1. General Information

1.1. These Terms & Conditions govern all purchases, orders, and interactions with the Babotipi store on Etsy.
1.2. By placing an order, you agree to these Terms & Conditions, Etsy’s Terms of Use, and applicable EU consumer protection laws.
1.3. The seller of all products is Babo – Karolina Kononiuk, registered in Poland.

1.5. All communication occurs exclusively via Etsy messages.

2. Products & Orders
2.1. All products are handmade or made-to-order unless otherwise stated.
2.2. Product descriptions, materials, dimensions, and photos are provided as accurately as possible; slight variations may occur due to the handmade nature of items.
2.3. By placing an order, the buyer confirms that all provided information (address, phone number, etc.) is correct.


3. Prices & Payments
3.1. Prices are shown in EUR.
3.2. Payments are processed exclusively through Etsy’s secure payment systems.
3.3. Available payment methods are only those offered directly by Etsy for your country (e.g., credit/debit cards, PayPal, Etsy gift cards, or other methods currently available through Etsy).
3.4. Once payment is completed, the order enters fulfillment processing.

4. Shipping & Delivery
4.1. Orders are shipped to the address provided during Etsy checkout.
4.2. All orders are shipped using carriers selected by the seller.
4.3. Delivery Time
Poland: 1–3 business days
Europe: 3–7 business days
Outside EU: 5–12 business days
Actual delivery may vary due to customs, seasonal delays, weather, or carrier issues.
4.4. Delays caused by customs, postal services, or force majeure are outside the seller’s responsibility.
4.5. If a parcel is returned due to an incorrect address or failure to collect it, the buyer may be responsible for reshipping costs.

5. Customs, Duties & Import Taxes
5.1. International shipments may be subject to customs duties, VAT, import taxes, or handling fees imposed by the buyer’s local authorities.
5.2. These charges are not included in product prices or shipping fees.
5.3. The buyer is fully responsible for any such charges.
5.4. Customs processing may cause delays beyond the seller’s control.
5.5. If the buyer refuses to pay customs fees and the parcel is returned, the refund will be issued minus the shipping cost and any return fees charged by the carrier.
5.6. If the parcel is destroyed or not returned by customs authorities, no refund may be possible.

6. Return & Exchange Policy
6.1. EU buyers have the right to withdraw from the contract within 14 days of receiving the product, unless the item is personalized or otherwise excluded by law.
6.2. The buyer must contact the seller via Etsy within 14 days to initiate a return.
6.3. Items must be returned in their original condition, unused and properly packaged.
6.4. Custom or personalized products are not eligible for return unless damaged or defective.
6.5. The buyer is responsible for return shipping costs unless the item arrived damaged or incorrect.
6.6. Refunds are issued after the returned product is received and inspected.
6.7. Original shipping costs are not refundable, except in cases where the seller is at fault.
6.8. Exchanges are possible if arranged via Etsy and within the return period; buyer covers shipping costs both ways.

7. Damaged or Defective Items
7.1. If an item arrives damaged, the buyer must contact the seller within 48 hours via Etsy messages.
7.2. Proof such as photos or videos may be required.
7.3. A replacement or refund will be arranged depending on product availability.

8. Privacy & Data Protection (GDPR)
8.1. The seller complies with EU GDPR regulations.
8.2. Personal data is used solely for order processing, shipping, communication, and legal obligations.
8.3. Data is stored securely and never sold to third parties.
8.4. Buyers may request access, correction, or deletion of their personal data.

9. Final Provisions
9.1. These Terms are governed by the laws of Poland and EU consumer law.
9.2. For disputes, the consumer may use the EU ODR platform.
9.3. The seller reserves the right to update these Terms when necessary.
