMERCIAL USE – NO CREDIT REQUIRED

If you want to use our artwork in your product (1000 copies sold or less) without giving a credit to our shop you should purchase our NO CREDIT license (20$ for each individual SET). So one license should be purchases for every set of graphics you wish to use without giving a credit.

4. COMMERCIAL USE – QUANTITIES/MASS PRODUCTION

The COMMERCIAL USE and NO CREDIT licenses are NOT mass production licenses. If you intend to sell more than 1000 products using one or more elements from a single set of our graphics as part of your product design (physical or digital) you need to purchase a MASS PRODUCTION license (one license for each set of graphics).

*** WHAT ARE YOU ALLOWED AND NOT ALLOWED TO DO ***

DIGITAL SCRAPBOOKERS:
You can use all our graphics for your personal projects. You CANNOT sell any of our artwork in a commercial Scrapbook kit of any kind even it is altered.

EMBROIDERY DIGITIZERS:
You can use our products personally or commercially as long as the file you sell is a digital embroidery file. You may not include any of our original files in your download.

DIGITAL PRODUCT DESIGNERS:
You can use our artwork personally or commercially to create digital printable files with the following resrictions:
- Files must be flattened (JPEG or PDF file with no layers). Individual images from YarkoDesign must not be extractable.
- The graphics need to be used as part of your own design and cannot be sold as the are.
- COLLAGE SHEETS are not ALLOWED.
- You cannot sell our artwork layered or on white backgrounds as printables.
- You can only sell digital creations for PERSONAL USE.

PRINTED PRODUCT DESIGNERS:
You can use our cliparts for personal or commercial use. You can print pretty much anything you can think of but it must not exceed 1000 copies sold, for more than 1000 copies sold you must contact us for a MASS PRODUCTION LICENSE. You can also create PRINTED products at Zazzle, Cafe Press, Etsy or in your own store.

LOGO AND WEB DESIGNERS:
You can use our cliparts for personal or commercial use, to create logo and web designs to sell. For logo design use the cliparts as part of the design not as is. You may not sell graphics as a LOGO unless they are considerably altered. For Website/ Blog templates, banners, headers, footers, buttons, store fronts please make sure the files are flattened at 72 dpi and cannot be extracted.

TEACHERS, EDUCATORS:
You can use our products personally or commercially (TPT). If you are selling your products in digital format, you must credit YarkoDesign inside your PDF and wherever you display or sell the file. See the examples of a credit above. The files must be flattened, uneditable and unextractable. You cannot share our original graphics for free. If you do not wish to credit us see COMMERCIAL NO CREDIT REQUIRED licence information above.

OTHER USES:
If you are interested in selling a product that is not mentioned above or if you are not sure if your product fits in any of these categories, please contact us.


*** NOT ALLOWED ***

- Third party sale or wholesale.
- You cannot claim any YarkoDesign graphics as your own under any circumstances.
- You cannot sell, trade, share or give away for free our designs as is or altered including but not limited to clipart packs, digital paper packs, scrapbook kits or as a part of image collections.
- You cannot share our graphic files for free even if it is personal use.
- You cannot create scrapbooking kits, templates, clipart packs, paper packs or any other products using our graphics or combined with the graphics of other producers and sell on a digital download boutique/store who is a direct competitor of YarkoDesign.
-DIGITAL COLLAGE SHEETS, bottle cap images, design sheets for shrinkable paper, scrabble images/sheets and any product that resembles them are NOT ALLOWED for commercial use.
