This Privacy Policy describes how and when I collect, use and share information when you buy an item from my shop CalmMoneyApps, contact me, open the hosted version of my app or the free demo, or otherwise use my services through Etsy.com or its related sites and services. It does not apply to the practices of third parties that I do not own or control, including Etsy. You can read the Etsy Privacy Policy to learn how Etsy handles your information.
About my apps
My apps run on your own device. They have no account and do not send your budget data to me or to anyone else, so I never see what you enter in them.
Information I collect
To fulfil your order, you must provide me with certain information (which you authorised Etsy to provide to me), such as your name, email address, billing address or country, and the details of what you ordered. Providing this information is necessary to enter into and perform our contract; if you do not provide it, I cannot complete your order. If you contact me through Etsy messages or by email, I also receive the information you choose to share; anything else you send me is optional.
Why I need your information and how I use it
I rely on the following legal bases to collect, use and share your information:
- as needed to provide my services, such as fulfilling your order, giving customer support and settling disputes;
- to comply with a legal obligation, such as keeping records of your purchase as required by Dutch tax law;
- my legitimate interests, when these are not overridden by your rights or interests, such as improving my products and complying with the Etsy Seller Policy and Terms of Use;
- your consent, if I ever ask for it; you can withdraw it at any time, without affecting the lawfulness of processing based on consent before its withdrawal. I do not send you marketing messages unless you have given me your express consent.
I do not use automated decision-making, including profiling.
Information sharing and disclosure
I share your personal information only for limited reasons:
- Etsy: as needed to provide my services and to comply with the Etsy Seller Policy and Terms of Use.
- Hosting: the phone version of my app and the free demo are hosted by Vercel Inc. (United States), which receives technical data such as your IP address and browser type when you open them, only to deliver the app.
- Service providers: trusted parties that help me run my business, such as my email provider (Google), my accounting software provider and, if I use one, my accountant, only to the extent needed for that service.
- Authorities: the Dutch Tax Administration (Belastingdienst), if it asks to inspect my records.
- Business transfers: if I sell or merge my business, I may disclose your information as part of that transaction, only to the extent permitted by law.
- Compliance with laws: I may collect, use, retain and share your information if I believe in good faith that this is reasonably necessary to respond to legal process or government requests, to enforce my agreements and policies, to prevent or address fraud, security or technical issues, or to protect the rights, property and safety of my customers or others.
Data retention
I keep your personal information only as long as needed to provide my services. Records of your purchase are kept for 7 years, because Dutch tax law requires this. Other information, such as messages, I keep only as long as needed to help you and to handle any questions or disputes.
Transfers of personal information outside the EU
I am based in the Netherlands. Etsy is a separate controller and processes your information under its own privacy policy (Etsy Ireland UC for users outside the Americas, Etsy, Inc. in the United States for users in the Americas); that policy explains how Etsy transfers data outside the EEA. My email provider, Google, may store information outside the European Economic Area. Where that happens, the transfer relies on the European Commission's adequacy decision for the EU-US Data Privacy Framework (and its UK Extension for UK data), under which Google LLC is certified, or otherwise on the European Commission's Standard Contractual Clauses. Vercel Inc. is certified under the EU-US Data Privacy Framework and its UK Extension, and transfers to Vercel rely on that framework. You can request a copy of the safeguards used for these transfers by emailing info@montari.nl; Google's Standard Contractual Clauses are published at https://cloud.google.com/terms/sccs.
Your rights
Because I am based in the Netherlands, the EU General Data Protection Regulation applies to how I handle your information wherever you live, so you have the following rights:
- Access: you can ask for a copy of the personal information I hold about you.
- Change, restrict, delete: you can ask me to correct, restrict my use of, or delete your personal information. Unless I must keep it for legal reasons, I will generally delete it on request.
- Portability: you can ask to receive the information you provided to me in a structured, commonly used and machine-readable format.
- Complain: you can lodge a complaint with a data protection supervisory authority, in particular in the EU country where you live or work, or with the Dutch Autoriteit Persoonsgegevens (autoriteitpersoonsgegevens.nl). UK residents can also complain to the Information Commissioner's Office (ico.org.uk).
For information that Etsy holds about you, you can also contact Etsy through Etsy.com/help.
Your right to object
You can object at any time to my use of your information based on my legitimate interests, and to receiving marketing messages. If you object, I will stop, unless I have compelling legitimate grounds or need the information for legal reasons.
How to contact me
For the purposes of EU data protection law, I, Dennie van Klaveren, trading as Montari, am the data controller of your personal information. If you have any questions or concerns, you can send me a message on Etsy or email me at info@montari.nl. You can also write to me at:
