Custom Order & Intellectual Property Agreement
By purchasing a custom Sprout design, the buyer acknowledges and agrees that any Sprouts created featuring brand names, logos, likenesses, or trademarked imagery are produced strictly at the request and direction of the purchaser. The purchaser affirms that they have the legal right, permission, or license to use any such branding, imagery, or intellectual property requested for their custom order. The seller assumes no responsibility or liability for any intellectual property disputes, claims, or legal actions that may arise from the use, display, or distribution of custom Sprouts created under purchaser instruction.
All Sprouts, including custom and non-custom designs, remain the intellectual property of the seller. The resale, reproduction, duplication, or commercial redistribution of any Sprouts—custom or otherwise—is strictly prohibited without the seller’s prior written consent. Purchase of a Sprout does not grant the buyer any ownership rights to the design, mold, digital file, or production method used in its creation.
The seller reserves the right to refuse any custom request that may violate copyright, trademark, or intellectual property laws, or that may otherwise pose legal or ethical concerns.
By completing a purchase, the buyer further agrees that all custom orders are produced as novelty decorative accessories and are not intended for commercial branding use, promotional resale, or mass production. The seller shall not be held liable for any damages, losses, legal claims, or third-party actions arising from the buyer’s use, misuse, distribution, or representation of any custom Sprout.
Completion of purchase constitutes full acceptance of these terms and conditions.
