**Terms and Conditions of the Hobbyhorsowo.pl / ETSY Online Store**

1. **General Provisions**
1.1. These terms and conditions define the rules for using the online store https://hhobbyhorsowo.etsy.com.

2. **Definitions**
2.1. Customer – a natural person, legal person, or organizational unit without legal personality, using the online store.
2.2. Consumer – a Customer who is a natural person, making purchases in the online store unrelated directly to their business or professional activity.
2.3. Terms and Conditions – these terms and conditions of the online store.
2.4. Online Store – the website available at https://hhobbyhorsowo.etsy.com.

3. **Order Placement Rules**
3.1. The online store sells goods via the Internet.
3.2. Orders can be placed 24 hours a day, 7 days a week.
3.3. To place an order, the Customer must register or use the option to purchase without registration.
3.4. The order placement process includes selecting the goods, adding them to the cart, choosing the delivery and payment methods, and confirming the order.
3.5. If the buyer chooses courier delivery during the purchase, they are required to provide their mobile phone number so the courier company can contact them immediately in case of delivery issues. Orders without a phone number will be sent via Polish Post.
3.6. After placing the order, the Customer receives a confirmation of the order acceptance at the provided email address.
3.7. If a package is not picked up by the buyer, or in case of undeliverable items, the cost of return shipping will be deducted from the refunded amount, corresponding to the amount the buyer paid during the order.

4. **Prices and Payment Methods**
4.1. All prices listed on the website of the online store are gross prices (including VAT) and are expressed in the currency of the country where the order is placed.
4.2. Delivery costs are added to the order price, depending on the delivery method chosen by the Customer.
4.3. The Customer can pay for the order via: bank transfer or online payment.

5. **Delivery**
5.1. Goods are delivered worldwide.
5.2. The estimated delivery time is from 2 to 7 working days, counting from the day the payment is credited to the Seller's account.
5.3. Delivery costs depend on the chosen delivery method and are specified during the order placement.

6. **Right of Withdrawal**
6.1. The Consumer has the right to withdraw from the sales agreement without providing a reason within 14 days from the date of receiving the goods.
6.2. To exercise the right of withdrawal, the Consumer must inform the Seller of their decision via a clear statement, such as a letter sent by post or email.
6.3. The Consumer is required to return the goods within 14 days from the day they informed the Seller of the withdrawal. The return shipping costs are borne by the Consumer.
6.4. The Seller will refund all payments received from the Consumer, including delivery costs (excluding section 3.7), no later than 14 days from the date of receiving the returned goods or proof of their return.

7. **Complaints**
7.1. The Seller is responsible for physical and legal defects of the goods in accordance with the applicable laws.
7.2. Complaints can be submitted by email at: sprzedaz@hobbyhorsowo.pl or in writing to the Seller's address.
7.3. In case of a defect in the goods, the Customer has the right to request repair, replacement with new goods, price reduction, or withdrawal from the agreement.

8. **Personal Data Protection**
8.1. The personal data administrator is the Seller.
8.2. Personal data is processed for order fulfillment and, if the Customer agrees, for marketing purposes.
8.3. The Customer has the right to access their personal data, correct it, and request its deletion.

9. **Final Provisions**
9.1. In matters not regulated by these terms and conditions, Polish law applies, particularly the Civil Code and the Consumer Rights Act.
9.2. The Seller reserves the right to make changes to these terms and conditions. The changes will be effective on the date specified by the Seller, not earlier than 7 days from the date they are made available on the online store's website. Orders placed before the changes take effect will be processed according to the terms in force on the date the order was placed.
9.3. These terms and conditions come into effect on 01.01.2025.

2.1. Klient – osoba fizyczna, osoba prawna lub jednostka organizacyjna nieposiadająca osobowości prawnej, korzystająca ze sklepu internetowego.
2.2. Konsument – Klient będący osobą fizyczną, dokonujący zakupów w sklepie internetowym w zakresie niezwiązanym bezpośrednio z jego działalnością gospodarczą lub zawodową.
2.3. Regulamin – niniejszy regulamin sklepu internetowego.

