Terms & Conditions
1. Scope
These Terms and Conditions apply to all orders placed through the Etsy shop studiosaysay. The seller is an individual operating under the German small business regulation (Kleinunternehmerregelung, § 19 UStG). By placing an order, you accept these Terms and Conditions.
2. Contract Formation
The presentation of products in the Etsy shop does not constitute a legally binding offer. By placing an order, you submit a binding offer to purchase. The purchase contract is concluded when the order is confirmed via email or when the goods are dispatched.
3. Products & Production
All products are produced on demand via the print-on-demand provider Gelato. This means every product is individually manufactured after your order is received. Colors may vary slightly from what is shown on screen. Minor production variations (e.g. in placement or shade) are possible and do not constitute a defect.
4. Prices
All prices shown are final prices inclusive of any applicable charges. As studiosaysay operates under the German small business regulation (§ 19 UStG), no VAT is charged or shown on invoices.
5. Payment
Payment is processed through the payment methods provided by Etsy (e.g. credit card, PayPal, Klarna) via Etsy Payments. The full amount is charged at the time of purchase.
6. Shipping & Delivery Times
Products are produced by Gelato and shipped directly to you. Production typically takes 2–5 business days. Delivery within Germany usually takes an additional 3–7 business days after production. International delivery times may vary. All delivery times are estimates and are not guaranteed. Delays caused by production partners or shipping carriers are outside of my control.
7. Right of Withdrawal
As all products are individually manufactured to order, there is no statutory right of withdrawal pursuant to § 312g para. 2 no. 1 of the German Civil Code (BGB). Products made to customer specification are excluded from the right of return.
This does not affect your statutory warranty rights in the case of defective or damaged products (see Section 8).
8. Warranty & Defects
If you receive a defective, damaged, or incorrectly delivered product, please contact me within 14 days of receiving your order via Etsy message. Please include photos of the issue. For valid complaints, I will offer either a replacement or a full refund. Return shipping is not required in these cases.
9. Returns & Refunds
As all products are individually produced to order, returns and exchanges are generally not accepted, except in cases of proven production errors or shipping damage (see Section 8). Please carefully review product descriptions, size guides, and preview images before placing your order.
10. Limitation of Liability
Liability for slight negligence is excluded to the extent permitted by law. This does not apply in cases of injury to life, body, or health, or in cases of breach of essential contractual obligations. For essential contractual obligations, liability is limited to foreseeable, contract-typical damages.
11. Intellectual Property
All designs, graphics, and texts used in this shop are protected by copyright. Reproduction, distribution, or use of the designs without explicit permission is not permitted. The purchase of a product does not transfer any rights to the designs contained therein.
12. Privacy
Personal data (name, address, email) is processed to fulfill your order, based on Art. 6 para. 1 lit. b GDPR. Data is shared with Gelato as production partner and with shipping carriers as required for order fulfillment. For more information, please refer to our separate Privacy Policy and Etsy's Privacy Policy.
13. Dispute Resolution
The European Commission provides an online dispute resolution (ODR) platform: https://ec.europa.eu/consumers/odr. I am not obligated or willing to participate in dispute resolution proceedings before a consumer arbitration board.
14. Governing Law
These Terms and Conditions are governed by the laws of the Federal Republic of Germany. Should any individual provision be invalid, the remaining provisions shall remain unaffected.

Privacy Policy
1. Data Controller
The person responsible for the processing of personal data in this Etsy shop is the owner of studiosaysay. Contact is available exclusively via the Etsy messaging system.
2. What Data Is Collected?
The following personal data is processed when you place an order:
– Name and address (for delivery purposes)
– Email address (for order communication)
– Payment data (processed exclusively via Etsy Payments)
– Order details (product, quantity, price)
3. Purpose and Legal Basis
Your data is processed solely for the purpose of fulfilling your order. The legal basis is Art. 6 para. 1 lit. b GDPR (performance of a contract). Without this data, your order cannot be processed or delivered.
4. Sharing with Third Parties
To fulfill your order, your data is shared with the following service providers:
– Gelato AS, Drammensveien 130, 0277 Oslo, Norway (production partner & shipping): name, delivery address, and order details for manufacturing and delivery of your product.
– Shipping carriers (e.g. DHL, DPD, depending on Gelato routing): delivery address for shipment.
– Etsy Ireland UC, 66/67 Great Strand Street, Dublin 1, Ireland: payment processing and shop operations via the Etsy platform.
Your data will not be shared with any other third parties or used for advertising purposes.
5. Data Retention
Your data is retained only for as long as necessary to fulfill your order or as required by statutory retention obligations (e.g. tax retention periods of up to 10 years).
6. Your Rights
You have the right at any time to:
– Access your stored data (Art. 15 GDPR)
– Rectification of inaccurate data (Art. 16 GDPR)
– Erasure of your data, where no legal retention obligations apply (Art. 17 GDPR)
– Restriction of processing (Art. 18 GDPR)
– Data portability (Art. 20 GDPR)
– Object to processing (Art. 21 GDPR)

7. Right to Lodge a Complaint
You have the right to lodge a complaint with a data protection supervisory authority. The competent authority for North Rhine-Westphalia, Germany is: Landesbeauftragte fuer Datenschutz und Informationsfreiheit Nordrhein-Westfalen (www.ldi.nrw.de).
8. Etsy's Privacy Policy

9. Cookies & Tracking
This shop is operated via the Etsy platform. Etsy uses its own cookies and tracking technologies, over which I have no control as the shop owner. For details, please refer to Etsy's Cookie Policy.

This Privacy Policy may be updated as needed, for example in response to changes in legal requirements or the service providers used. The current version is always available in the shop.
