§1 field of application
These terms and conditions apply to the production, sale and supply of items by Magic Tribal Hair to the customer and no other terms shall apply. Magic Tribal Hair reserves the right at its sole discretion to amend these terms and conditions at any time.

§2 Order process – payment – custom duties

(1) Order process
The contract is valid with your purchase of one ore more of our offers. Magic Tribal Hair will make the goods ordered according to your customization details and after your payment has been cleared. This means we make all items to order and specialize in custom orders, so we only deliver on advance payment.

(2) Payment
Payment options:
All options Etsy offers for your country, among others credit card, Etsy gift card, Paypal, Klarna...

Important notice: Delivery may only be affected to the address we receive with your order which is the address you signed up with at Etsy. Please make sure you have your current address there! Second shippings due to address faults from your side must be covered by you. This also applies if first shipping was free.

(3) Custom duties and import sales tax

Information for customers in the U.S.:
The current administration has decided that deliveries from Germany to the U.S. are subject to 15 % tariff (15 % of item value and shipping costs) from August 25, 2025. Tariffs are paid to UPS by the customer. We recommend paying online (check tracking and your e-mail inbox for a UPS message) upfront, this will not only speed up the delivery process but also save you an extra $ 12 fee UPS charges for swiping your card upon delivery at your door.

Information for customers in the UK:
Orders below GBP £ 135: Etsy charges UK VAT during checkout and on top of the prices you see in the listings. UK VAT is charged on shipping, too. Etsy remits the VAT you pait to the HMRC and we add this information to the outside of your parcel to prevent you from being charged twice.
Orders GBP £ 135 and more: You will have to pay UK VAT and custom charges upon receipt of your parcel.

Information for customers in Switzerland:
You are obliged to pay Swiss VAT upon receipt of your parcel. Deliveries to other non-EU countries may cause customs duties and/ or import sales tax (the sales tax/ GST percentage in your country), which must be paid by the customer. Deliveries are often free up to a certain value; Magic Tribal Hair adds the relevant form and a copy of the invoice to every delivery to custom-affected countries, so you won't get any trouble at the customs. Please inform about customs duties and import sales taxes at your local tax office.

§3 Terms of shipment and shipping costs
We ship worldwide, except to Austria (how customers in Austria can still order from us see end of this paragraph)*. Shipping costs include postal charges, boxing and handling and are paid by the customer. For some countries (United States, Canada and UK) we offer shipping upgrades for expedited or express shipping through UPS. Shipping costs include VAT where applicable.

We update you with shipping information as soon as your parcel has shipped; average shipping time and tracking information for you to track your parcel online. This means you can't miss it even if the parcel service doesn't give you a note in your physical mailbox (happens sometimes) about a delivery to your neighbour or storage at a local pick-up. If a parcel is returned because the customer did not pick it up at their local post office/ pick-up in time, redelivery = second shipping must be paid by the customer.

The customer is responsible for providing the right shipping address, we are obliged to ship to the address you entered at Etsy, so please keep this address up to date. If delivery fails due to a wrong address provided by the customer, the customer must pay the costs for another shipment. This also applies in case the first shipment was free.

If delivery time cannot be met due to such a delay of address issues not caused by us or a parcel being returned as unclaimed meaning not picked up at the local pick-up, the contract cannot be cancelled.

* Note for customers in Austria:
Due to the new packaging laws we must stop shipping directly to addresses in Austria, all orders placed with shipping address in Austria will be cancelled and fully refunded. If you live in Austria, you are welcome to reorder then to an address in any other country! Or to reorder to a shipping provider in Germany that forwards your parcel to your address in Austria. Costs are about the same as previous direct shipping to Austria, because you can book the smallest parcel volume (3 kg, forwarding costs are about € 9 only you pay to the shipping provider and shipping costs to the provider are the low shipping costs for Germany).

§4 Time of delivery
Time of delivery is the period between order and the day your parcel arrives at your delivery address. This means delivery time contains processing time and shipping time.
You find delivery time for each item when you click "Shipping & Policies" on top of the item description. It says "Ready to ship in..." below the payment options.

Time of delivery is also determined by the volume of your order, because all items are hand-made to order.
If you order several items with different processing times, the longest usually applies to your order.

Delivery time can only be met if payment is made right with your order and if customization details (for example details for hair color) are inserted right with your order or discussed with us post order the same day (e.g. when you send a picture for our free hair color check taken 100 % to the instructions here https://www.etsy.com/listing/559460789/custom-headband-hair-color-check-free) which enables me to make and ship your order as scheduled.

§5 Contract formation/ cancellation right
The contract is valid with your purchase of one ore more of our offers. If you use the etsy shopping cart the contract is valid only after you have proceeded through checkout and clicked the "buy and pay"-button. Putting an item in your shopping cart only does not lead to any contract.

Cancellation right does not apply to hand- & custom-made to order items. All items by Magic Tribal Hair are hand-made to order exclusively. We don't sell any pre-produced items. Our items are made as per your specification, i.a. hair extensions in your exact hair color often, so we do not accept any returns. Hair pieces cannot be returned due to hygienic reasons either. Therefore we do not offer a digital return form or add one to our parcels either.

§6 Prices & Coupon Codes
All prices are final prices/ gross prices. Prices include 19 % VAT where applicable.

U.S. Marketplace Sales Tax
Marketplace sales tax is added to prices (item prices and shipping costs) during checkout if your state charges any. The percentage charged is the same you are charged for this kind of product when you buy it in a physical shop in your state. Etsy remits all marketplace sales tax charged to U.S. authorities and we add this information to the outside of your parcel to prevent you from being charged twice.

Australian GST
Etsy charges Australian GST for delivery addresses in Australia during checkout and on top of the prices you see in the listings. GST is charged on shipping, too. Etsy remits all GST charged to Australian authorities and we add this information to the outside of your parcel to prevent you from being charged twice.

UK VAT

Coupons codes must be inserted straight with your order during checkout process and cannot be redeemed later on. If you forgot to insert the coupon code, you can still use it for your next order, at least in case it won't have expired by then. Percentage discounts refer to order value without shipping costs. You can't redeem more than 1 coupon per order.

§7 Liability for defects & warranty
Legal regulations apply.

§8 Choice of law and jurisdiction
German law is applicable for all Magic Tribal Hair transactions and the place of jurisdiction is Cologne.