3. Zasady Składania Zamówień
3.1. Sklep internetowy prowadzi sprzedaż towarów za pośrednictwem sieci Internet.
3.2. Zamówienia można składać przez całą dobę, 7 dni w tygodniu.
3.3. W celu złożenia zamówienia Klient musi dokonać rejestracji lub skorzystać z opcji zakupu bez rejestracji.
3.4. Proces składania zamówienia obejmuje wybór towaru, dodanie go do koszyka, wybór metody dostawy i płatności oraz potwierdzenie zamówienia.
3,5. Jeżeli kupujący, podczas zakupu wybierze dostawę zamówienia za pośrednictwem firmy kurierskiej, jest zobowiązany do dostarczenia sprzedającemu numeru telefonu komórkowego, aby w razie kłopotów z przesyłką, firma kurierska mogła się bezzwłocznie skontaktować z kupującym celem rozwiązania problemu.
Zamówienia, do których nie zostanie dołączony numer telefonu, zostaną wysłane Pocztą Polską
3.6. Po złożeniu zamówienia Klient otrzymuje potwierdzenie przyjęcia zamówienia na podany adres e-mail.
3,7. Za przesyłki nie odebrane przez kupujących, lub w przypadku braku możliwości ich dostarczenia, podczas zwrotu środków, zostanie naliczony koszt przesyłki za zwrot paczki, odpowiadający kwocie, jaką kupujący poniósł podczas składania zamówienia.

4. Ceny i Metody Płatności
4.1. Wszystkie ceny podane na stronie sklepu internetowego są cenami brutto (zawierają podatek VAT) i wyrażone są w walucie kraju, z którego jest składane zamówienie.
4.2. Do ceny zamówienia doliczane są koszty dostawy, zgodnie z wybraną przez Klienta metodą dostawy.
4.3. Klient może dokonać płatności za zamówienie poprzez: przelew bankowy, płatność online.

5. Dostawa
5.1. Dostawa towarów realizowana jest na terytorium całego świata.
5.2. Przewidywany czas dostawy wynosi od 2 do 7 dni roboczych, licząc od dnia zaksięgowania płatności na koncie Sprzedawcy.
5.3. Koszty dostawy zależą od wybranego sposobu dostawy i są podane podczas składania zamówienia.

6. Odstąpienie od Umowy
6.1. Konsument ma prawo odstąpić od umowy sprzedaży bez podania przyczyny w ciągu 14 dni od daty otrzymania towaru.
6.2. Aby skorzystać z prawa odstąpienia od umowy, Konsument musi poinformować Sprzedawcę o swojej decyzji w drodze jednoznacznego oświadczenia, na przykład poprzez pismo wysłane pocztą lub pocztą elektroniczną.
6.3. Konsument zobowiązany jest do zwrotu towaru w ciągu 14 dni od dnia, w którym poinformował Sprzedawcę o odstąpieniu od umowy. Koszty zwrotu towaru ponosi Konsument.
6.4. Sprzedawca zwraca wszystkie płatności otrzymane od Konsumenta, w tym koszty dostawy (z wyłączeniem pkt 3.7) nie później niż w ciągu 14 dni od dnia otrzymania zwróconego towaru lub dowodu jego odesłania.

7. Reklamacje
7.1. Sprzedawca odpowiada za wady fizyczne i prawne towarów zgodnie z obowiązującymi przepisami prawa.
7.2. Reklamacje można składać na adres e-mail: sprzedaz@hobbyhorsowo.pl lub pisemnie na adres siedziby Sprzedawcy.
7.3. W przypadku stwierdzenia wady towaru, Klient ma prawo do żądania naprawy towaru, wymiany na nowy, obniżenia ceny lub odstąpienia od umowy.

8. Ochrona Danych Osobowych
8.1. Administratorem danych osobowych Klientów jest Sprzedawca.
8.2. Dane osobowe przetwarzane są w celu realizacji zamówień oraz, jeśli Klient wyrazi na to zgodę, w celach marketingowych.
8.3. Klient ma prawo dostępu do swoich danych osobowych, ich poprawiania oraz żądania ich usunięcia.

9. Postanowienia Końcowe
9.1. W sprawach nieuregulowanych niniejszym regulaminem mają zastosowanie przepisy prawa polskiego, w szczególności Kodeksu cywilnego oraz Ustawy o prawach konsumenta.
9.2. Sprzedawca zastrzega sobie prawo do dokonywania zmian w niniejszym regulaminie. Zmiany regulaminu wchodzą w życie w terminie wskazanym przez Sprzedawcę, nie krótszym niż 7 dni od dnia ich udostępnienia na stronie sklepu internetowego. Zamówienia złożone przed wejściem w życie zmian regulaminu są realizowane na podstawie zapisów obowiązujących w dniu złożenia zamówienia.
9.3. Niniejszy regulamin wchodzi w życie z dniem 01.01.2025
