These API Terms of Use (“API Terms”) between you and Etsy apply to your use of the Etsy API, alone or in combination with the Etsy Site, Etsy Apps, or Etsy Services (as each of those terms are defined below).
If you live in North America or South America, this agreement is between you and Etsy, Inc. If you live elsewhere, this agreement is between you and Etsy Ireland UC, a subsidiary of Etsy, Inc. We’ll refer to Etsy, Inc. and all of its subsidiaries collectively as “Etsy”.
By registering for a developer account, or by accessing or using the Etsy API, you agree to (i) these API Terms and (ii) the Etsy's Terms of Use (“Etsy Terms”) (collectively, the “Terms”) and acknowledge receipt and notice of the Privacy Policy. If you are accepting these Terms on behalf of an entity, you represent and warrant that you have the legal authority to bind the entity. All references to “you” throughout these Terms include reference to such entity.
Please note that Section 11 of the Etsy Terms, which applies to your use of the Etsy API, contains a binding arbitration agreement and class action waiver for users in North and South America, and explains how you may be able to opt out of arbitration. By agreeing to the Terms, you and Etsy agree to submit any disputes between us exclusively to individual arbitration and not to sue in court, except in the limited circumstances described in Section 11 of the Etsy Terms.
Definitions. “Etsy API” means all application programming interfaces, Developer Tools, and any related documentation or materials made available by Etsy. “Developer Tools” means the software development kits, webhooks, developer specifications, technical documentation, and other related resources made available at https://developers.etsy.com/. We’ll refer to Etsy.com as the “Etsy Site”, Etsy’s mobile applications as the “Etsy Apps”, and Pattern by Etsy, Etsy Payments, the Etsy API, and our other services, together with the Etsy Site and Etsy Apps, collectively as the “Etsy Services”. Buyers and sellers who use Etsy Services are “Etsy Members”.
Modifications. Etsy may update these API Terms, including the Enterprise Tier Terms, from time to time, including by adding entirely new terms and deleting existing terms. If the changes are material, we’ll let you know in advance by sending you an email or posting a notice to your Developer Account. Your use of the Etsy API after the effective date of the changes constitutes your acceptance of the updated API Terms. If you do not agree with the changes, you must immediately stop using the Etsy API and close your Developer Account. No other amendment to or modification of these API Terms is effective unless it is in writing and signed by both parties.
1. License to Use the Etsy API
Subject to these API Terms, Etsy grants you a limited, non-sublicensable, non-transferable, non-exclusive and revocable license to access and use the Etsy API solely to develop, create, share and run Applications that integrate with the Etsy Services. “Application” means any software, website, integration or other tool that accesses or utilizes the Etsy API and which you make available to Etsy sellers or use in conjunction with your Etsy shop(s).
Ownership of Etsy API. Etsy retains all rights, title and interest, including all intellectual property rights, in the Etsy API. You acknowledge and agree that any rights in the Etsy API acquired by you, in the past, present or future, whether by operation of law or otherwise, are hereby irrevocably assigned to Etsy, and upon Etsy’s request, you will complete all necessary or appropriate documentation to give full effect to such assignment.
Your use of the Etsy API is limited to the rights expressly granted in these API Terms. Violation of these API Terms may result in immediate suspension or termination of your access to the Etsy API or your Developer Account (including related accounts).
Etsy’s Trademarks. You agree not to use Etsy’s trademarks, logos, trade dress (including signature colors, layout and text), or other brand elements in any manner that could suggest an endorsement by or affiliation with Etsy. Similarly, you are prohibited from creating or using any mark, name or design that is confusingly similar to Etsy’s trademarks. If you would like to use Etsy’s trademarks in connection with your use of the Etsy API, you may do so only if you agree to and follow our Trademark Policy and the requirements below.
Given that your Application is your own creation, Etsy’s trademarks must appear less prominently than your own branding. When publicizing or sharing your Application, you are permitted to state that it was developed using the Etsy API, but you cannot imply that your Application is endorsed or certified by Etsy.
To prevent any potential confusion, you must prominently display the following statement within your Application: "The term 'Etsy' is a trademark of Etsy, Inc. This Application uses Etsy's API, but is not endorsed or certified by Etsy."
