Etsy's own privacy policies apply to data processing carried out by Etsy.
To the extent that Etsy provides me with personal data in connection with an order or communication, I process such data in accordance with this Privacy Policy.

This may include, in particular:
* Name
* Contact details
* Order details
* Billing information
* Payment status
* Content of communications relating to the order
The data is processed for the purposes of performing the contract, providing the purchased digital content, responding to enquiries and, where applicable, handling warranty, withdrawal or refund requests.
The legal basis for this processing is Art. 6(1)(b) GDPR.
Where data is processed in order to comply with statutory obligations, in particular tax or commercial law obligations, the legal basis is Art. 6(1)(c) GDPR.
4. Contact
If you contact me via Etsy's messaging system or by email, I process the data you provide in order to handle your enquiry.
For enquiries relating to an existing or proposed contract, processing is carried out on the basis of Art. 6(1)(b) GDPR.
For other enquiries, processing is carried out on the basis of Art. 6(1)(f) GDPR. My legitimate interest lies in properly responding to enquiries and communicating with customers and interested parties.
5. Payment Processing via Etsy
Payment processing is generally carried out through the payment services offered by Etsy.
Depending on the buyer's place of residence, the selected payment method and the individual transaction, Etsy Ireland UC, Etsy Payments Ireland Limited or other companies affiliated with Etsy may be involved in payment processing.
The available payment methods are displayed during the Etsy checkout process.
As a rule, I do not receive complete credit card details or other complete payment information of the buyer.
Further information regarding the processing of personal data in connection with payment processing can be found in Etsy's privacy and payment policies.

Customer, order and transaction data required for processing orders may be processed in this context.
To the extent that processing is necessary for the performance of the contract, the legal basis is Art. 6(1)(b) GDPR.
Where Billbee processes personal data on my behalf, such processing is carried out in accordance with the statutory requirements governing data processing agreements pursuant to Art. 28 GDPR.
7. Accounting with Lexware Office
I use Lexware Office in order to fulfil my statutory accounting and tax obligations.
In particular, invoice, customer, order and payment data may be processed for this purpose.
Processing is carried out in particular to fulfil statutory accounting, documentation and retention obligations on the basis of Art. 6(1)(c) GDPR.
Where additional processing is required for the proper organisation and performance of my accounting activities, such processing may be based on Art. 6(1)(f) GDPR.
8. Statutory Retention Obligations
Personal data is generally stored only for as long as it is required for the respective processing purpose.
Data will not be deleted where and for as long as statutory retention obligations apply.
In particular, tax and commercial law provisions may require invoice, accounting and business records to be retained for several years.
After expiry of the applicable retention periods, the data will be deleted unless another legal basis requires continued storage.
9. Disclosure of Data to Recipients

