A. TERMS AND CONDITIONS

1. Seller and scope

1.1 These terms apply to all contracts for the delivery of goods concluded via the Etsy platform between Benjamin Oppl, trading via the Etsy shop "MoonAndTheMeadows", Drosselweg 18, 50735 Köln, Germany, email benjamin.oppl@outlook.com, VAT ID DE360436312 (the "Seller"), and the customer.

1.2 A consumer is any natural person concluding the transaction for purposes which are predominantly outside their trade, business or profession. An entrepreneur is a person acting in the exercise of their trade or independent profession.

2. Conclusion of contract

2.1 Each listing in the shop constitutes a binding offer to sell the item shown. The customer accepts the offer by completing Etsy's order process and clicking the button that finalises the order; at that moment the purchase contract is concluded.

2.2 The contract text is stored by the Seller; the customer receives the order details by email through Etsy. Input errors can be corrected during the order process using the standard functions of the browser and of the Etsy checkout. Contract languages: English and German.

3. Prices and payment

3.1 All prices are total prices and include statutory value added tax where the Seller is required to charge it. Where the Etsy platform is required to collect VAT, sales tax or import charges on a transaction, these are calculated and shown at checkout.

3.2 For deliveries to countries outside the European Union, additional duties, taxes or fees may arise which are not payable through the Seller and are borne by the customer, unless collected at checkout.

3.3 Payment is processed through Etsy Payments (Etsy Ireland UC, 66/67 Great Strand Street, Dublin 1, Ireland; for payments in USD or CAD: Etsy Inc., 117 Adams Street, Brooklyn, NY 11201, USA). The payment methods available are shown at checkout.

4. Production and delivery

4.1 All items are produced on demand. Printing and dispatch are carried out by the Seller's production partner Gelato (Gelato ASA, Dronning Eufemias gate 8, 0191 Oslo, Norway) from the available production site nearest to the delivery address, in order to reduce transport distance, time and emissions.

4.2 Orders enter production shortly after purchase. Order cancellation before dispatch is therefore not offered. The statutory right of withdrawal for consumers (sections B and D below) remains unaffected by this.

4.3 Delivery is made to the delivery address stated in the Etsy order. Estimated production and delivery times are shown in the listing.

5. Retention of title

Delivered goods remain the property of the Seller until the purchase price has been paid in full.

6. Warranty

6.1 The statutory warranty rights for defects apply.

6.2 Consumers are asked - without this affecting their statutory rights - to report obvious transport damage to the carrier and to the Seller, so that a replacement can be arranged quickly with the production partner.

7. Right of withdrawal

Consumers in the European Union and the European Economic Area have a statutory 14-day right of withdrawal as set out in the Withdrawal Notice below. Consumers in the United Kingdom have equivalent cancellation rights under the UK Consumer Contracts Regulations 2013, which the Seller honours in the same way.

8. Applicable law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of their country of habitual residence.

9. Dispute resolution

The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).


B. WITHDRAWAL NOTICE (English)

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day on which you, or a third party named by you who is not the carrier, takes physical possession of the goods (in the case of an order covering several goods delivered separately: of the last good).

To exercise this right, you must inform us - Benjamin Oppl, Drosselweg 18, 50735 Köln, Germany, email benjamin.oppl@outlook.com - of your decision to withdraw by an unequivocal statement (e.g. an email or a message via Etsy, including the withdrawal option in Etsy's "Help with order" flow). You may use the model withdrawal form below, but this is not obligatory. To meet the deadline, it is sufficient to send your communication before the withdrawal period expires.

Effects of withdrawal

If you withdraw, we will reimburse all payments received from you, including the costs of standard delivery (not any supplement for a non-standard delivery option you chose), without undue delay and no later than 14 days from the day we are informed of your withdrawal. We will use the same means of payment you used for the transaction; you will not be charged any fees for the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back, whichever is earlier.

You shall send back the goods to Benjamin Oppl, Drosselweg 18, 50735 Köln, Germany, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal. The deadline is met if you send the goods before the 14-day period has expired. You bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.

D. WIDERRUFSBELEHRUNG (Deutsch)

Widerrufsrecht

Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen. Die Widerrufsfrist beträgt vierzehn Tage ab dem Tag, an dem Sie oder ein von Ihnen benannter Dritter, der nicht der Beförderer ist, die Waren (bei einer einheitlichen Bestellung mehrerer Waren mit getrennter Lieferung: die letzte Ware) in Besitz genommen haben bzw. hat.

Um Ihr Widerrufsrecht auszuüben, müssen Sie uns - Benjamin Oppl, Drosselweg 18, 50735 Köln, Deutschland, E-Mail benjamin.oppl@outlook.com - mittels einer eindeutigen Erklärung (z. B. per E-Mail oder über eine Etsy-Nachricht, einschließlich der Widerrufsoption im Etsy-Ablauf "Hilfe zur Bestellung") über Ihren Entschluss, diesen Vertrag zu widerrufen, informieren. Sie können dafür das beigefügte Muster-Widerrufsformular verwenden, das jedoch nicht vorgeschrieben ist. Zur Wahrung der Widerrufsfrist reicht es aus, dass Sie die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absenden.

Folgen des Widerrufs

Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, einschließlich der Lieferkosten (mit Ausnahme der zusätzlichen Kosten, die sich daraus ergeben, dass Sie eine andere Art der Lieferung als die von uns angebotene, günstigste Standardlieferung gewählt haben), unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrags bei uns eingegangen ist. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das Sie bei der ursprünglichen Transaktion eingesetzt haben, es sei denn, mit Ihnen wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden Ihnen wegen dieser Rückzahlung Entgelte berechnet. Wir können die Rückzahlung verweigern, bis wir die Waren wieder zurückerhalten haben oder bis Sie den Nachweis erbracht haben, dass Sie die Waren zurückgesandt haben, je nachdem, welches der frühere Zeitpunkt ist.

Sie haben die Waren unverzüglich und in jedem Fall spätestens binnen vierzehn Tagen ab dem Tag, an dem Sie uns über den Widerruf dieses Vertrags unterrichten, an Benjamin Oppl, Drosselweg 18, 50735 Köln, Deutschland, zurückzusenden oder zu übergeben. Die Frist ist gewahrt, wenn Sie die Waren vor Ablauf der Frist von vierzehn Tagen absenden. Sie tragen die unmittelbaren Kosten der Rücksendung der Waren. Sie müssen fuer einen etwaigen Wertverlust der Waren nur aufkommen, wenn dieser Wertverlust auf einen zur Prüfung der Beschaffenheit, Eigenschaften und Funktionsweise der Waren nicht notwendigen Umgang mit ihnen zurückzuführen ist.