2. Your Developer Account
Developer Account. To access and use the Etsy API, you must first register for an Etsy developer account (“Developer Account”), request access to the Etsy API as set out in Section 3, indicate whether you wish to use the Etsy API for personal or commercial use, and provide all required information in an accurate, true and complete manner. Your Developer Account is solely for your own use, and you are responsible for all activities through your account (if you are a business entity, this includes individuals you designate as authorized users and you will be solely responsible for such users). Etsy may reject a request for Etsy API access for any reason, in our sole discretion. You understand that Etsy will use the email address that you have associated with your Developer Account (the “Developer Email Address”) as the primary method of communication.
Good Standing. It is your ongoing responsibility to keep your Developer Account information accurate, true and complete by updating it as needed within your Developer Account or contacting developer@etsy.com, and in good standing by complying with the requirements set out in the Terms (including the Enterprise Tier Terms where applicable) and the Developer Tools. Failure to do so may result in the suspension or termination of your Developer Account or access to the Etsy API. Etsy may, from time to time, request additional information from you or about your Application to ensure compliance with the Terms. You agree to provide such information in a timely and accurate manner.
Protect your API Credentials. You are responsible for maintaining the security of your Etsy API credentials and your Developer Account. Etsy is not liable for any loss or damage arising from your failure to maintain the security of your Etsy API credentials and your Developer Account. If you discover any security concerns or suspect that your account has been compromised, you must immediately notify Etsy at security@etsy.com.
API Rate Limits. Each API key is allocated by default a set number of API Calls per day as specified in the Etsy API developer documentation (such limit, your “API Rate Limit”). Each API key may only be used for a single Application, and each Application may only use its designated API key. “API Calls” refers to any instance where your Application transmits a request to the Etsy API.
Etsy may, in our sole discretion, set, grant, enforce, modify or restrict your API Rate Limit and your use of the Etsy API. Creating or attempting to create additional API keys to circumvent these limitations is strictly prohibited. You may request an increase in your API Rate Limit by contacting developer@etsy.com. Etsy may grant requests for higher API Rate Limits at its discretion, and may condition acceptance of such requests on your agreement to additional terms and/or charges.
Enterprise Tier. To increase the API Rate Limit for your Application to more than three (3) million API Calls per day, your Application must qualify for the “Enterprise Tier” and meet the eligibility criteria described in Section 1 of the Enterprise Tier Terms. If your Application is eligible and you opt your Application into the Enterprise Tier, you acknowledge and agree to the Enterprise Tier Terms, which is hereby incorporated by reference. Any Application that is in the Enterprise Tier is an “Enterprise Application”.
3. Application Requirements
Application Purpose and Updates. You must submit the purpose of your Application (the “Application Purpose”), as well as any updates to the Application, for Etsy’s prior approval, which may be granted or withheld at Etsy’s sole discretion. You may receive access to the Etsy API only after Etsy’s approval of your Application Purpose.
Prior to making your Application available to Etsy sellers or using it on your own Etsy shop, you must ensure that your Application is fully functional, tested for bugs and defects, consistent with the Application Purpose submitted to and approved by Etsy, and compliant with all applicable Terms (including the Enterprise Tier Terms where applicable) and Developer Tools. Etsy may, in its sole discretion, list Applications made available to sellers on its Etsy Apps page. Etsy has sole discretion regarding the location and form of display of Applications on the Etsy Apps page.
Etsy reserves the right to review, test and conduct technical audits of your Application at any time to ensure your compliance with these API Terms. You will cooperate with Etsy in the reviewing and testing of an Application and answer questions and provide information as reasonably requested regarding your Application. Etsy may require you to make modifications of your Application in order to comply with the Terms. In such an event, you will make any required modification within a reasonable period of time as determined by Etsy.
Service Support. You must provide service support to all Etsy sellers using your Application. Your Application must include a monitored email address that Etsy sellers can use to contact your Application for support. You will respond to all such inquiries from Etsy sellers in a reasonable and timely manner.
