A. General Terms and Conditions with Customer Information
––––––––––––––––––––––––––––––––––––––––––––––––––––––––––

1. Scope
1.1 These General Terms and Conditions (hereinafter referred to as "GTC") of Timo Meyer, operating under "Blossavi" (hereinafter referred to as "Seller"), apply to all contracts for the provision of data created and supplied in digital form (digital content) that a consumer or entrepreneur (hereinafter referred to as "Customer") concludes with the Seller regarding the digital content described by the Seller on the online marketplace Etsy. The inclusion of the Customer's own terms and conditions is hereby objected to unless otherwise agreed.
1.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
1.3 An entrepreneur within the meaning of these GTC is a natural or legal person or a legally responsible partnership who, when entering into a legal transaction, acts in the exercise of their trade, business, or profession.

2. Conclusion of the Contract
2.1 By listing an item on Etsy, the Seller makes a binding offer for the provision of the digital content.
2.2 The Customer may accept the Seller's offer via the online order form provided by Etsy. For this purpose, the Customer places the desired item in their Etsy shopping cart and completes the order process using the steps specified by Etsy. By clicking the button that concludes the ordering process, the Customer declares their acceptance of the offer, thus concluding a contract for the digital content selected by the Customer.
2.3 The contract text is stored by the Seller after the conclusion of the contract and transmitted to the Customer in text form (e.g., email, fax, or letter) following their order submission. The Seller does not provide access to the contract text beyond this.
2.4 Before placing a binding order, the Customer can identify input errors by carefully reading the information displayed on the screen. The browser's zoom function can serve as an effective technical tool to enlarge the display and better detect errors. The Customer may correct their input during the electronic ordering process using the usual keyboard and mouse functions until they click the button concluding the order process.
2.5 The German language is available for the conclusion of the contract.

3. Right of Withdrawal
Consumers generally have a right of withdrawal. Details are provided in the Seller's cancellation policy.

4. Prices and Payment Conditions
4.1 The prices quoted by the Seller are total prices. Value-added tax is not shown as the Seller is a small business under § 19 (1) UStG.
4.2 For payments in countries outside the European Union, additional costs may arise in individual cases, which the Seller does not bear and must be paid by the Customer. These include, for example, costs for money transfers by credit institutions (e.g., bank transfer fees, exchange rate fees).
4.3 The available payment methods are indicated in the Seller's offer on Etsy.
4.4 Payments made via Etsy Payments are processed by Etsy Ireland UC, 66/67 Great Strand Street, Dublin 1, Ireland ("Etsy UC") or – for payments in US dollars or Canadian dollars – by Etsy Inc., 117 Adams Street, Brooklyn, NY 11201, USA ("Etsy Inc."). Further details on Etsy Payments and their terms of use can be found here: etsy.com/legal/etsy-payments/?ref=list
4.5 If prepayment by bank transfer has been agreed upon, payment is due immediately after the contract conclusion, unless a later due date has been agreed upon.

5. Provision of Digital Content
Digital content is provided to the Customer via email or download.

6. Granting of Usage Rights
6.1 Unless otherwise stated in the Seller's description of the content, the Seller grants the Customer a non-exclusive, unrestricted right to use the content for private and commercial purposes.
6.2 Sharing the content with third parties or creating copies for third parties outside the scope of these GTC is prohibited unless the Seller has consented to the transfer of the license to the third party.
6.3 If the contract involves the one-time provision of digital content, the granting of rights only becomes effective upon full payment of the contractual fee by the Customer. The Seller may allow preliminary use of the content before this time. However, this does not result in a transfer of rights.

7. Liability for Defects
The statutory liability for defects applies.

8. Applicable Law
The laws of the Federal Republic of Germany apply to all legal relationships between the parties, excluding the laws on the international sale of goods. For consumers, this choice of law only applies insofar as the protection afforded is not withdrawn by mandatory provisions of the law of the country where the consumer has their habitual residence.

9. Alternative Dispute Resolution
The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

B. Right of Withdrawal
–––––––––––––––––––––

Introduction
Consumers are entitled to a right of withdrawal under the following conditions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activities.

Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without providing any reason.
The withdrawal period is fourteen days from the date of the conclusion of the contract.

To exercise your right of withdrawal, you must inform us (Timo Meyer, Blossavi, Weizenkamp 4, 21614 Buxtehude, Germany, Tel.: +49 15203882938, Email: hello@blossavi.de) by means of a clear declaration (e.g., a letter sent by post or email) of your decision to withdraw from this contract.
You may use the attached model withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send the notification of your exercise of the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal
If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract.

We will use the same means of payment for the refund that you used for the original transaction unless expressly agreed otherwise with you; in no case will you be charged any fees for this refund.

Expiry of the Right of Withdrawal
The right of withdrawal expires prematurely if we have begun to perform the contract after you have expressly agreed that we may begin performance before the expiry of the withdrawal period, and you have acknowledged that your right of withdrawal will be lost once the contract has been fully performed.

4) Rights of the Data Subject
4.1 Under applicable data protection law, you have comprehensive rights regarding the processing of your personal data, which we inform you about below:

Right of Access (Article 15 GDPR): You have the right to obtain information about your personal data processed by us, the purposes of the processing, the categories of processed personal data, the recipients or categories of recipients to whom your data has been or will be disclosed, the planned storage period or the criteria for determining the storage period, the existence of a right to rectification, deletion, restriction of processing, objection to processing, the right to lodge a complaint with a supervisory authority, the origin of your data (if not collected by us), the existence of automated decision-making, including profiling, and, if applicable, meaningful information about the logic involved and the significance and intended consequences of such processing for you.

Right to Rectification (Article 16 GDPR): You have the right to request the immediate correction of inaccurate data concerning you and/or completion of incomplete data stored by us.

Right to Deletion (Article 17 GDPR): You have the right to request the deletion of your personal data under the conditions outlined in Article 17(1) GDPR. This right does not apply, however, if processing is necessary for the exercise of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise, or defense of legal claims.

Right to Restriction of Processing (Article 18 GDPR): You have the right to request the restriction of processing of your personal data if you dispute the accuracy of your data, for the duration of its verification; if you oppose the deletion of your data due to unlawful processing and instead request restriction; if you need the data to assert, exercise, or defend legal claims after the data is no longer needed for the original purposes; or if you have objected to processing pending verification of whether our legitimate grounds outweigh yours.

Right to Data Portability (Article 20 GDPR): You have the right to receive your personal data in a structured, commonly used, and machine-readable format or to request its transfer to another controller, where technically feasible.

4.2 Right to Object: If we process your personal data based on a legitimate interest as defined in Article 6(1)(f) GDPR, you have the right to object to this processing at any time for reasons related to your particular situation, with effect for the future.

5) Data Retention Period
The retention period for personal data is determined by the applicable legal basis, the purpose of processing, and statutory retention periods.

6) Reference to Etsy's Privacy Policy
