4.6 The buyer agrees that upon delivery of the package by the shipping service, they will open the package in the presence of the delivery person if they notice external damage, signs of tampering, or suspicious noises inside the package. To be able to make future insurance claims, the buyer must take photos of both the unopened damaged shipping packaging and the defect on the product. The buyer ensures that the package is intact and has no visible damage and that any defects in the package or the goods are recorded in the shipping documents of the delivery service. Further actions required by the buyer in such a case are described in the section "Product Quality and Complaints."

5. PRODUCT QUALITY AND COMPLAINTS

Introduction

Consumers/buyers are natural persons acting for purposes that are not self-employed or commercial. The following right of withdrawal and conditions apply in such cases:

5.1 The quality of the goods in the seller’s online store complies with the manufacturer’s standards and the laws of the country of origin of the goods.

5.2 The goods offered and sold by the seller are used goods. Due to their nature, they may show natural signs of wear and damage, which do not constitute a disadvantage or defect of the product and do not justify a price reduction or a complaint. Significant damage, signs of wear, etc., will be stated in the product details where possible and can be explained further at the buyer’s request. The seller does not guarantee that the quality of the purchased or received products, services, information, or other materials will meet the buyer’s expectations or that any errors in the service will be corrected.

5.3 When purchasing used electronic items such as lamps or other electrical devices, particularly those imported from another country, it is important to note that adjustments may be necessary to meet local safety standards and regulations. Electrical systems and standards vary from country to country, so consulting a professional is recommended to ensure that purchased items comply with local requirements and can be used safely. A professional can, for example, advise on whether and what modifications or adaptations are necessary to make the electronic items compatible with local power grids or to consider other safety aspects. It is important to emphasize that the seller is legally not permitted to provide advice or recommendations on such adaptations. This is because the seller may not have sufficient knowledge of local regulations and standards and therefore cannot offer reliable advice on this matter. Instead, it is the buyer’s responsibility to inform themselves about applicable regulations and requirements before purchasing used electronic items and, if necessary, consult a professional to ensure compliance with local standards and safe use.

5.4 If the goods arrive with damage caused during delivery (4.6), the customer must inform the seller as soon as possible (within 48 hours) and provide photos of the goods, the packaging in its unopened state, and the goods while still packed, as well as a document from the delivery service. Further actions will be agreed upon between the seller and the buyer.

5.5 If the buyer has not received their package within three weeks from the shipping date, they must inform the seller within these three weeks about the status of the delivery. Only packages reported as lost or missing within three weeks can be processed through the shipping insurance. If a loss is reported later, the seller cannot be held liable for damages resulting from the loss or be responsible for compensation.

5.6 If the customer has complaints about the quality of the goods (not related to damages during delivery), they must notify the seller in writing via email at hello@bottegajacobs.com within 14 days of receiving the goods. The seller will review the buyer’s complaints as soon as possible and communicate their decision to the buyer. In the event of a legal dispute, the seller will make every effort to resolve the dispute through negotiations.

5.7 The right of withdrawal does not apply to buyers who, at the time of contract conclusion, are not members of the European Union and whose residence and delivery address are outside the European Union.

5.8 To exercise the right of withdrawal, the buyer must inform the seller of their decision via a clear statement. The buyer may use the attached model withdrawal form, though this is not mandatory. To meet the withdrawal deadline, it is sufficient for the customer to send their notice of withdrawal before the deadline expires.

5.9 The buyer meets the deadline if they return the goods to the seller before the 14-day period expires. The buyer bears the direct costs of returning the goods. Returns can only be sent to the following address: Bottega Jacobs / Paul Jacobs, Viale della Repubblica 82, 56020 Santa Maria a Monte, PI, Italy.

5.10 The originally incurred shipping costs are non-refundable. Bottega Jacobs reserves the right to reject returns that do not meet the specified requirements. If your return is rejected, the item will be sent back to you at your expense, and no refund will be issued.

6. RETURNS AND REFUNDS

6.1 If the goods purchased from our online store do not meet your expectations for any reason, you may, under Italian law, file a complaint, exchange them for another item, or receive a refund within the European Union and within 14 days of receiving the goods, under the specified conditions.

6.2 Please note that the following items cannot be returned:

- Custom-made items with modifications to the product
- Discounted items
- Used and/or damaged after receipt
- Gift vouchers

6.3 Once the seller has confirmed the refund process, the buyer may return the goods (preferably in the original packaging) using a courier service of their choice. The shipping costs and the risk of loss or damage to the goods during transport are the sole responsibility of the buyer.

6.4 After receiving the returned goods, the seller will, at their discretion, either replace the goods within seven business days (if stock is available) or refund the buyer for the purchase amount.

7. FORCE MAJEURE

7.1 The seller cannot be held liable for failing to fulfill obligations to the buyer if such failure is caused by force majeure, such as war, strikes (affecting the company or one of its service providers), lockouts, accidents, fire, snow, floods, severe weather, communication and/or transportation disruptions or suspensions, blockades, export restrictions, import or export bans, production or supply halts, or regulatory decisions by supervisory authorities.

7.2 In such cases, the seller will inform the buyer of the failure to fulfill obligations and the measures taken.

8. INTELLECTUAL PROPERTY PROTECTION

8.1 The content of the websites www.buzzidining.com and www.etsy.com/shop/buzzidining is the intellectual property of the copyright holder.

8.2 Any reproduction, copying, imitation, publication, transmission, sale, or commercial use of one or more intellectual property rights in any medium or in part requires prior written authorization from the copyright holder.

9. LIMITATION OF LIABILITY

9.1 The services of Bottega Jacobs, as well as its owners, managers, employees, and third parties, are not liable for indirect or incidental losses, including loss of profit, data, reputation, or other intangible losses resulting from the ability or inability to use the service; any statements or actions by third parties; any information obtained through the use of the service; or unauthorized access to the service.

10. DISPUTES AND APPLICABLE LAW

10.1 Any disputes and disagreements arising between the parties regarding the use of the service will be settled through negotiations. If negotiations fail, the courts in Florence, Italy, will have jurisdiction over the matter.