Application Terms and Warranty Disclaimer. You will enter into enforceable terms, including a privacy policy, with your Application’s users which are consistent with your obligations under the Terms and which grant any necessary license or right to use your Application (“Application Terms”). The Application Terms will be between you and the user and will not create or imply any obligation on Etsy. You will ensure that users are required to accept the Application Terms in a manner that is legally enforceable, including but not limited to a click-through or equivalent user experience. The Application Terms must also include a warranty disclaimer substantially similar to the following:
DISCLAIMER: THIS APPLICATION IS SOLELY PROVIDED BY [INSERT DEVELOPER NAME] (THE “APPLICATION DEVELOPER”). YOU ACKNOWLEDGE THAT ETSY, INC. AND ITS AFFILIATES ARE NOT THE APPLICATION DEVELOPER, DO NOT PROVIDE THE APPLICATION SERVICE, AND MAKE NO WARRANTIES OF ANY KIND WITH RESPECT TO THE APPLICATION OR DATA ACCESSED THROUGH IT.
Application Fees, Invoicing, and Taxes. You, and not Etsy, are (i) the sole person or entity providing the Application to Application users; and (ii) the sole person or entity responsible for invoicing and collecting any fees (including any applicable taxes) from Application users for the Application. Etsy bears no responsibility for charging fees or taxes to Application users.
Discontinuation of Application. If you no longer wish to maintain your Application or use the Etsy API, you may discontinue or withdraw your Application by providing at least thirty (30) days’ prior written notice to Etsy and Etsy sellers that are using your Application (the “Withdrawal Notice Period”), unless Etsy, at its sole discretion, agrees to a shorter Withdrawal Notice Period or determines that immediate suspension or termination of your Application’s access to the Etsy API is necessary. During any Withdrawal Notice Period, you agree to maintain your Application and provide support and transitional services to the Etsy sellers using your Application. Upon the effective date of discontinuation or withdrawal, the Etsy API access associated with that Application will be terminated. Notwithstanding the foregoing, if your Application is an Enterprise Application, the discontinuation and withdrawal requirements for such Enterprise Application will be governed by the Enterprise Tier Terms.
Dormant Applications. If an Application has not made a successful call to the Etsy API for six (6) consecutive months, Etsy reserves the right to suspend such Application’s access and/or your access to the Etsy API. To request that access be reenabled, you may contact developer@etsy.com.
4. Your Privacy and Etsy Member Privacy
Information We Collect About You. We know your personal information is important to you, so it’s important to us. We collect certain information about you when you use Etsy Services, including in connection with your use of the Etsy API. Our Privacy Policy details how this information is collected, used and shared by Etsy.
Personal Information of Etsy Members. With respect to any personal information relating to Etsy Members that you access via the Etsy API, you acknowledge that you act as a service provider to the applicable Etsy seller and will process such data only to fulfill the services that you provide under the Application Terms between you and the Etsy seller. You represent and warrant that you have executed Application Terms with each Etsy seller that comply with all applicable privacy laws and that you will process Etsy Member personal information accessed in connection with the Etsy API in accordance with the Application Terms and all applicable privacy laws. This includes transparently informing Etsy sellers regarding the information collected by your Application, the manner in which such information is used, stored, secured and disclosed, and the controls that Etsy sellers have over the use, sharing and access of their information. Failure to maintain transparent and sufficient Application Terms may result in your Etsy API access being suspended or terminated.
5. Use of the Etsy API
Developer Responsibility. You are responsible for your use of the Etsy API and your Application, including but not limited to developing, operating, and maintaining your Application and the provision of services through the Application. You must ensure that your Application, its content, and your use of the Etsy API comply with all applicable laws and regulations, including intellectual property, privacy, telecommunications, and commercial laws, and the Terms and all applicable policies, including the Intellectual Property Policy, which may be modified from time to time. Your Application, its content, and your use of the Etsy API must not infringe upon any intellectual property or other right of any third party, or violate any agreements to which you are a party.
Etsy has no responsibility or control over the content that you, your Application, or your Application’s users upload or transmit through the Etsy API. Under no circumstances shall Etsy be liable for your Application or any damages, losses, claims, or liabilities arising from it. Etsy expects your use of the Etsy API to be in good faith and in the spirit of Etsy.
