A. Terms and Conditions

Scope of Application
These Terms and Conditions ("T&Cs") of Sandra Suttles, trading as "Sunnyty" ("Seller"), apply to all contracts for the delivery of goods entered into by a consumer or business ("Customer") with the Seller via the online marketplace Etsy. Any contrary terms of the Customer shall not apply unless otherwise agreed.

Contract Conclusion
By listing a product on Etsy, the Seller makes a binding offer to sell the item. The Customer may accept the offer by completing the ordering process on Etsy. The contract is concluded when the Customer clicks the final order button.

Right of Withdrawal
Please refer to section C below.

Prices and Payment Terms
All prices include statutory VAT. Additional shipping charges, if any, are stated in the product listing. Payment methods are listed in the offer.

Delivery and Shipping Conditions
Delivery is made to the address specified by the Customer on Etsy. Delivery time, shipping method, and responsibility for shipping costs are governed by Etsy's policy.

Grant of Rights for Digital Content
Where applicable, the Seller grants the Customer a non-exclusive, unlimited right to use the content provided for personal and commercial purposes. Transfer or reproduction for third parties outside these T&Cs is prohibited.

Retention of Title
Goods remain the Seller’s property until fully paid.

Warranty
The legal warranty provisions apply. For businesses, warranty claims for used goods are excluded and the limitation period for new goods is one year from delivery. This does not apply to claims for damages or product updates.

Customized Products
For custom products, the Customer shall provide all necessary content (e.g., text, images) and confirm they have rights to the submitted material. The Seller reserves the right to reject inappropriate content.

Applicable Law
The laws of the Federal Republic of Germany apply. For consumers, this choice of law only applies if it does not deprive the consumer of mandatory consumer protection laws.

Alternative Dispute Resolution
The Seller is not obligated or willing to participate in dispute resolution proceedings before a consumer arbitration board.

C. Right of Withdrawal

Introduction: Consumers are entitled to a right of withdrawal as outlined below. A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession.

Right of Withdrawal: You have the right to withdraw from this contract within fourteen days without giving any reason.For contracts concerning the delivery of goods, the withdrawal period is fourteen days from the day you or a third party named by you who is not the carrier has taken possession of the last item.For contracts concerning the supply of digital content not supplied on a tangible medium, the withdrawal period is fourteen days from the day of the conclusion of the contract.To exercise your right of withdrawal, you must inform us (Sandra Suttles, Sunnyty, Bäckergasse 4, 71735 Eberdingen, Germany, Tel.: +49 151 52504916, Email: sunnyty@web.de) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email). Consequences of Withdrawal: If you withdraw from this contract, we shall reimburse you all payments received from you, including delivery costs (except for the supplementary costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we are informed about your decision to withdraw from this contract.We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.For contracts concerning the delivery of goods, we may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.You shall send back the goods or hand them over to us without undue delay and in any event no later than twenty-one days from the day on which you communicate your withdrawal from this contract to us. Exclusion or Premature Expiry of the Right of Withdrawal: The right of withdrawal does not apply to contracts for the supply of goods that are made to the consumer’s specifications or are clearly personalized.The right of withdrawal expires prematurely in the case of a contract for the supply of digital content not supplied on a tangible medium if we have begun the performance of the contract after you have expressly agreed that we begin with the performance of the contract before the withdrawal period has expired, you have confirmed your understanding that by agreeing to start the performance of the contract you lose your right of withdrawal, and we have provided you with a confirmation of the contract including the aforementioned conditions in a durable medium.
