The Charter of Fundamental Rights of the European Union codifies in the legal framework of treaties that establish and govern the EU the basic human rights that must be respected by EU laws and institutions. It is, in short, the EU’s bill of rights and builds on the European Convention on Human Rights of 1950. The charter was first drafted in 2000 and “solemnly proclaimed” by the European Parliament, the Council of the European Union, and the Commission of the European Communities (now called simply the European Commission).

However, the charter lacked the force of law, and the failure of the proposed European Constitution in 2005 undermined efforts to make the charter legally binding. These efforts were renewed a few years later when, as the UNHCR’s Refworld database explains, “The Charter was proclaimed at Strasbourg on 12 December 2007 by the European Parliament, the Council and the Commission …. This text repeats and adapts the Charter proclaimed on 7 December 2000.” The updates and adaptations in the text adopted in 2007 largely serve to clarify limits on the EU’s authority and powers in relation to the charter and the sovereignty of its member states.

The Treaty of Lisbon, which amended the Maastricht Treaty of 1992 and the Treaty of Rome of 1957 — the two treaties which form the constitutional basis of the EU — was signed the next day, 13 December 2007, and made the charter as binding as those foundational treaties. Xavier Groussot, associate professor of law in the Faculty of Law at Lund University in Sweden, and Laurent Pech, lecturer in law and Jean Monnet Chair in EU Public Law at the National University of Ireland, Galway (now the University of Galway), make clear: “With the entry into force of the Lisbon Treaty [on 1 December 2009], the Charter has finally become a legally binding and core element of the Union’s legal order.”

“The Charter is a great achievement,” stated Věra Jourová, the European Commission’s vice president for values and transparency, in 2019. “With the Charter, we agreed on a set of shared values and fundamental rights that serve as a compass to guide our actions. The Charter is a symbol of our shared European identity, the knowledge that we all belong to a community of values where fundamental rights are respected; where democracy and the rule of law prevail.”