Rights You Grant Etsy. You grant Etsy a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use, display, edit, modify, reproduce, publicly display and perform, distribute, store, and prepare derivative works of any data or information that you provide or transmit to Etsy in connection with the Etsy API. This allows us to provide and improve the Etsy API, including displaying information to Etsy Members in connection with your Application, and for Etsy’s uses and purposes set forth in the Privacy Policy.
Display of Data. The Etsy platform and its data are subject to frequent changes. Data accessed through the Etsy API can change frequently. You will not display listing content more than six (6) hours older than the corresponding information on the Etsy Site or the Etsy Apps. You will not display any other Etsy content more than twenty-four (24) hours older than the content displayed on the Etsy Site or the Etsy Apps. Once you’ve accessed, stored, or displayed Etsy content, you will not cache or store it longer than is reasonably necessary to provide service to your Application’s users.
Members’ Content. When using the Etsy API, you may interact with content generated by Etsy Members and/or Etsy Members’ personal information. For clarity, Etsy Members, not Etsy, own the content they create.
Commercial Use. Etsy provides the Etsy API to enable developers to create Applications that may have commercial uses. Etsy, in its sole discretion, may prohibit any commercial use of the Etsy API that it deems inappropriate or does not comply with these API Terms. If you are uncertain as to whether your intended commercial use of the Etsy API is permitted under these API Terms, please contact us at developer@etsy.com.
Prohibited Behavior. Your use of the Etsy API must be in good faith and in the spirit of Etsy. You agree that you will not:
- Attempt to replace or mimic Etsy’s core functionalities, or circumvent the Etsy checkout process;
- Divert sales or migrate Etsy Members from Etsy, or drive traffic to external websites or services unrelated to the Etsy platform;
- Copy, resemble, or mirror the look and feel of the Etsy Site, the Etsy Services, or Etsy’s trademarks or otherwise misrepresent your affiliation with Etsy;
- Engage in any practices that disrupt or adversely affect Etsy’s business, credibility, or reputation, or that could reasonably be expected to harm Etsy or Etsy Members;
- Support, encourage or facilitate the creation of listings or sale of products on the Etsy platform that is incompatible with Etsy’s Creativity Standards and Prohibited Items Policy, including but not limited to mass-produced items;
- Support, encourage, or facilitate the unauthorized downloading, copying, reproduction, or use of Etsy Members’ products, photos or designs, or the infringement of intellectual property rights, including trademarks and copyrights;
- Compromise the security or integrity of the Etsy API or Etsy’s platform, including but not limited to, circumventing security features, exploiting technical limitations, distributing malicious code, or disrupting the user experience on Etsy;
- Modify, alter or tamper with the Etsy API, or use the Etsy API in any manner that poses or could pose a safety or security risk to Etsy, Etsy’s users, or the integrity of the Etsy platform;
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Etsy API, or access or attempt to access any internal or legacy Etsy APIs or data feeds;
- Excessively burden or impose an unreasonable burden on the Etsy API or Etsy platform;
- Create multiple Applications that offer substantially the same services;
- Include code in an Application that performs operations unrelated to the services provided by the Application;
- Improperly handle any Etsy Member data, including processing it unless you have the necessary authorization and only to the extent compliant with your terms of service, your privacy policy and the Terms;
- Upload, post, collect, store, or transmit member ID and password combinations;
- Use the Etsy API for purposes of transmitting spam or other unsolicited marketing communications, or to connect with any third-party advertising or marketing platform;
- Use the Etsy API for purposes of sending to Etsy Members order, shipping and tracking information, whether via email, text or otherwise, unless expressly authorized in writing by Etsy;
- Request more than the minimum amount of data needed from the Etsy API to provide Etsy sellers with the intended Application;
- Transfer or commercialize your access to the Etsy API, your API credentials, or Etsy Member content or data to any third party;
- Use the Etsy API in a manner unrelated to Etsy Member activity, such as to obtain information about Etsy’s internal systems and processes;
- Solicit, incentivize, or encourage reviews of any Application that are fake, misleading, or inaccurate, whether by offering compensation or otherwise;
- Engage in any practice that manipulates or artificially inflates any Etsy shop’s statistics or engagement metrics, including but not limited to ratings, reviews and viewership;
- Charge Etsy sellers a fee to use or access any part of your Application that integrates with the Etsy API and that Etsy provides to Etsy sellers free of charge;
- Develop an Application that violates the Terms or any of Etsy’s policies, including but not limited to, the Prohibited Items Policy, the Intellectual Property Policy and the Anti-Discrimination Policy;
- Use or promote the use of automated systems or browser extensions to access, analyze, or scrape the Etsy Site, the Etsy API or any Etsy data, including but not limited to Etsy listings, shops, or user profiles, unless expressly authorized in writing by Etsy; or
- Use the Etsy API to collect, scan, or otherwise request Etsy content for purposes of analytics, machine learning, training artificial intelligence models, licensing, or content removal, unless expressly authorized in writing by Etsy.