C. GENERAL TERMS AND CONDITIONS (GTC)
=====================================
1. Scope
1.1 These General Terms and Conditions apply to all contracts relating to digital content concluded between
Marc Seidl
Am Obstgarten 14
85757 Karlsfeld
Germany
– hereinafter referred to as the "Seller" –
and customers through the Seller's Etsy shop.
1.2 The offer is directed at both consumers and businesses unless otherwise stated in the respective product description.
1.3 A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their self-employed professional activity.
1.4 A business or entrepreneur is a natural or legal person or a partnership with legal capacity that, when entering into the legal transaction, acts in the exercise of its commercial or self-employed professional activity.
1.5 Digital content within the meaning of these General Terms and Conditions means data that is created and supplied in digital form and is not provided on a tangible medium.
2. Conclusion of Contract
2.1 The presentation of a digital item in the Etsy shop constitutes an offer to conclude a purchase contract under the conditions stated in the respective product description.
2.2 The customer may select an item using the ordering functions provided by Etsy and proceed through Etsy's designated checkout process.
2.3 Before finally submitting the order, the customer can review and, where applicable, correct their entries using the functions provided by Etsy.
2.4 The contract is concluded when the customer completes the Etsy checkout process using the designated final order button and the order is processed or confirmed accordingly by Etsy.
2.5 Payment processing and the technical handling of the ordering process are carried out in accordance with Etsy's applicable terms and technical functions.
2.6 Information relating to the order is made available to the customer via Etsy. Etsy may in particular provide the customer with an order confirmation or receipt on a durable medium, for example by email.
2.7 The input and contract language depends on the language and display options available to the customer on Etsy. The German version of these General Terms and Conditions shall prevail unless mandatory statutory provisions provide otherwise.
3. Subject Matter of the Contract and Provision of Digital Content
3.1 The subject matter of the contract is exclusively the digital content described in the respective product description.
3.2 No physical item will be delivered unless explicitly stated otherwise in the respective product description.
3.3 The digital content is generally made available electronically through the download options provided by Etsy following successful payment processing.
3.4 The type, scope, file format, resolution, dimensions, number of files and other characteristics of the digital product are specified in the respective product description.
3.5 The customer is responsible for checking before purchase whether the file formats and technical requirements specified in the product description are suitable for the customer's intended use. The customer's statutory rights in the event of a defect in the digital product remain unaffected.
4. Prices and Payment
4.1 The price displayed on Etsy at the time the order is placed shall apply.
4.2 Any taxes collected or remitted by Etsy pursuant to statutory requirements will be taken into account in accordance with Etsy's calculation for the respective order during the checkout process.
4.3 The available payment methods are displayed to the customer during the Etsy checkout process.
4.4 Payment processing is carried out through Etsy or payment service providers used by Etsy.
5. Functionality and Compatibility
5.1 Information regarding the functionality, file format and essential technical requirements of a digital product can be found in the respective product description.
5.2 Where specific software, hardware, programs or applications are required in order to use a digital product, this will be stated in the product description insofar as it is essential for the ordinary or explicitly intended use.
5.3 The statutory requirements concerning the conformity of digital products remain unaffected.
6. Rights of Use
6.1 Upon full payment, the customer receives a non-exclusive right to use the purchased digital content within the scope specified in the respective product description.
6.2 Unless further rights of use are expressly granted in the product description, use is permitted exclusively for private, non-commercial purposes.
6.3 Where the product description expressly permits commercial use, the scope of such use is determined by the licence terms stated in the product description.
6.4 Irrespective of any permitted commercial use, the following is not permitted without express authorisation:
* reselling the purchased original digital file,
* distributing the original file free of charge or for payment,
* making the file publicly available on download, file-sharing or similar platforms,
* offering the original file or only insignificantly modified versions as a separate digital product,
* granting sublicences to third parties in relation to the original file.
6.5 Further rights may arise from the respective product description.
6.6 Copyright and other intellectual property rights remain with the respective rights holder. The purchase transfers only those rights of use that are expressly granted.
7. Statutory Rights in the Event of Defects
The statutory provisions relating to liability for defects and the provision of digital products apply, in particular Sections 327 et seq. of the German Civil Code (BGB).
The customer's statutory rights are not restricted by these General Terms and Conditions.
8. Right of Withdrawal
Consumers generally have the statutory right of withdrawal.
Details are set out in the cancellation policy below.
In the case of digital content that is not supplied on a tangible medium, the right of withdrawal may expire prematurely if the statutory requirements are met.
9. Applicable Law
The law of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods.
For consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence.
10. Consumer Dispute Resolution
The Seller is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

Special Information on the Expiry of the Right of Withdrawal for Digital Content
In the case of a paid contract for digital content that is not supplied on a tangible medium, the right of withdrawal expires before the end of the fourteen-day withdrawal period if all statutory requirements are met.
This requires, in particular, that:
1. performance of the contract has begun,
2. you have expressly consented to performance beginning before the end of the withdrawal period,
3. you have confirmed your understanding that, by giving such consent, you lose your right of withdrawal once performance of the contract begins, and
