Shipping

§ 1 Scope of application; Providers; Inclusion of the GTC
(1) These General Terms and Conditions (hereinafter referred to as "GTC") apply to all contracts concluded between the provider via the MULINU online shop.

(hereinafter the "Provider" or "MULINU") and you as a customer.

(2) Subject to individual agreements made between the customer and the provider, all agreements made between the customer and the provider in connection with the purchase contract result conclusively from these GTC as well as the order confirmation and the declaration of acceptance of the provider.

(3) The version of the GTC valid at the time of conclusion of the contract shall be decisive. The customer has the option of viewing the GTC during the ordering process, printing them out and saving them in a reproducible form.

(4) Any deviating terms and conditions of the customer shall not become part of the contract.

(5) Contract conclusion and execution are carried out in German.


§ 2 Offer of goods and conclusion of contract
(1) The presentation and advertising of articles in the online shop of the provider does not constitute a binding offer to conclude a purchase contract.

(2) The range of goods in the online shop is not aimed at commercial resellers; for these, the provider offers a separate sales program.

(3) The customer selects the desired goods by clicking on the buttons "Add to cart" and "Checkout". By clicking on the button "Order with obligation to pay", the customer completes the order process and makes a binding offer to the provider to conclude a purchase contract (hereinafter referred to as "order"). Data entered by the customer can be changed at any time until the order process has been completed using the "Edit" and "Remove" buttons.

(4) The receipt of the order will be confirmed to the customer immediately (hereinafter referred to as "order confirmation"). The order confirmation as such does not constitute a binding acceptance of the order, unless it also declares acceptance in addition to the confirmation of receipt.

(5) A contract is only concluded when the provider accepts the customer's order by means of a declaration of acceptance (hereinafter referred to as "order confirmation"), by delivery of the ordered articles or by request for payment. The order can only be accepted by MULINU within three working days after receipt of the order.

(6) The text of the contract is stored by MULINU, but for security reasons can no longer be retrieved by the customer after completion of an order process.


§ 3 Right of withdrawal
(1) Consumers are entitled to a right of revocation in accordance with the statutory provisions. Consumers are natural persons for whom the purpose of the order cannot be attributed to a commercial, self-employed or freelance activity.

(2) If the customer exercises the right of revocation, he shall bear the costs of the return.

(3) In the following, the customer receives the legally required information about the requirements and consequences of the right of withdrawal.

by means of a clear declaration (e.B. a letter sent by post or via e-mail) about your decision to revoke this contract. You can use the attached model withdrawal form, but this is not mandatory. To comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the expiry of the revocation period.

Consequences of revocation
If you withdraw from this contract, we shall reimburse you all payments that we have received from you, including delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us), immediately and at the latest within fourteen days from the day on which we received the notification of your revocation of this contract. For the repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment. (4) The right of revocation does not apply to distance contracts for the delivery of goods that have been manufactured according to customer specifications or that are clearly tailored to the personal needs of the customer.


§ 4 Prices and shipping costs
(1) All prices in the online shop are inclusive of statutory value added tax and plus any shipping costs as well as costs incurred by the selected payment method.

(2) For goods ordered via the online shop, the prices of the day of the order apply.

(3) The price including VAT, the shipping costs and any costs incurred by the selected payment method will be displayed to the customer during the ordering process.

(4) If the customer's order is fulfilled in partial delivery, the customer will only incur shipping costs for the first partial delivery. If the partial delivery is made at the request of the customer, shipping costs will be charged for each partial delivery.


§ 5 Terms of payment
(1) MULINU accepts payment by "STRIPE" (credit card), "PayPal" and on account; we reserve the right to exclude individual payment methods.

§ 7 Reservation of self-supply; unavailability; Withdraw
If MULINU is unable to deliver the ordered goods through no fault of its own, for example because the upstream supplier has not fulfilled its contractual obligations, or if the goods ordered by the customer are not available for a period of at least one month due to force majeure, MULINU may withdraw from the purchase contract. MULINU will inform the customer immediately in the event of corresponding delivery difficulties. In the event of a withdrawal by MULINU, MULINU will immediately reimburse the customer for any payment already made.


§ 8 Set-off and right of retention
(1) The customer is only entitled to offset claims if the counterclaim of the customer concerns a counter-performance claim from the same purchase contract, has been legally established, is recognized by MULINU or is undisputed.

(2) The customer can only assert rights of retention if the counterclaim is based on the same purchase contract.


§ 9 Retention of title
The delivered goods remain the property of MULINU until full payment of the purchase price.


§ 10 Warranty
(1) MULINU is liable for material defects or defects of title delivered articles in accordance with the applicable statutory provisions, in particular §§ 434 ff. BGB.

(2) MULINU grants a two-year warranty on the processing and material of all backpacks from the date of purchase. The guarantee is valid within the territorial scope of the European Union and Switzerland. Should the Buyer discover defects in materials and workmanship within the two-year warranty period and hand over the product to the respective dealer or directly to MULINU before the warranty expires, MULINU will remedy the defect in question or replace the product with a defect-free product. The decision on how to remedy the defect is made by MULINU. MULINU assumes the costs incurred for the remedy of defects as such, but not other costs that may arise in connection with the warranty claim, such as .B transport or shipping costs. The warranty does not apply to normal wear and tear and such damage caused by improper handling, accidents or extreme temperatures. Also excluded from the warranty is the accessories for which only the statutory warranty rights apply. In the event of a warranty claim, the warranty period shall not be extended by a further two years. The warranty is always valid from the date of purchase and is limited to the two-year term to be calculated from the date of purchase. If the buyer wishes to assert a warranty claim, the proof of purchase of the dealer (invoice or receipt), which must show the date of purchase, must be presented. Technical changes to the product are reserved.

§ 11 Color deviations
The customer is aware that color deviations may occur in the products shipped by us from artisanal production. Likewise, color deviations between the illustrations and the article may occur in terms of printing technology. These do not entitle to warranty claims.


§ 12 Liability
(1) MULINU is liable in accordance with the statutory provisions, unless liability is excluded under the following provisions.

(2) MULINU excludes liability for slightly negligent breaches of duty, unless damages resulting from injury to life, limb or health or guarantees are affected or claims under the Product Liability Act are affected. Furthermore, the liability for the violation of obligations, the fulfillment of which makes the proper execution of the contract possible in the first place and on the observance of which the customer may regularly rely.

(3) The provisions of this § 11 also apply to breaches of duty by vicarious agents of MULINU.


§ 13 Copyrights
Texts, graphics, photos, images, moving images, sound recordings, software and other content published in the online shop (hereinafter referred to as "content") are the intellectual property of MULINU, its licensees or content providers, unless copyrights of third parties exist. Use of this content is not permitted.


§ 14 Data protection
(1) All personal data provided by the customer (e.B title, name, address, e-mail address) will be collected, processed and stored by MULINU exclusively in accordance with the provisions of German data protection law.

(2) MULINU uses the data provided by the customer to fulfill and process the order. The customer's data will be passed on to the shipping company commissioned with the delivery, insofar as this is necessary for the delivery of the goods. For the processing of payments, MULINU may pass on the customer's payment data to MULINU's house bank or payment service provider. Upon completion of the contract and full payment of the purchase price, the customer's data will be blocked for further use and completely deleted after expiry of tax and commercial retention obligations.

§ 15 Applicable law and place of jurisdiction
The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If the customer is a consumer residing in another country of the European Union, the application of mandatory consumer protection provisions of this country remains unaffected by the choice of law made in sentence 1.


§ 16 Severability clause
Should any provision of these GTC be or become legally invalid, this shall not affect the validity of the remaining provisions.