Quality Standards. Etsy reserves the right to take action, including but not limited to suspending or terminating your access to the Etsy API and off-boarding an Application from the Etsy Services, if Etsy determines, in its sole discretion, that the Application does not meet acceptable quality standards (such standards, “App Quality Standards”). This determination may be based on, but not limited to, the following factors: (i) repeated complaints from Etsy Members regarding the Application’s functionality, performance, user experience, security, or compliance with these API Terms, the Etsy Terms, the Application Terms or any of Etsy’s applicable policies; (ii) failure of the Application to operate as described to Etsy or as advertised; (iii) the Application causing technical or instability issues on the Etsy platform or for Etsy Members; or (iv) the Application’s use is prohibited under this Section 5.
Suspension and Termination. Maintaining a high-quality Application that provides a positive experience for Etsy Members is a continual requirement for access to the Etsy API. In the event Etsy identifies concerns regarding the quality of your Application or that your Application or use of the Etsy API violate any of the Terms or documents incorporated by reference in them, Etsy may, but is not obligated to, notify you of these issues and provide a period to remediate the concerns. However, if Etsy deems the violations or quality concerns to be severe or pose an immediate risk to the Etsy platform or Etsy Members, Etsy may suspend or terminate the Application’s access pursuant to Section 6. Etsy’s decision regarding an Application’s quality and any resulting action shall be final and binding.
Changes to the Etsy API. Etsy reserves the right, at its sole discretion, to change, update, suspend, or discontinue the Etsy API, in whole or in part, at any time and for any reason, with or without notice. Such actions may include, but are not limited to, modifying pricing, access, or usage; adding, removing or limiting access to specific API features or functionality; or updating certain technical requirements in the Developer Tools that Applications must meet. You are responsible for implementing and using the most current version of the Etsy API, which may require you to install or update software to continue using the Etsy API, and making any necessary changes to your Application at your own cost. Etsy will not be liable for any impact these changes may have on your Application, including any effects on your revenue generation. Your continued use of the Etsy API following an update constitutes your acceptance of the update.
6. Termination
Termination by Etsy. As noted above and under this Section 6, Etsy may terminate or suspend your access to the Etsy API and/or your Developer Account (including related accounts), in whole or in part, and may suspend or remove your Application, if: (i) you fail to maintain your Developer Account in good standing; (ii) you violate the Terms or any other applicable terms, policies, laws or regulations; (iii) Etsy identifies concerns regarding the quality of your Application or the Application fails to meet the App Quality Standards; or (iv) you engage in any conduct that Etsy determines disrupts or harms Etsy Services, the Etsy platform, Etsy’s business, Etsy Members, the Etsy community, or the security or integrity of Etsy’s systems.
Etsy may notify you of these issues and provide a period to remediate the concerns; however, Etsy is under no obligation to do so. Etsy’s decision regarding an Application’s quality or whether your Application or Developer Account violates the Terms or other applicable Etsy policies is final and binding.
Effects of Termination. Upon any termination or suspension of your access to the Etsy API and/or your Developer Account: (i) all rights and licenses granted to you under these API Terms will immediately cease; (ii) you must immediately cease all use of the Etsy API and any Etsy data; (iii) you must remove all connections or functionalities within your Application that utilize the Etsy API; (iv) you must immediately cease all marketing and promotion of your Application in connection with Etsy, Etsy Services or the Etsy API and remove all Etsy branding and reference; (v) you will remain responsible for and immediately pay all outstanding obligations to Etsy, including any fees owed to Etsy; and (vi) your Application will be removed from the Etsy Services and the Etsy platform.
