General Terms and Conditions - Cancellation Policy & Cancellation Form

§ 1 Provider, inclusion of the terms and conditions
(1) These General Terms and Conditions of the Etsy Shop BubiduDE Owner: GALWANI Schmuck GmbH, Dänholmstr. 7, 18439 Stralsund, Germany
apply to all contracts for the delivery of jewelry or goods that a consumer or entrepreneur concludes with the seller, the goods presented by the seller on the Internet trading platform Etsy.com.
(2) A consumer within the meaning of these Terms and Conditions is any natural person who enters into a legal transaction for purposes that are predominantly attributable neither to his commercial nor his independent professional activity.

§ 2 Offer of goods and conclusion of contract
(1) By placing an item on Etsy.com, the seller makes a binding offer to sell this item.
(2) The customer can accept the offer of the seller BubiduDE via the online order form provided on Etsy. To do this, the customer must first place the desired item in the shopping cart at Etsy and then go through the order steps specified by Etsy. By clicking the final order button, the customer declares acceptance of the offer, whereby a purchase contract for the jewelry or merchandise previously selected by the customer is concluded.
(3) The text of the contract is stored by the seller BubiduDE and sent to the customer in text form after the conclusion of the contract including these terms and conditions and customer information.
(4) Only the German language is available for the conclusion of the contract.

§ 3 Prices and payments
(1) The sales prices stated by the Seller are total prices and include the statutory value added tax. Any additional delivery and shipping costs will be indicated separately in the respective product description.
(2) For deliveries in countries outside the European Union, additional costs may be incurred in individual cases for which the Seller is not responsible and which are to be borne by the Customer. These include, for example, higher costs for payment transmission by banks or customs duties or taxes. Further costs may be incurred in relation to payment transmission if the delivery is not made to a country outside the European Union, but the customer makes the payment from a country outside the European Union.
(3) Various payment options are available to the customer, which are indicated in the seller's offer at Etsy.com.
(4) If prepayment by bank transfer is agreed upon at the conclusion of the purchase, the payment is due immediately after the conclusion of the contract, unless both parties have agreed upon a later payment date.
(5) If payment is made by PayPal, the payment will be processed by the payment service provider PayPal Europe S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg, subject to the PayPal Terms of Use, available at www.paypal.com/de/webapps/mpp/ua/useragreement-full. This requires, among other things, that the customer opens a PayPal account or already has such an account.

§ 4 Shipping and delivery times
(1) The delivery of jewelry or goods is made by shipping to the delivery address provided by the customer, unless otherwise agreed.
(2) If the transport company sends the goods or jewelry back to the seller because a delivery to the customer was not possible, the customer bears the costs for the unsuccessful shipment.

§ 5 Right of withdrawal
(1) Consumers are generally entitled to a right of withdrawal.
(2) Information on the right of withdrawal can be found in the seller's cancellation policy.
(3) The right of withdrawal does not apply to consumers who do not belong to a Member State of the European Union at the time of conclusion of the contract and whose sole place of residence and delivery address at the time of conclusion of the contract is outside the European Union.

§ 6 Liability for defects
(1) If the purchased item is defective, the provisions of the statutory liability for defects shall apply.
(2) The Customer is requested to immediately complain about delivered goods with obvious transport damages to the deliverer and to inform the Seller thereof. If the customer does not comply with this, this has no effect on his legal or contractual claims for defects.

§ 7 Applicable law
(1) The law of the Federal Republic of Germany shall apply to all legal relationships between the parties to the exclusion of the laws on the international purchase of movable goods.

§ 8 Alternative Dispute Resolution
(1) The EU Commission provides a platform for online dispute resolution on the Internet at the following link: https://ec.europa.eu/consumers/odr.
This platform serves as a contact point for the out-of-court settlement of disputes arising from an online purchase or service contract involving a consumer.
(2) The Etsy seller BubiduDE is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.



Cancellation policy

Right of withdrawal

You have the right to revoke this contract within fourteen days without giving any reason. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods.

To exercise your right of withdrawal, you must inform us (GALWANI Schmuck GmbH, Dänholmstraße 7, 18439 Stralsund, phone 49 (0) 38314457990, e-mail kundenservice@galwani.de) by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract.

To comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the expiry of the revocation period.

Consequences of revocation

If you revoke this contract, we shall reimburse you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered by us), without undue delay and no later than within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment.

We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any case no later than within fourteen days from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days.

You shall bear the direct costs of returning the goods.

You will only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing the condition, properties and functioning of the goods.

Exceptions to the right of withdrawal

The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
