5. Copyrights
5.1 With every use of the work the name of the respective artist (originator / originator) is to be called.
5.2 Every use and utilisation of the work is permitted only after written approval of the artist and is valid only for the agreed duration and the agreed purpose. With the possession of the work or the transfer of title are – provided that differently does not agree – no utilisation rights or rights of use according to the copyright law linkedly; this is valid in particular for public exhibiting.
5.3 For every use or utilisation of the work the artist is entitled to an adequate reimbursement.
5.4 If the exhibition right is expressly granted deviating from figure 5.2, the right is also granted for the topical reporting about the work, also the right to the picture of the work on poster, invitation, on the Internet as well as in the catalogue in connection with an exhibition.
5.5 To the work use überlassene documents (photo, slides, texts among other things) may be published only by consent of the artist called on the documents and under naming of his name.
5.6 The resale right (§26 UrhG) and the access right (§25 UrhG) are recognised. In addition, the obligation insists on leaving the work temporarily to the use (e.g., for exhibitions) to the artist, as far as it is reasonable.
6. Warranty/Maintenance/Repair
6.1 Guarantee achievements of the artist for artistic creation are excluded, provided that does not agree in the contract differently.
6.2 Servicing obligations are not taken over, unless, they are agreed separately and all costs linked with the servicing are born from / by the user user and are compensated for the artist separately.
6.3 It is left to the artist to carry out necessary restoration or repair against adequate remuneration. If the artist does not carry out the restoration or repair himself, she / he gives obliging instructions to her kind and implementation.
7. GENERAL REGULATIONS
The renunciation of the artist, a right or a regulation of these Terms and Conditions to exercise or to put through, shows no renunciation of this right or the concerning regulation.
8. APPLICABLE RIGHT AND LEGAL VENUE
These Terms and Conditions determine themselves according to German right with the exception of his collision-juridical regulations and to the exclusion of the UN-purchase right.
For disputes from or in connection with the use of the service and/or these Terms and Conditions the courts are exclusively responsible in Aachen, provided that you are a businessman or have no firm residence in Germany, your residence or usual place of residence after coming into effect of these Terms and Conditions abroad have moved or if your residence or usual place of residence is not known at the time of the complaint elevation.
9. SEVERABILITY CLAUSE
Provided that a regulation of these Terms and Conditions is ineffective, the remaining regulations of it remain untouched. The ineffective regulation is valid as by such substitutes which comes to the sense and the purpose of the ineffective regulation in legal manner economically most near. Same is valid for possible regulation gaps.
10. For in the shop of the supplier to shown goods the supplier delivers an obliging purchase offer. With sending the order wish about the badge "liable to payment order" the customer accepts the purchase offer. The supplier confirms the contract end by e-mail (contract confirmation).