Survival. These API Terms will remain in effect even after your access to the Etsy API is terminated, or your use of the Etsy API ends.
7. Disclaimer, Indemnification and Release
When you use the Etsy API for an Application, you (and your successors in interest) agree that Etsy’s role is limited to providing the Etsy API as described in these API Terms.
The Etsy API is provided “as is”, and Etsy makes no warranties, express or implied, regarding its functionality, reliability, availability, or suitability for any particular purpose, nor that it will be uninterrupted or error-free. To the maximum extent permitted by applicable law, Etsy disclaims all warranties, including but not limited to warranties of non-infringement, merchantability, and fitness for a particular purpose.
Your use of the Etsy API is subject to the Etsy Terms, including but not limited to:
- Section 8 which contains the limitation of liability.
- Section 9 which contains your indemnification obligations.
- Section 11 which contains an arbitration clause and class action waiver for North and South America.
- Section 12 which contains the dispute resolution for the rest of the world.
You hereby waive any claims against Etsy and Etsy Members, and fully release Etsy and Etsy Members from any claims related to intellectual property, data breach, security, or data protection, arising from or related to your Application’s use of the Etsy API, including but not limited to access to the Enterprise Tier and the interaction of your Application with Etsy or Etsy Services.
You agree not to bring or assist any third party in bringing any intellectual property infringement claim against Etsy or Etsy Members related to your use of and access to the Etsy API, including the interaction of your Application with Etsy or Etsy Services. For clarification, this paragraph pertains solely to your use of and access to the Etsy API and does not extend to unrelated content within your Application or any Etsy shop you may control. You acknowledge that the limitations of liability set forth in the Etsy Terms apply to your use of the Etsy API.
If any Etsy Member data accessed via the Etsy API is compromised or suspected to be compromised (a “Data Breach”), you will promptly notify Etsy at dpo@etsy.com and the Etsy seller, but in no event later than 24 hours from discovery of the Data Breach.
If Etsy is sued or receives any claim, notice, inquiry, or demand arising from or relating to your Developer Account, your Application(s), or your use of the Etsy API (including use under the Enterprise Tier), or your violation of these API Terms (including the Enterprise Tier Terms where applicable), you agree to defend and indemnify Etsy against all resulting liability, damages, costs, expenses, and attorneys’ fees. The full scope of your indemnification obligations to Etsy is further detailed in Section 9 of the Etsy Terms.
8. Feedback
We encourage developers to provide feedback and suggestions (“Feedback”). You agree that Etsy will exclusively own all rights to any Feedback that you submit, including any related intellectual property rights, and you hereby assign all right, title, or interest in Feedback to us. You acknowledge that Etsy is free to use the Feedback without restriction, including to develop and improve the Etsy API and other Etsy products and services. You agree not to provide any Feedback that you consider confidential or proprietary, as Etsy will treat all Feedback as non-confidential and non-proprietary.
9. Non-Exclusive and Independent Relationship
All rights granted and obligations due under these API Terms, to you or to Etsy, are non-exclusive, and therefore nothing under these API Terms will be construed to prohibit either of us from engaging in or participating, either for itself or with one or more third parties, in business arrangements similar to or competitive with those described herein.
Under these API Terms and in connection with your use of the Etsy API, you are not Etsy’s agent, representative or employee. These API Terms do not (i) create or evidence any association, joint venture, partnership, or franchise between the parties; or (ii) impose any partnership or franchisor obligation or liability on either party.
10. Some Finer Legal Points
In the event Etsy and you enter into a separate written agreement regarding the Etsy API, the terms of that agreement will control solely to the extent of any direct conflict with these API Terms. If any part of these API Terms is found to be invalid or unenforceable, that part will be limited to the minimum extent necessary and severed so that these API Terms will otherwise remain in full force and effect. Our failure to enforce any part of these API Terms is not a waiver of our right to later enforce that or any other part of these API Terms. We may assign any of our rights and obligations under these API Terms.
