Got an IRS penalty notice (CP14, CP501, CP503, CP504 Notice of Intent to Levy, or similar)? The penalty portion may be removable, but the decision order changed in July 2026.

AUTOMATIC RELIEF COMES FIRST: For eligible original returns, the IRS's new Automatic Exemption from Penalty (AEP) can prevent certain failure-to-file, failure-to-pay, or failure-to-deposit penalties during processing. AEP is automatic and free; no application, form, phone request, or paid kit is required. It does not cover every return or penalty, and it does not erase tax or interest.

If your notice still shows an assessed penalty, first identify the return period and ask the IRS whether AEP should have applied. First-Time Abatement remains requestable only for IRS-listed transition returns. When neither administrative path resolves the penalty, documented reasonable cause, Form 843, or an appeal may still fit.
