General Terms and Conditions Cora Design
1. scope of application:
These GTC regulate all legal relationships between Cora Design, Inh. Sandra Schruff (hereinafter: Cora Design) and their customers. They replace all previous GTC and apply exclusively to these customers. Other GTC are expressly contradicted.
2. conclusion of contract
The contract is concluded with the sending of the contract confirmation or with the sending/handing over of the goods. Cora Design is not obliged to conclude a contract.
3. reservation of proprietary rights / copyright
The sold goods remain the property of Cora Design until full payment. Only the goods are sold, all rights to own designs remain with Cora Design.
In the case of the sale of embroidery design files, the rights of use sold will not pass to the buyer until full payment has been made.
4. payment options / foreign delivery
Cora Design accepts only prepayment and Paypal within the webshop, for offline sales also cash.
Cora-Design delivers abroad only from an amount of € 200, but the buyer can always pick up the goods at his own expense and self-organized, but only after prior notice to Cora Design on site.
5. samples (note: on the website or in the store must be set a clear separate offer regarding samples)
We are happy to provide samples and selection shipments. These are charged at separate .prices and sent to new customers by cash on delivery or prepayment, unless a pickup at the site Cora Design was agreed.
When placing an order for the sampled products, a credit note will be issued for the calculated samples for the price difference between the unit price and the actual sales price for the total quantity. A return or exchange of samples and selection shipments (especially textiles) is unfortunately not possible in principle for hygienic reasons. We reserve the right to send samples in the size of our choice.
We expressly reserve the right to deviations in color or surface or strength due to raw materials.
6.a Finishing orders / Individual embroideries
If the customer provides Cora Design with customer's own embroidery templates of any kind, Cora Design is not obliged to check these embroidery templates for suitability or inadequacies. In particular, Cora Design is not obliged to check legal, especially copyright infringements of the templates or the customer.
The customer agrees to indemnify Cora Design from all damages resulting from an infringement of his template.
6.b. Order cancellation
If the customer cancels an embroidery order, the customer owes Cora Design a loss of profit equal to 10% of the amount due on the unfulfilled portion of the order. The customer has the possibility to prove a lesser damage. Cora Design in turn has the possibility to prove a higher damage.
7. exclusion of liability
The liability of Cora Design is excluded. Not excluded is the liability for slight negligence in the breach of essential contractual obligations, as well as intent, gross negligence and damage to body, life and health. Statutory warranty rights for defects shall remain unaffected by this, so the customer shall have the right to withdraw from the contract, to rectification/redelivery and to a reduction in price even if liability is excluded, if there are corresponding defects.
In the case of negligently caused damage to property and financial loss, Cora Design shall only be liable in the event of a breach of an essential contractual obligation, but limited in amount to the damage foreseeable at the time of conclusion of the contract and typical for the contract. Material contractual obligations are those whose fulfillment characterizes the contract and on which the provider and customer may rely.
Claims from product liability law remain unaffected.
7 Applicable Law / Place of Jurisdiction
The law of the Federal Republic of Germany applies, UN sales law is excluded. If the customer is a consumer residing in another EU country, mandatory consumer protection regulations and mandatory consumer protection judicial law of the consumer's country of residence remain applicable. The courts at the registered office of Cora Design shall have local jurisdiction for contracts with merchants, legal entities under public law or special funds under public law. Contract language is German.
