This Privacy Policy describes how and when I collect, use and share information when you purchase a product from me, contact me, or otherwise use my services through Etsy.com or related sites and services.
This Privacy Policy does not apply to third-party actions that I do not own or control, including Etsy or any third-party services that you access through Etsy. You can refer to the Etsy Privacy Policy to learn more about its privacy policies.
To fulfill your order, you must provide me with certain information (which you authorized Etsy to give me), such as your name, email address, mailing address, payment information and information about the product you are ordering. You can also provide me with additional personal information (for example, for an individual jewelry order) if you contact me directly.
Why do I need your information and how I use it
I rely on a number of legal grounds for collecting, using and sharing your information, including:
as needed to provide my services, for example, when I use your information to fulfill your order, resolve disputes or support clients;
when you gave your affirmative consent, which you can withdraw at any time, for example, by subscribing to my newsletter;
if it is necessary to fulfill a legal obligation or a court order or in connection with a lawsuit, such as storing information about your purchases, if required by tax legislation; and
as necessary for the purposes of my legitimate interests, if these legitimate interests are not revoked by your rights or interests, such as 1) providing and improving my services. I use your information to provide the services you have requested and to improve my services in my legitimate interests; and 2) Compliance with the Etsy Policies and Terms of Use. I use your information as necessary to fulfill my obligations under the Etsy Policies and Terms of Use for Seller.
Information sharing and disclosure
Information about my clients is important to my business. I share your personal information for very limited reasons and under certain circumstances, namely:
Etsy. I share information with Etsy as needed, to provide you with my services and fulfill my obligations in accordance with the Etsy Seller Policy and Etsy Terms of Use.
Service Providers. I use certain trusted third parties to perform functions and provide services to my store, for example, delivery companies. I will transfer your personal information to these third parties, but only to the extent necessary to provide these services.
Business translations. If I sell or merge my business, I can disclose your information in this transaction only to the extent permitted by law.
Compliance with the laws. I can collect, use, store and transfer your information if I have a good faith belief that it is reasonably necessary to: (a) respond to a lawsuit or government requests; (b) enforce my agreements, terms, and policies; (c) prevent, investigate and solve problems of fraud and other illegal activities, security or technical problems; or (d) protect the rights, property, and security of my clients or others.
Data storage
I only keep your personal information as long as necessary to provide you with my services and as described in my Privacy Policy. However, I may also need to retain this information in order to fulfill my legal and regulatory obligations, resolve disputes and enforce my agreements. I usually keep your data for the next period of time: 2 years.
Transfer of personal information outside the EU
I can store and process your information through third-party hosting services in the United States and other jurisdictions. As a result, I may transfer your personal information to a jurisdiction with data protection legislation and government supervision different from that of yours. If it is assumed that I am transferring information about you outside the EU, I rely on Privacy Shield as a legal basis for the transfer, as Google Cloud is certified by Privacy Shield.
Your rights
If you live in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply in general, certain rights apply only in certain limited cases. I will describe these rights below:
Access. You may have the right to access and receive copies of personal information about you, which I store by contacting me using the contact information provided below.
Modify, limit, delete. You may also have the right to change, restrict my use or delete your personal information. In the absence of exceptional circumstances (for example, when I am obliged to store data for legal reasons), I usually delete your personal information upon request.
An object. You may object to (i) my processing of some of your information based on my legitimate interests and (ii) receiving marketing communications from me after receiving your explicit consent to receive them. In such cases, I will delete your personal information if I do not have valid and legitimate reasons to continue using this information or if it is necessary for legal reasons.
Complain. If you live in the EU and want to express concerns about my use of your information (and without prejudice to any of your other rights), you have the right to do so with your local data protection authority.
For the purposes of EU data protection legislation, I, Tetiana Tsiukalo, am the controller of your personal information data. If you have any questions or problems, you can contact me at Tetiana Tsiukalo
